DECLARATION
Federal Ministry of the Interior
of 28 October 1977
on the occupation of members of the People's militia to carry out the tasks of the National Security Corps
The Federal Ministry of the Interior, after approval of the Chief Commander of the People's militia, provides, pursuant to § 51 paragraphs 2 and 4 of Act No. 40 / 1974 Coll., on the National Security Corps:
(1) Members of the People's militia shall be called upon to perform the tasks of the National Security Corps in order to maintain public peace, order and security within the State in exceptional cases.
(2) The tasks referred to in paragraph 1 shall be carried out by members of the People's militia under the direct command of, or in cooperation with, the members of the National Security Corps, independently of, designated commanders of the People's militia.
(3) The performance of the duties referred to in paragraph 1 shall also be considered to be the performance of the service of members of the People's militia in the security of the weapons and ammunition stockpiles of the People's militia. This service shall be performed by members of the People's militia under the command of designated commanders of the People's militia.
In the performance of the service referred to in § 1 (3), a member of the People's militia shall be entitled to use:
(a) the touches and moves of self-defense, the tear medium, the baton, the shackles, the firing of weapons, warnings and warning shots in the air;
(b) arms only in the following cases:
1. to avert, in the event of necessary defence, an attack against or imminent to the person concerned or an attack on the life of another person;
2. If the dangerous perpetrator against whom he acts does not give up on his call or refuses to leave his hiding place;
3. to prevent the escape of a dangerous perpetrator who cannot otherwise be detained;
4. to avert a dangerous attack that threatens a guarded object or site, after a futile challenge to abandon the attack.
The mission of the National Security Corps shall be demonstrated by members of the People's militia in a manner specified by the Special Regulation.2)
The Order of the Minister of the Interior of the Czechoslovak Socialist Republic No. 30 / 1971 Coll., on the delegation of members of the People's militia to certain security tasks is hereby repealed.
This decree shall take effect on the day of its publication.
