on the Mining Rescue Service
The Czech Mining Office provides pursuant to § 7 paragraph 5 of the Act of the Czech National Council No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration:

ČÁST PRVNÍ

INTRODUCTORY PROVISIONS
§ 1
Tasks of the Mining Rescue Service
(1) The mission of the Mining Rescue Service is to carry out rescue work, rapid and effective interventions for:
(a) saving human lives and property in serious operational accidents, including the provision of first aid in the underground;
(b) the fight against serious operational accidents, in particular the explosions of gases and coal dust, mine fires, rock and gas bursts, oil and gas eruptions, water, gas, mud and chickens, mine sinks and ventilation disturbances ("accidents");
(c) the removal of the consequences of accidents.
(2) The Mining Rescue Service further
(a) carry out other work in a non-breathable or harmful environment;
(b) cooperate in emergency prevention and health and safety at work and safety at work, in particular by carrying out workplace inspections, checks on means of accident control, staff training and training.
§ 2
Interpretation of terms
For the purposes of this decree, it shall be considered as:
(a) a mine operating unit which, from the point of view of ventilation, constitutes a separate technical unit, whatever it is called organizational; the concept of mine is equivalent to the concept of underground for underground mining organisations. 1) In case of doubt, the Czech Mining Office will decide,
(b) the base of the area defined for the entry of mining rescue workers into intervention, which is also used for the temporary storage of respiratory devices and other equipment of mining rescue workers between interventions and is connected with the driver of the accident or dispatcher.

ORGANISATION OF BAN SAFEGUARD SERVICES
§ 3
Bany rescue stations
(1) The tasks of the Mining Rescue Service shall be:
(a) main mining rescue stations;
(b) district mining rescue stations;
(c) racing mining rescue stations;
(d) the Mining Rescue Corps of the State Mining Administration.
(2) The main and district mining rescue station shall be set up by the organisation, after agreement, or on the basis of a regulation of the Czech Mining Authority, which shall determine its seat and define its operation.2)
(3) Racing mining rescue stations must be set up by organisations
(a) deep-sea mines during construction, mining, procurement and disposal;
(b) coal quarries on which old mining works may be affected by opening, preparing and quarrying, or deep mining works will be set up or used;
(c) which carry out drilling and geophysical work from a surface with the expected presence of flammable or harmful gases, oil or water under pressure, extraction, treatment or underground storage of liquid minerals and gases in natural rock structures;
(d) which carry out underground work in a mining way, (1) in which accidents requiring the intervention of the mining rescue corps can be expected.
(4) The organisation, with the approval of the main mining rescue station, may provide for the mining rescue service and other mining rescue station set up by another organisation, or establish a racing mining rescue station common to two or more mines.
§ 4
Main Mining Rescue Station
(1) Main Mining Rescue Station except for the tasks referred to in § 1
(a) manage and control, on a professional basis, the activities of district mining rescue stations and, if they are not established, manage and control the activities of racing mining rescue stations;
(b) training and training of mining rescue workers and other workers of mining rescue stations;
(c) participate in annual inspections of emergency plans and check emergency plans;
(d) control emergency prevention facilities;
(e) correct, check and test in its own workshops and testing rooms breathing and reviving devices, rescue techniques and issue test certificates;
(f) supervise the control and testing of detectors, indicators and gas analysers and the training of personnel working with such instruments;
(g) draw up a plan for mutual assistance to the mining rescue stations;
(h) monitor, or carry out research in the field of mining rescue and cooperate with relevant research and other centres;
i) provides medical services for first aid in underground mines at the headquarters of the main mining rescue station;
(j) carry out other activities provided for by the Staff Regulations of the Mining Rescue Station (§ 19).
(2) The head of the main mining rescue station shall report once a year to the Czech Mining Office and to the district mining office responsible for the headquarters of the main mining rescue station.
