DECLARATION
Ministry of Transport
of 27 March 1964
on the delegation of the competence of the public administration in railway matters
The Ministry of Transport provides according to § 19 and 20 of Act No. 51 / 1964 Coll., on Railways:
(1) The competence of the railway administration is exercised by the Central Directorate of Czechoslovak State Railways and National Railways. *) In the exercise of that competence, they shall:
(a) deliver an opinion on the preparatory documentation of buildings to be connected to a continuous rail network or to increase rail traffic requirements, to carry out construction procedures, to issue building permits and to exercise state building supervision on national and lift tracks;
(b) to carry out approval procedures and to issue authorisations to start operations on national and tug tracks;
(c) agree to start auxiliary operations on national and tugboat tracks;
(d) to allow exemptions from the prohibition of structures in the national and lift railway protection zone and to lay down adequate conditions for construction in the railway protection zone;
(e) co-operate in the decision-making of the District National Committee on the need and scope of measures in the vicinity of national runways and lifts;
(f) establish, in cooperation with the water management authority, the distance between water works and national installations and lifts;
(g) to give consent to the segregation of water into the circuits of national runways and lifts;
(h) to give consent to the conduct of shots in and around the national and lift tracks;
(ch) to discuss with the Mining Authority the arrangements for the contact of national runways and lifts with mining activities;
(i) decide, after consultation with the District National Committee, whether to set up or cancel a station (stop) and change their shipping authority on national routes;
(j) authorise the tug to procure goods for other persons or organisations;
(k) to decide in agreement with the Regional National Committee and the Military Administration on the abolition of and the cessation or limitation of operations on lifts; the approval of the central authority of the superior organisation in charge of the management of the train shall be required to cancel the train;
(l) to cooperate in the decision-making of the District National Committee on the acceptance of the cancelled national and tug track;
(m) to exercise state expert supervision on the railways.
(2) The competence of the Regional National Committee in railway matters remains unaffected.
General administrative rules apply to proceedings in which national rail administrations decide on the rights, legal interests or obligations of citizens and organisations as a railway administrative body. The Ministry of Transport shall decide on the appeal against their decision.
This Decree shall take effect on 1 April 1964.
