The Ministry of Transport provides pursuant to Section 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll., Act No. 118 / 2004 Coll., Act No. 309 / 2008 Coll. and Act No. 187 / 2014 Coll., ("the Act ') for the implementation of § 5 (6), § 18 (3), § 22 (4), § 24 (4), § 29e (3), § 29f (3), § 29i (2), § 29j (3), § 29k, § 30a (8) and § 30b (7):

GENERAL PROVISIONS AND USE OF AQUATIC DUTIES
§ 1
Basic concepts
For the purposes of this decree:
(a) a self-propelled vessel equipped with its own machinery, except for a vessel whose machinery is only used for manoeuvres and easier towing or pushing lines;
(b) by a standing vessel a vessel which is directly or indirectly anchored or directly or indirectly bound to shore;
(c) by a floating vessel, a vessel which is not directly or indirectly anchored, bound to shore or which is not boarded;
(d) a vessel on board which has been caught in an obstacle or at the bottom of a waterway resulting in the loss of its free movement;
(e) by stopping for a floating vessel the state in which the vessel stands in relation to the shore.
§ 2
Vessel assembly leader
The vessel assembly leader shall be determined as follows:
(a) if there is only one self-propelled vessel on the board of vessels, the leader of the assembly shall be the leader of that vessel;
(b) if two or more self-propelled vessels are at the head of the tug, the leader shall be the leader of the first self-propelled vessel; However, if an auxiliary self-propelled vessel intended for towing or pushing (hereinafter referred to as the "tugboat ') is used as the first vessel to ensure the passage through a difficult section of the waterway, in particular by a strait or bridge, it shall be the leader of the self-propelled leader assembly,
(c) if two or more self-propelled towed vessels are at the head of the towing gear, the leader shall be the leader of the crew of the master of the vessel from which the tow rope was transferred to the towed vessel, in other cases the leader of the master of the vessel with the highest engine power;
d) if the pressure set is pushed by two tugs together, the leader of the set is the leader of the pressure tug that provides the main drive of the set.
§ 3
Fishing
(1) For the proper control of the vessel, it is necessary to ensure that the steering person is able to hear sound signals and have a view in all directions in the wheelhouse, which is the space or superstructure on board where the vessel is operated, to receive orders and to transmit information. If circumstances so require, an observer shall be provided on board or an audible reception device shall be used.
(2) Self-propelled craft, with the exception of a small vessel, capable of operating at a speed exceeding 40 km / h in relation to water, (hereinafter referred to as "high-speed craft") shall be steered by a person qualified under the Regulation on the competence of persons to lead and operate vessels which is also capable of conducting a vessel by radar. A second person with the same qualifications shall be present in the wheelhouse of such a vessel; This does not apply if the vessel is standing in the lock, sailing out of it or waiting to be sailed through the lock.
§ 4
Load and safe loading, occupancy by passengers
(1) The vessel must not be loaded above the mark of its maximum dive.
(2) The load shall be deployed on the vessel or assembly of the vessels in such a way as to ensure at least 350 m visibility at all times. If an opaque space is created during a voyage in front of a vessel or along its sides, this limitation of visibility may be compensated by technical means, in particular a radio locator.
(3) The cargo shall not endanger the stability of the vessel or the strength of the body.
(4) The stability of the vessel carrying the containers is verified before departure in the case of the vessel
(a) up to a width of 9,5 m, loaded containers in more than one layer;
(b) of a width of 9,5 m to 11 m, loaded containers in more than two layers,
(c) wider than 11 m, loaded containers in more than three layers or in more than three rows in width; or
(d) wider than 15 m, loaded containers in more than three layers.
(5) A vessel intended for the carriage of passengers shall not carry more passengers than is permitted to carry on it. Only as many persons as there are seating positions on the high-speed craft.
§ 5
Water status threatening safety of navigation
(1) The water condition in which the safety of all vessels is compromised is in the section
(a) Elbe Kunetice Štěkm 973,50 to Přeč škaměč km 951,20 for water in Přeč 240 cm or more,
b) Elbe Přeč škaměkm 951,20 to Toššt íšt íkm 869,14 on a watercourse in Přeč 280 cm or more,