§ 5
Circuit mining rescue station
(1) Circular mining rescue station except for the tasks referred to in § 1
(a) manage and control the professional activities of mining mining rescue stations;
(b) training and training of mining rescue workers and other workers of mining rescue stations;
(c) participate in annual inspections of emergency plans and check emergency plans;
(d) control emergency prevention facilities;
(e) repairs, checks and tests in its own workshops breathing and reviving devices and rescue equipment;
(f) carry out other activities entrusted to it by the Main Mining Rescue Station.
(2) The head of the district mining rescue station shall report once a year to the superior main mining rescue station and to the district mining office on its activities.
§ 6
Racing mining rescue station
(1) Racing mining rescue station in addition to the tasks referred to in § 1
(a) train and train mining rescue workers;
(b) participate in annual inspections of emergency plans;
(c) control emergency prevention facilities;
(d) repair, control and test breathing and living appliances and rescue equipment;
(e) carry out other activities entrusted to it by the main or district mining rescue station.
(2) The head of the racing mining rescue station shall report once a year to the superior mining rescue station on its activities.

§ 7
Responsible for equipping the mining rescue stations
The organisation that set up the mining rescue station is responsible for the personnel, material and technical equipment of the mining rescue station.
§ 8
Main and secondary mining rescue station equipment
(1) Main and district mining rescue stations must be equipped with breathing and reviving devices, supplies of spare rescue and emergency equipment, rescue equipment and means of transport in accordance with the Staff Regulations of the Mining Rescue Station (§ 19).
(2) The main and district mining rescue station must have a pipe, the spaces of which are adapted to the conditions to which mining rescue workers are exposed during intervention, including the possibility of blowing with non-toxic gases, increasing temperature and relative humidity. The pipe must be able to be ventilated quickly and access to all its premises must be provided to provide rapid assistance in the event of an accident by a mining rescue worker. The pipe shall be appropriately positioned and marked with a significant indication of the device for calling for rapid assistance.
(3) A training centre shall be set up at the main mining rescue station and district mining rescue station established for the organisations referred to in § 3 (3) (c) where the disposal of individual types of open flares from wells or probes, including fire extinguishing media (gas, oil), can be practised. The training workplace shall have a water-supply device under pressure into the bursting medium as well as a device for rapidly closing the water or gas supply to the drill well or probe. The operating rules of the training station are issued by the head of the mining rescue station on which the training station is set up.
§ 9
Equipment of the mining rescue station
(1) A racing mining rescue station must be equipped with at least 12 breathing and 2 breathing instruments ready for action. At least 3 spare absorbers and 3 refilled bottles shall be prepared for each oxygen breathing apparatus. Three spare filled bottles shall be prepared for each revitalisation device and for each air breathing apparatus. For mines with a greater frequency of interventions, the number of breathing and reviving devices shall be increased accordingly, as decided by the head of the organisation issued in agreement with the relevant main mining rescue station. For non-coal mines, for mines under construction, reinsurance or disposal, and for the organisations referred to in § 3 (3) (c), the number of breathing and reviving devices may be reduced to 6 breathing devices and 1 reviving apparatus, as decided by the head of the organisation in agreement with the relevant main mining rescue station.
(2) The plant mining rescue station must also be equipped with other rescue equipment and the necessary medical equipment and material; the quantity and species shall be determined by the Staff Regulations of the Mining Rescue Station.
(3) The number of lamps ready for immediate use shall correspond to at least the prescribed number of breathing appliances. These lamps shall be separately marked and separately stowed at the designated location.
§ 10
Breathing and reviving apparatus
(1) Only types of breathing and reviving apparatus approved by the Czech Mining Authority may be used for the purpose of mining rescue services. 3)
(2) Breathing and reviving appliances and their accessories must be maintained in standby condition. Instruments not usable for intervention shall be separately marked and stored separately.
(3) Only mining paramedics can use breathing devices. Other persons may use breathing apparatus only under the conditions laid down by the Czech Mining Office.
(4) Breathing and reviving devices are tested by the Mines Rescue Station mechanic at regular monthly intervals and in addition immediately after each use and in case of doubt as to their health and function.
