THE LAW
of 25 February 2000
amending Act No. 289 / 1995 Coll., on Forests and amending and supplementing certain laws (Forest Act), as amended by Act No. 238 / 1999 Coll.
Parliament has decided on this law of the Czech Republic:
Act No. 289 / 1995 Coll., on Forests, and amending and supplementing certain laws (Forest Act), as amended by Act No. 238 / 1999 Coll., is amended as follows:
1. In Article 32 (7), the dot at the end of the paragraph is deleted and the words, including footnote 21a, are added: "or farmed game farms. 21a)
21a) § 19 (3) of Act No. 23 / 1962 Coll., as amended. '
2. Paragraph 33 (3) reads as follows:
"(3) Mining in a forest in which the forest owner operates without an approved plan or protocol to take over the curriculum may be carried out only with the consent of the forest manager. The consent cannot be refused unless mining is contrary to the other provisions of this law. If the extraction is to exceed 3 m3 per ha of forest per calendar year, the owner of the forest, as well as the buyer of the standing forest crop, shall give prior written notice to the authority of the state administration of the forest and provide evidence of the observations of the relevant forest operator. If the authority of the State administration of the forests has not communicated its opinion to the person who notified it in writing of the intention to carry out the extraction within 30 days of the date of notification of the notification, that person may carry out the extraction. The general rules on administrative procedures shall not apply to the issue of this opinion by the State administration of forests. ';
3. In Paragraph 54 (1), the words "The authority of the State Administration of Forests shall impose a fine of up to CZK 1 000 000 to the entrepreneur, 28) which, in the course of business, shall be replaced by the words" The authority of the State Administration of Forests shall impose a fine of up to CZK 1 000 000 to whoever. "
At the same time, footnote 28 is deleted.
4. in Paragraph 54 (1) (c):
"(c) carry out mining in excess of the approved plan or protocol to take over the curriculum taken over, or carry out other mining in contravention of that law, in particular carrying out illegally mining in quantities exceeding 3 m3 per hectare of forest per calendar year, or carrying out, without authorisation by the State administration of the forest, a toll on the crop of less than 80 years of age,";
5. In Article 54 (2), the words "to an entrepreneur who, in the course of his business," shall be replaced by "to whom."
6. Paragraph 55 (1) reads as follows:
"(1) The body of the State Forest Administration shall impose a fine of up to CZK 1 000 000 to the forest owner or another person who:
(a) cause significant damage to the forest by intentional action and thereby jeopardise the performance of its functions;
(b) without a decision by the State Administration of Forests on withdrawal or restriction, remove or restrict the use of land intended for forest functions;
(c) use illegally land intended for the performance of forest functions in such a way as to prevent them from being used for the performance of forest functions;
(d) carry out illegal logging in quantities exceeding 3 m3 per hectare of forest per calendar year;
(e) carry out, without the permission of the authority of the State Administration of the Forests, tolls intended for cultivation under 80 years of age. "
This Act shall take effect on the day of its publication.