(f) Ústí nad Labem-Střekov výště km 767,32 to Hřensko železtěm km 726,60 na vodštu v Ústí nad Labem 540 cm and higher,
g) Vltavy České Budějovice Škaměcí km 241,40 to Hnivkovice záměm 210,40 at water flow in the water flow profile České Budějovice 100 m3 / s and higher,

(2) The water status in which the safety of the shipping of vessels and self-sailing vessels of more than 85 m is compromised is in the section Elbe Měník Km 837,38 to Lovosice Km 787,76 on water in Mělnik 410 cm or more.
§ 6
Maximum authorised dimensions of vessels and vessel assemblies
(1) The maximum authorised length and width of the vessel and the vessel assembly for each section of the waterway are set out in Annex 1 to this Decree.
(2) The maximum allowed draught values for each section of the waterway are set out in Annex 2 to this Decree.
(3) The maximum authorised value of the fixed point height of the vessel and of the vessel assembly, which is the point of the structure of the vessel which cannot be dismantled and reassembled by normal means on board, for each section of the waterway, is given in Annex 3 to this Decree.
(4) On waterways not covered by Annexes 1 to 3 to this Regulation, the length, width, height of the vessel or the assembly of vessels shall correspond to the nature of the waterway.
§ 7
Maximum authorised sailing speeds
(1) On waterways, the maximum sailing speed is permitted
(a) within 25 m of the shore of 10 km / h,
(b) in navigation channels for loaded vessels 5 km / h and for other vessels 10 km / h.
(2) In the water-flow section of the Elbe from Ústí nad Labem, km 767,32 to Hřensko, when sailing upstream, at a water-condition of less than 275 cm to the water point in Ústí nad Labem, the maximum sailing speed allowed is 6 km / h for self-propelled vessels flying submersible, which corresponds to the highest authorised submersible of the vessel in accordance with Annex 2 to this Regulation.
(3) The maximum sailing speed of 10 km / h is permitted on water tanks and other large waterways within 50 m of the shore or designated bathing areas.
(4) The provisions of paragraphs 1 to 3 shall apply unless otherwise provided by signal signs or legislation governing the use of surface water for navigation. Paragraphs 2 and 3 shall not apply to defined water areas under the law.
(5) Where a small craft with its own propulsion is not equipped with a speed measuring device, it shall, in the cases referred to in paragraphs 1 and 3, only be allowed to sail at a speed corresponding to the propulsion mode, where the buoyancy of the vessel constitutes only hydrostatic forces and the effect of dynamic forces induced by the speed of movement of the vessel is negligible.