(5) The equipment for breathing and reviving devices, in particular masks, mouthpieces, bottles and absorbers, is checked regularly by the mechanics of the mining rescue station, at least every 6 months.
(6) Breathing and reviving bottles should be tested according to the regulations on metal pressure vessels for the transport of gases. 4) The record of these tests must be stored at the mining rescue station. Breathing and reviving bottles shall be coloured according to the relevant standard, 5) numbered and marked by the organisation name. Medical oxygen must be used for filling bottles for oxygen breathing apparatus and hygienic air or other approved physiological breathing mixtures for air breathing apparatus.
(7) Breathing and reviving apparatus, their accessories, checking and testing instruments must be tested periodically, at least every 6 months
(a) to a racing mining rescue station, a circuit mechanic or a main mining rescue station mechanic;
(b) at the district mining rescue station the mechanic of the main mining rescue station,
(c) at the main mining rescue station of the main mechanic.
(8) Checks, tests and records shall be carried out in accordance with the instructions of the main mining rescue station. The head of the mining rescue stations shall be obliged to hand over to personnel who check and test breathing and reviving devices and their accessories, copies of relevant instructions.
(9) The results of tests and checks must be recorded (Section 23).
§ 11
Location of mining rescue stations
(1) The Mining Rescue Station must be located in rooms corresponding to the needs of the Mining Rescue Service, enabling, in particular, storage, supply and reception, maintenance and testing of respiratory and revival devices, and other rescue techniques, emergency procedures, training and rest of mining rescue workers after intervention.
(2) Before approving projects of newly established or reconstructed main mining rescue stations, it is necessary to express the Czech Mining Office. Before approving the projects of newly established or reconstructed district and racing mining rescue stations, the main mining rescue station must be expressed.
(3) The rooms and facilities of the mining rescue stations can only be used for the purpose of the mining rescue service.

§ 12
Mining Rescue
(1) A worker may become a mining rescue worker who:
(a) is between 21 and 35 years of age;
(b) is fit for work in the Mining Rescue Corps;
(c) has at least two years of professional experience in the field in which it will work in the Mining Rescue Corps;
d) completed ten days of basic theoretical training and practical training at the main mining rescue station;
(e) have successfully passed a qualification test before a commission appointed by the head of the main mining rescue station;
f) made a promise to the mining rescue.
(2) Medical fitness must be confirmed by medical examination.
(3) A mining paramedic must undergo a medical examination at least once a year and always after a serious illness or accident. The medical examination shall be carried out in accordance with specific rules. 6)
(4) At least once a quarter, a mining paramedic must undergo recurrent theoretical training and practical exercises in the range of one shift in the use of a breathing and reviving apparatus; of which two practical exercises of the year in the use of breathing apparatus must be held in a pipe and two in a mine. A blow in the breathing apparatus in the mine can replace the exercise in the mine. The mine exercise must not be performed in a non-breathable environment.
(5) The mining paramedic of the organisation referred to in § 3 (3) (c) carries out practical exercises in the use of the breathing apparatus by performing one exercise in the pipe and three exercises in the training workplace or in the deep well in the year. Intervention in the breathing apparatus replaces practical exercise at the training centre or deep-hole well.
(6) A mining rescue worker may operate in the Mining Rescue Corps until the age of 45. In addition to this age limit, the head of the main or district mining rescue station is permitted by medical judgement with regard to the function performed. At the head of the main mining rescue station and its representative, the Czech Mining Authority authorises this exemption on the basis of a medical opinion.
(7) The practice referred to in paragraph 1 (c), the 10-day basic theoretical training and practical training at the main mining rescue station referred to in paragraph 1 (d) is not required for graduates of the mining college and industrial schools who have received basic rescue training in the framework of teaching.
(8) If a worker fulfils the requirements referred to in points (a) to (e) of paragraph 1, he shall, in the presence of a representative of the State Mining Administration, make a solemn promise to the head of the Main Mining Rescue Station.
(9) Members of the Mining Rescue Corps of the State Mining Administration take the oath of the Mining Rescue Officer to the President of the Czech Mining Office.

