amending and supplementing Decree No. 45 / 1964 of the Ministry of Justice Coll., implementing certain provisions of the Civil Code
In agreement with the central authorities involved, the Ministry of Justice of the Slovak Socialist Republic provides, pursuant to § 447 (2) and § 448 (2) of the Civil Code:
Decree No. 45 / 1964 Coll., implementing certain provisions of the Civil Code, is amended as follows:
1. Paragraph 18, including the title, reads:
"Compensation for loss of earnings
(K § 447 (2))
(1) Compensation for loss of earnings, together with the earnings of the injured party and any invalidity pension or partial invalidity pension, must not exceed the amount of 2500 CZK per month.
(2) Invalidity pension or partial invalidity pension are those pensions after deduction of any special pension tax. "
2. Paragraph 19, including the title, reads:
"Reimbursement of maintenance costs for survivors
(K § 448 (2))
The calculation of the cost of maintenance of the survivors shall be based on the average earnings of the deceased; However, the amounts by which the average earnings exceed the amount of CZK 2500 per month shall not be taken into account. '
Any adjustment to the refunds referred to in Article I shall be made, if any, from the effectiveness of the order and where those refunds have already been definitively decided on or have already been agreed on within one year of the entry into force of this Order.
This Decree shall take effect on 1 July 1973.