NOTIFICATION MARKS, POINTS AND VESSELS
§ 8
Vessel names except small vessels
(1) Each vessel, with the exception of a small vessel, shall bear on the body or on fixed labels or plates the registration marks of which are:
(a) the name or emblem of the vessel, marked on both sides of the vessel near the bow and, except for a vessel designed or specially equipped to sail by pushing (hereinafter referred to as "the pusher") and on the stern, or the name of the operator or its usual abbreviation, for which the vessel's serial number or the registration number and the letter code of the country in which the home port or the vessel's registration place shall be entered, as appropriate, in accordance with Annex 4 to this Regulation;
(b) the name of the home port or the place of registration, indicated either on either side of the vessel on the stern or near the stern followed by the letter code of the country where the home port or the place of registration is situated;
(c) the official identification number, which is the European vessel identification number and, if not allocated, the registration number;
(d) the capacity of the vessel in tonnes indicated on both sides of the body or on fixed tables, if the vessel is intended to carry the cargo;
(e) an indication of the maximum permissible number of passengers indicated in a clearly visible location, if it is a vessel where more than 12 passengers are permitted to be carried (hereinafter referred to as a passenger ship).
(2) The distinguishing marks shall be indicated in clearly legible and indelible Latin letters or Arabic numerals. The height of the letters and digits of the registration mark referred to in paragraph 1 (a) shall not be less than 20 cm, in other markings less than 15 cm; the width of the letters and figures and the thickness of the draw shall be proportionate to their height; The letters and figures shall be bright on the dark background or dark on the light background.
(3) The implementation of the registration marks referred to in paragraph 2 need not be fulfilled in the case of the particulars of the registration marks referred to in paragraph 1 (c) to (e).
(4) If one of the inscriptions of the vessel ensuring the movement of the assembly is covered in a side-bound assembly or in a pressure assembly, it shall be marked on the label and placed in such a way that it is clearly visible from the directions covered by other vessels.
§ 9
Small vessel registration marks
(1) The small vessel registered in the register of small vessels shall bear on the body the registration mark, which shall be the European vessel identification number and, if not allocated, the registration mark. The registration mark shall be marked on the outer sides of the two sides of the vessel near the bow and made in clearly legible Latin letters or Arabic numerals of a height of at least 10 cm. The letters and numbers of the light colour on the dark background or the dark colour on the light background shall be used for the identification mark.
(2) A small vessel not subject to registration shall bear on the inside or outside of the vessel:
(a) the name of the operator or its usual abbreviation; or
(b) the name and surname or name of the owner of the vessel.
(3) The provisions of paragraph 2 shall apply mutatis mutandis to the registration marks of floating gear which are not subject to registration under the Small Vessel Register and the competence of small vessels, ferry ships and floating gear for use on waterways.
§ 10
Anchor marking
The vessel's registration marks referred to in Article 8 (1) (a) shall be indelibly indicated on the anchorages. This does not apply to small-vessel anchors.
§ 11
Cargo marks and margin scales
(1) All vessels, except small vessels, have signs indicating the plane of the maximum dive. The methods for establishing the maximum draught of inland waterway vessels and the conditions for carrying out load signs shall be laid down in the Ordinance on the eligibility of vessels to operate on inland waterways (1). In the case of seagoing vessels, the summer dive mark in freshwater shall replace the load mark.