§ 13
Members of the Mining Rescue Corps
The members of the Mining Rescue Corps are mining rescue workers and other selected workers of the Mining Rescue Station.
§ 14
Mining Rescue Corps Main Mining Rescue Station
(1) The members of the Mining Rescue Corps of the Main Mining Rescue Station are:
(a) the head of the main mining rescue station and its representatives;
(b) the main mechanic of the main mining rescue station and its representatives,
(c) technicians, mechanics, patrolmen and, where appropriate, heads of division;
(d) physicians qualified in the field of mining and prescribed medical qualifications, 7)
(e) personnel of the main mining rescue station of other professions performing the tasks of the mining rescue service.
(2) The number of members of the Mining Rescue Corps of the Main Mining Rescue Station is determined by the Staff Regulations of the Mining Rescue Station (§ 19).
(3) The head of the main mining rescue station shall entrust from the experienced mining rescue workers the necessary number of patrons and, where appropriate, the heads of troops.
(4) Only a mining rescue worker with at least three years of rescue practice who has completed at least 6 weeks of emergency service at the district or main mining rescue station may be a sergeant.
(5) The head of the main mining rescue station may only be a mining engineer who studied deep-water mining at the university and at the main mining rescue station for the organisations referred to in § 3 (3) (c) may be the head only of a graduate high school with a deep-water drilling field (hereinafter the "mining engineer") with at least eight years of professional expertise, of which at least four years of rescue practice, which is a mining bailiff and successfully passed the exam of mining rescue before the commission of the Czech Mining Authority.
(6) Only a mining engineer with at least four years of professional expertise, of which at least two years of rescue practice, who is a mining paramedic and successfully passed the exam of mining rescue before the Bohemian Mining Authority commission, may be Deputy Head of the Main Mining Rescue Station.
(7) The main mechanic of the main mining rescue station can only be a mechanical engineer with at least four years of professional expertise, of which at least two years of rescue practice.
(8) The head of the main mining rescue station, its representative and the main mechanic can only establish and relieve the organisation of this function with the prior approval of the Czech Mining Authority.
§ 15
Mining Rescue Corps District Mining Rescue Station
(1) The members of the Mining Rescue Corps of the District Mining Rescue Station are:
(a) head of the district mining rescue station and its representative,
(b) the main mechanic of the district mining rescue station and its representative,
(c) technicians, mechanics and patrons,
(d) personnel of the district mining rescue station of other professions performing the tasks of the mining rescue service.
(2) The number of members of the Mining Rescue Corps is determined by the Staff Regulations of the Mining Rescue Station.
(3) The head of the district mining rescue station shall entrust to experienced mining rescue workers the necessary number of patrons meeting the requirements of Section 14 (4).
(4) Only a mining engineer with at least four years of professional expertise, of which at least two years of rescue practice, who is a mining paramedic and successfully passed the examination of mining rescue before the Bohemian Mining Authority commission, can be the head of the district mining rescue station.
(5) Only a mining engineer with at least two years of professional expertise, of which at least one year of rescue practice, who is a mining paramedic and successfully passed the examination of mining rescue before the Bohemian Mining Authority commission, may be Deputy Head of the District Mining Rescue Station.
(6) The head of the district mining rescue station and its representative shall have completed special training at the main mining rescue station for at least 20 days prior to the establishment.
(7) The head of the district mining rescue station and its representative can only set and relieve the organisation of this function with the prior approval of the Czech Mining Authority.
§ 16
Mining rescue corps of racing mining rescue station
(1) The members of the mining rescue corps of racing mining rescue stations are
(a) the head of the racing mining rescue station and its representative,
b) the mechanic of the racing mining station and its representative,
(c) Sergeant,
(d) workers of the mining rescue station of other professions performing the tasks of the mining rescue service.
