amending and supplementing the Act of the Czech National Council No. 200 / 1990 Coll., on infractions, Act of the Czech National Council No. 283 / 1991 Coll., on the Police of the Czech Republic, and the Act of the Czech National Council No. 553 / 1991 Coll., on municipal police
Parliament has decided on this law of the Czech Republic:
Act of the Czech National Council No. 553 / 1991 Coll., on Municipal Police, is added as follows:
After Paragraph 17, the following Section 17a is inserted:
(1) The officer is entitled to use technical means to prevent the departure of a vehicle which has been left in a place where the vehicle is prohibited from being left by a ban resulting from local road traffic modification or if the vehicle is on a pavement where it is not permitted, or if an unauthorised seizure of public spaces is carried out by the vehicle and the driver is not present near the vehicle.
(2) Technical means to prevent the departure of a vehicle may be used in accordance with paragraph 1 only if the conditions for their removal are ensured continuously.
(3) The technical means of preventing the departure of a vehicle shall be removed without undue delay after any infringement has been dealt with in the block procedure or after the identity of the person who left the vehicle on the spot has been identified or after the operations necessary to establish the identity of that person.
(4) Technical means to prevent the departure of a vehicle for the reasons referred to in paragraph 1 may not be used if:
(a) constitute an obstacle to road traffic, 15a); or
(b) is visibly marked as a vehicle of the armed forces, armed security corps, fire protection corps, a vehicle intended for the provision of medical services, an invalid vehicle or a person enjoying privileges and immunities under the law or international treaties by which the Czech Republic is bound.
(5) The attachment and removal of technical means to prevent the departure of the vehicle is carried out at the expense of the person who left the vehicle on the spot.
15a) § 37 of Decree No. 99 / 1989 of the Federal Ministry of Interior Coll., on Road Traffic Rules (Road Traffic Rules). '
Decisions given in infringement proceedings by an administrative authority of the Slovak Republic, which has acquired legal authority until 31 December 1992, shall be valid in the Czech Republic. If such a decision has been made by a prohibition of action which has not yet been fully implemented, the authority of the Police of the Czech Republic responsible for the place of permanent residence of the infringer shall decide on the proposal to refrain from the exercise of the remainder of the prohibition of activity (§ 92 paragraph 1 of the Czech National Council Act No. 200 / 1990 Coll.).
The President of the Chamber of Deputies is hereby authorised to declare in the Collection of Laws of the Czech Republic the full text of the Act on Infringements, as is apparent from the later regulations.
This Law shall take effect on 1 March 1993.
