Law on voluntary organisations and gatherings

on voluntary organisations and gatherings.
The National Assembly of the Czechoslovak Republic decided on the following Act:
Voluntary organization.
§ 1.
In order to exercise their democratic rights and thus to consolidate the popular democratic establishment and to support the efforts to build socialism, the people are brought together in voluntary organisations, in particular in a single trade union, in women's organisation, in youth organisation, in a single human body and sports organisation, in cultural, technical and scientific associations.
§ 2.
(1) The tasks of voluntary organisation (hereinafter referred to as "organisation") and the way in which the performance of these tasks is ensured shall be determined by its rules of organisation, which shall in addition include, in particular, information on the name of the organisation and its registered office, the perimeter of the activity and internal arrangements.
(2) The organisation shall be subject to the approval of the organisation order. The Organisational Regulations shall be approved by the Regional National Committee of Organisations; If the area of activity exceeds the area of the region, the rules of organisation of the Ministry of Interior shall be approved.
§ 3.
(1) Membership in organisations is voluntary; a member of the organisation may, within the limits of the Organisational Regulations, become a member of any person who may contribute to the performance of his or her tasks by his or her participation.
(2) The principle of organisation construction is democratic centralism. A majority of the votes are sufficient for a resolution; the minority is subject to a majority; the resolutions adopted are binding on all. Members elect democratically functionalists of organisation.
(3) The organisational components deal with their specific tasks separately in accordance with the resolutions of the higher authority; the joint organisation shall, in accordance with the resolutions of the senior body, deal with the tasks for which it has been brought together.
§ 4.
(1) The State takes care of the development of organisations, creates favourable conditions for their activities and growth and ensures that life in them develops in accordance with the Constitution and the principles of popular democratic establishment.
(2) Such care shall be carried out by national committees; it is managed by the Ministry of the Interior, or by central authorities responsible for the organisation's tasks, as regards the general issues of the organisation's activities.
§ 5.
The Revolutionary Trade Union movement, the Unified Union of Farmers, the Czechoslovak Youth Union, the Czechoslovak-Soviet Union of Friendship, the Czechoslovak Union of Women, the Czechoslovak Community of Sokol and the Czechoslovak Red Cross are declared to be organisations under this law. The Ministry of the Interior may declare further organisation (associations) incurred before 1 October 1951 as organisation under this Act.
Assembly.
§ 6.
In accordance with the interests of the working people, citizens are guaranteed the exercise of the right of assembly if they do not threaten the people's democratic establishment or the public room and order.
§ 7.
The conveners of the Assembly and the members of its Bureau shall ensure that order is maintained in the Assembly; each participant shall be obliged to follow their order instructions.
§ 8.
Common provision.
The Minister of the Interior is hereby authorised to issue detailed provisions for the implementation of this Act in an agreement with participating members of the Government.
Transitional provisions.
§ 9.
(1) Associations formed before 1 October 1951 (hereinafter referred to as "associations") which carry out their activities in accordance with the interests of the working people may be transformed into or incorporated into organisations; the association may also be transformed into another appropriate body or incorporated into it. The way in which the associations are transformed or incorporated, as well as the demise of the remaining associations, and the way in which their property is handled, the Ministry of the Interior shall, in agreement with the central authorities involved, amend the general legislation.
(2) A resolution by the Board (committee) is sufficient to break up the association.
§ 10.
(1) Pending their conversion, incorporation or termination, the associations continue to operate according to their existing statutes; financial measures, in excess of ordinary administration, may be taken only after the prior agreement of the Regional National Committee or the authority empowered by the Regional National Committee.
(2) The Regional National Committees require the associations to submit the information necessary to assess their activities.
Final provisions.
§ 11.
Measures taken before 1 October 1951 in accordance with this Law shall be deemed to have been taken under the law.
§ 12.
They shall be deleted:
1. Law No 134 / 1867 / EC on the Law of Associations and Law No 135 / 1867 / EC on the Law of Collection, as amended;
2. the order of the Hungarian Minister of the Interior in matters of association and assembly law, in particular Regulations No 216 / 1848 B. M., No 128 / 1868 B. M., No 1394 / 1873 pres. B. M., No 773 / 1874 B. M., No 1508 / 1875 B. M., No 766 / 1898 B. M. and No 7430 / 1913 B. M., as amended, and
3. provision of Act No. 145 / 1947 Coll., on the Organisation of Farmers of the Czechoslovak Republic, if they contravene that Act.
§ 13.
This Law shall take effect on 1 October 1951; It shall be implemented by the Minister for the Interior in agreement with participating members of the Government.