(2) The Mining Rescue Corps shall have at least 25 members of the Mining Rescue Station and shall be represented by experts from all essential professions which may occur in the course of rescue activities. If more frequent interventions are taken, the number of mining rescue workers shall be increased accordingly, as decided by the head of the organisation in agreement with the relevant main mining rescue station. For non-coal mines and for mines under construction, reinsurance or disposal and for the organisations referred to in § 3 (3) (c), the number of members of a mining rescue station may be reduced accordingly, as decided by the head of the organisation in agreement with the main mining rescue station. If a racing mining rescue station is combined for two or more mines, the necessary number of mining rescue workers of all these mines must be included in its mining rescue corps.
(3) Only a mining engineer with a minimum of three years' professional experience, of which at least one year's rescue practice, or a graduate of a mining school with a minimum of six years' professional experience, of which at least two years' rescue practice, may be head of a mining mining mining station and its representative. A construction engineer or a graduate of an industrial building school may also perform the function of head of a mining mining mining mining rescue station and its representative at a mining mining station. The head of the mining rescue station and its representative can only be the mining paramedic who successfully passed the mining rescue exam before the district mining commission.
(4) The head of the racing mining rescue station, its representative, the mechanic of the racing mining rescue station and its representative must have completed special training at the main mining rescue station for at least 15 days before the provision to function.
(5) The head of a racing mining rescue station and its representative may establish and exempt the performance of this function only with the prior agreement of the district mining office.
(6) The head of the mining rescue station shall entrust to experienced mining rescue workers the necessary number of patrons meeting the requirements of Section 14 (4).
(7) The list of members of the Mining Rescue Centre, indicating the name, profession, residence, telephone numbers and function in the Mining Rescue Corps, must be posted at the Mining Rescue Station and at the dispatcher, or at another location designated by the emergency plan or the Staff Regulations of the Mining Rescue Station. The amendments must be included in the list immediately. In the exchange register of the stamp office, each mining rescue worker must be recorded differently.
(8) Mining rescue workers must be apportioned accordingly into all working shifts. The inspection service and the dispatcher shall be informed of the location of their workplace.
(9) The head of the mining rescue station and its representative must know the emergency plans within the scope of the mining rescue station.
§ 17
Mining Rescue Corps of the State Mining Administration
(1) The Mining Rescue Corps of the State Mining Administration consists of selected Mining Inspectors designated for the performance of the Supreme Oversight (8) in breathing appliances.
(2) The Czech Mining Authority provides in its rules of organisation:
(a) conditions for classification, performance of activities, including training and training of members of the Mining Rescue Corps;
(b) the number of members of the Mining Rescue Corps;
(c) the head of the Mining Rescue Corps and its representative and define their rights and obligations.
(3) Mining rescue stations are required to provide the members of the Mining Rescue Corps of the State Mining Administration with the necessary equipment to intervene in a non-breathable environment (breathing apparatus, its accessories, indicator, etc.). Main and district mining rescue stations are obliged to allow members of the Mining Rescue Corps of the State Mining Administration to carry out the prescribed exercises and provide the necessary training.
§ 18
Rights and obligations of the head of the mining rescue stations
(1) Head of the Mining Rescue Station
(a) organise and manage the activities of the Mining Rescue Corps;
(b) ensure the proper composition of the Mining Rescue Corps according to professions, organise the prescribed exercises and training of its members;
(c) provide regular and extraordinary medical examinations of members of the Mining Rescue Corps carried out in accordance with specific regulations, 6)
(d) ensure the entry into alert of mining rescue workers;
(e) ensure a rapid assembly of the Mining Rescue Corps, if necessary, and its early preparation for intervention;
(f) ensure the maintenance and equipment of the mining rescue station and its emergency condition;
(g) participate in the preparation and control of emergency plans;
h) evaluate the progress and outcome of the intervention of the Mining Rescue Corps;
(i) ensure that prescribed written records are kept and report on the activities of the mining rescue station at specified times;
j) proposes the award of honours and rewards to mining rescue workers for exceptional merit.
(2) In the absence of the Head of the Mining Rescue Station, he shall carry out his duties and shall be responsible for their performance.