(2) Each vessel, except small vessels whose dive can reach 1 m at full load, has a margin scale. The implementation of the scale shall be laid down in a regulation on the eligibility of vessels to operate on inland waterways (1).

OPTIC SIGNALS ON VESSELS

HLAVA I

GENERAL PROVISIONS
§ 12
Scope of application
(1) The optical signals on board are lights, boards, flags, flames, balloons and cones.
(2) If the conditions of visibility so require, the signal prescribed for operation at night and day shall be used. The schematic depictions of the signals prescribed in this section are given in Annex 5 to this Decree.
(3) Unless otherwise specified, the lights are meant to be constant and uniform.
(4) When navigating under a fixed or mobile bridge structure or under a lock of lock, vessels may carry an optical signal in accordance with the provisions of Part 1 of Title II of this Part in such a way that it passes without difficulty.
§ 13
Tables, flags, flames
(1) Unless otherwise specified, the tables and flags prescribed in this Decree are rectangular.
(2) Boards, flags and flames are not used soiled and faded.
(3) The dimensions of tables and flags are sufficient for good visibility if their dimensions are:
(a) at least 1 m x 1 m;
(b) for small vessels at least 0,6 m x 0,6 m;
(c) at least 1 m in length and at least 0,5 m in width in the case of a flame.
§ 14
Rolls, balloons, cones and double cones
(1) Cylinders, balloons, cones and double cones prescribed in this decree may also be replaced by modified articles which, when viewed from a distance, have the same shape.
(2) Cylinders, balloons, cones and double cones are not used soiled and faded.
(3) Dimensions of cylinders, balloons, cones and double cones are sufficient for good visibility if:
(a) a cylinder height of at least 0,8 m and a diameter of at least 0,5 m;
(b) a balloon diameter of at least 0,6 m;
(c) cone height of at least 0,6 m and base diameter of at least 0,6 m;
(d) height of double cones at least 0,8 m and diameter of base at least 0,5 m
(4) The means of signalling referred to in paragraph 3 of the smaller dimensions may be used on small vessels, but their good visibility must be maintained.
§ 15
Lights
(1) For the purposes of this Part:
(a) the peak light of a strong white light shining uninterrupted in a horizontal section of 225 degrees;
(b) side light bright green light on the right side of the vessel and bright red light on the left side of the vessel, each shining uninterrupted at 112,5 degrees
(c) a clear or ordinary white light illuminating uninterrupted at 135 degrees, by rear light;
(d) light visible from all sides, light placed on a vessel illuminating uninterrupted at 360 degrees in the apparent section;
(e) the height of the optical signal of the vessel shall be its distance from the highest level of the load marks or, for vessels not bearing the load marks, the distance from the plane of the maximum permissible draught;
f) the nights of the period between sunset and sunrise,
(g) the day of the period between sunrise and sunset.
(2) The peak light shall be placed on the vessel in such a way that it can be seen from the front and 22,5 degrees rearward of the perpendicular axis of the lamp to the longitudinal axis of the vessel from both its sides.
(3) The side light shall be placed on the vessel in such a way that it is visible from the front and 22,5 degrees rearward of the perpendicular axis of the lamp to the longitudinal axis of the vessel from the respective side.
(4) The rear light shall be placed on the vessel in such a way that it is visible from the rear 67,5 degrees on either side of the longitudinal axis of the vessel.
(5) Other lights or signals may be used for the connection between the vessels or between the vessels and the shore if they cannot be confused with the lights or signals specified in this decree.
§ 16
Emergency lights
If the signal lights prescribed by this decree cease to function, they shall be replaced immediately by emergency lights. In doing so, the prescribed strong light may be replaced by a bright and prescribed bright light by a ordinary light. Lights with prescribed power shall be brought back into service as soon as possible.

HLAVA II

NIGHT AND DAY SIGNALISATION

Signalling of floating vessels
§ 17
Self-propelled self-propelled craft signalling services
(1) Self-propelled craft carrying at night
(a) a peak light placed on the front of the vessel in its longitudinal axis, at a height of at least 4 m, the height being reduced to 3 m on special purpose and unmonitored waterways;
(b) side lights situated in the widest part of the vessel at least 1 m below the peak light and at least 1 m behind it in the same plane perpendicular to the axis of the vessel, sealed from the inside of the vessel so that the green light is not visible from the left side of the vessel and red light from the right side of the vessel; and
(c) the rear light placed at the rear of the vessel in its longitudinal axis.
(2) A self-propelled craft may at night carry a second peak light, situated in the longitudinal axis of the vessel behind the front peak light, at a height of at least 3 m above the front peak light, so that the horizontal distance between these lights is at least three times the vertical distance. A self-propelled craft which is more than 110 m long is carried by the second peak light.
(3) A self-propelled vessel, assisted by an auxiliary tugboat at night, carries the lights prescribed in paragraphs 1 and 2.
(4) In addition to the signals prescribed by other provisions of this Regulation, the floating high-speed craft signals by day and night by two bright yellow flash lights located at a suitable place 1 m above it so that it is visible from all sides.
(5) paragraphs 1 to 4 shall not apply to a small vessel; This also applies to vessels carrying cross-waterway transport, provided that technical competence has been approved for this type of transport (the ferry).
§ 18
Signalling of floating trawl lines
(1) The tugboat which runs the tugboat assembly and the tugboat used as an aid in front of another self-propelled vessel, whether pushed or sideways, shall bear:
(a) at night
1. two top lights placed at a distance of 1 m above each other in the front of the longitudinal axis of the vessel, the top light being placed at a height of at least 4 m and the bottom light, as far as possible 1 m above the side lights, the height of the upper light may be reduced to 3 m on the intended and unfollowed waterways;
2. side lights, pursuant to § 17 (1) (b), and
3. Yellow rear light, instead of white, placed in the longitudinal axis of the vessel at a sufficient height to be clearly visible from vessels towed behind a tugboat or from self-propelled craft, pressurised or side-bound assemblies in front of which the auxiliary tugboat moves; or
(b) by day, a yellow cylinder with two stripes black and white at the top and below, with white stripes on the edge of the cylinder placed vertically at the front of the vessel high enough to be visible from all sides.
(2) If there are more tug tugs in front of each other or if more tugs in front of the self-propelled vessel are floating at the head of the tug or side-bound formation, each of them shall bear:
(a) at night, instead of the top lights prescribed in paragraph 1 (a), the three top lights situated at a distance of 1 m above each other in the front of the longitudinal axis of the vessel, the height of the top and bottom lights being the condition referred to in paragraph 1 (a); or
(b) by day, the cylinder prescribed in paragraph 1.
(3) The vessels of the tug assembly, going after one or more tugs referred to in paragraphs 1 and 2, shall:
(a) at night a bright white light visible from all sides, at a height of at least 4 m, the height may be reduced to 3 m on the intended and unmonitored waterways; or
(b) by day, a yellow balloon placed in a suitable place and at a height such that it is clearly visible from all sides.
(4) Where:
(a) the towed vessel shall be longer than 110 m, the vessel shall bear two lights, the first of which shall be placed in the front of the vessel and the second of which shall be placed in the rear of the vessel;
(b) there are more than two side-bound vessels in the towing assembly, then these lights or balloons shall carry only the two external vessels so that the signalling of all towed vessels of the assembly is preferably at the same height above the water level.
(5) The vessel or vessels at the end of the towing assembly, other than the indication referred to in paragraph 4, shall, at night, bear the taillight prescribed in Paragraph 17 (1) (c). If at the end of the assembly there are side-bound vessels of more than two, this light shall be borne only by external vessels. Where small vessels sail at the end of the assembly, the provisions of this paragraph shall not apply.
(6) Small vessels towing other small vessels and towed small vessels shall not be subject to paragraphs 1 to 5.
§ 19
Signalling of floating pressure assemblies
(1) The pressure formation bears at night
(a) in the front
1. on a vessel at the head of the assembly or at the head of the assembly on the left, three peak lights placed at the vertices of an equilateral triangle with a horizontal base in a plane perpendicular to the longitudinal axis of the assembly so that the upper light is at least 4 m high and two lower lights at a distance of 1,25 m apart and at a distance of 1,10 m below the top light, the height of the upper light may be reduced to 3 m on the intended and unfollowed waterways;
2. on each additional vessel the full width of which is visible from the front, a peak light placed as far as possible 2 m below the level of the upper peak light referred to in point 1, on the mast in the longitudinal axis of the vessel on which the lights are carried,
(b) in the widest part of the side-light assembly prescribed in Paragraph 17 (1) (b), located as close as possible to the tugboat, at a distance of not more than 1 m from the sides of the assembly and at a height of not less than 2 m, the height may be reduced to 1 m on special purpose and unmonitored waterways;
(c) at the rear
1. three rear lights on a pressure tuber prescribed in paragraph 17 (1) (c), situated in a plane perpendicular to the longitudinal axis of the tugboat at a distance of 1,25 m, at a sufficient level so that it cannot be obscured by a particular assembly vessel;
2. a rear light on each vessel whose full width is visible from the rear; However, if more than two vessels are seen from the rear in addition to the pressure tugboat, only two external craft of the assembly shall carry this stern light.
(2) The provisions of paragraph 1 also apply to pressure assemblies which sail at night after one or more auxiliary tugs; white rear lights referred to in paragraph 1 (b). (c) point 1 shall, however, be replaced by yellow.
(3) If the pressure formation is floating behind one or more auxiliary tugs per day, the pressure tuber shall carry the yellow balloon referred to in Paragraph 18 (3) (b).
(4) The pressure assembly with two side-bound pressure tugs shall carry the night-time rear lights prescribed in paragraph 1 (b). (c) point 1 on the pressure tuber on which the leader of the assembly is on, the second pressure tuber shall carry the rear light prescribed in paragraph 1 (b). (c) point 2.
(5) For the purposes of the provisions of this Subpart, a compression assembly whose maximum dimensions do not exceed 110 m x 12 m shall be considered as a self-propelled craft on its own.
§ 20
Signalling of floating side-bound assemblies
(1) Side-bound formation bears at night
(a) on each vessel the peak light prescribed in paragraph 17 (1) (a) may, however, be replaced by a white light visible from all sides, as prescribed in paragraph 18 (3) (a) and placed in a suitable place, but not above the peak light of the vessel (s).
