Minister of Industry of the Czech Socialist Republic
of 14 July 1971
on the establishment of printing works and duplicates and the compulsory registration of printing machinery
The Minister of Industry of the Czech Socialist Republic, in agreement with the participating central authorities, provides for the establishment of ministries and other central authorities of the Czech Socialist Republic, as amended by the Czech National Council Act 147 / 1970 Coll., on changes in the system of ministries and other central authorities of the Czech Socialist Republic:
Purpose of the Order
The purpose of this decree is to prevent the dispersion of means of production, qualified experts and material sources in the printing industry and to establish a register of printing machinery and equipment.
Printers
A printing works within the meaning of this Decree is a production unit, making up printing products, equipped with printing machinery and equipment which reproduce designs by printing techniques. According to this decree, a single printing machine or device shall also be regarded as a printer for the same purpose as a printer.
Printing machinery
A printing machine within the meaning of this Decree is a device used for printing paper, plastic and metal films by printing, offset or rotogravure printing techniques. In addition, machinery and equipment for the serial production of black and white and colour photocopies, betting machines, hand-held fonts, reproduction cameras and electronic lift and engraving machines, as well as screen printing, shall be regarded as machines for the serial production of black and white and colour photocopies, planting machines, hand-held fonts, reproduction cameras and electronic drawing machines, unless they are used for printing moulded articles. The list of printing machinery is set out in Annex 1 to this Decree.
Basic provisions
(1) In order to ensure the efficient distribution of printing works and the use of the production technical and material base of the printing industry in line with the social interests, it is possible to establish:
(a) special-purpose printers
(b) racing printers
(c) breeding plants.
(2) The establishment and operation of special purpose and plant printers and duplicates requires the prior approval of the Ministry of Industry of the Czech Socialist Republic. The application for approval for the establishment and operation of special purpose and plant printers and duplicates shall be submitted to the Ministry of Industry of the Czech Socialist Republic on the form set out in Annex 2 to this Decree.
(3) The prior consent of the Ministry of Industry of the Czech Socialist Republic is also required
(a) to purchase printing machinery and spare parts from domestic or import;
(b) to export used printing machinery;
(c) for the conversion or sale of printing machinery, hand fonts, matrices and spare parts;
(d) to dispose of printing machinery and equipment.
Purpose printers
According to this Decree, special-purpose printing works are regarded as special-purpose printing works for which, in view of the strict settlement, the protection against misuse or for other serious reasons, it is appropriate to ensure such production in particular for that purpose established printing works.
Racing printers
A racing printer can only be set up with a production company for its own use if printing by printing is an essential part of its production process. In particular, the following shall be considered as an essential part of the production process:
(a) the printing technique required for the manufacture of products (e.g. the printing of scales of measuring instruments, etc.),
(b) printing of packaging materials (e.g. paper, PVC, foil, sheets, glass, etc.) where printing is an integral part of the technological process;
(c) printing on printed matter or packaging material;
(d) printing of technical production documentation related to the own production programme.
Reproduction
(1) The multiplication according to this Decree is an operational commercial facility for ensuring the local needs of the population and of the customer organisations, which perform reproduction in a fast and simple manner on propagating machines, i.e. instruments of the hymns, alcohol, planographic, ozalid, xerographic all formats and small-format offset machines in B3 format including (commercial reproductive plant).
(2) Propagating machinery and equipment intended solely for the internal use of offices, undertakings, organisations, institutes and institutions which do not carry out commercial activities with copies shall not be considered a breeding plant.
Common and implementing provisions
(1) Directors and responsible heads of printing works and duplicates, as well as heads of offices, undertakings, organisations, institutes and institutions where reproduction equipment is used for the purposes referred to in Article 7 (2), are required to ensure proper security of printing and reproduction machinery and to ensure, according to local circumstances, measures to prevent the misuse of such machinery and equipment.
(2) Purpose and racing printers are only authorised to manufacture those types of printing products which serve to ensure the tasks for which they have been set up. At the same time, those printing works are required to keep a record of the orders and to label the manufactured printing products.
Similarly, reproduction plants are required to keep a record of orders and mark copies made.
(1) The authorities and organisations which manage or own printing works or printing machinery and equipment are required to report the different types of machines in order to obtain and supplement the necessary records of the placement of such machines and to request approval for the continued operation of the printing works no later than two months after the date of application of this decree by the Ministry of Industry of the Czech Socialist Republic on the form set out in Annex 2 to this decree.
(2) Organisations engaged in the commercial activity of reproduction plants are required to submit a request for approval to the Ministry of Industry of the Czech Socialist Republic on the form set out in Annex 2 to this Decree no later than two months after the date of application of this decree. Where such organisations manage or own printing machinery and equipment, they shall report in the same way and within the same time limit as provided for in paragraph 1.
(3) The Ministry of Industry of the Czech Socialist Republic will consult the relevant central authority of the applicant and agree on further measures with the printing machines.
(4) The obligation to report printing machinery referred to in paragraphs 1 and 2 shall not apply to the following authorities and their subordinate organisations:
(a) the Federal Ministry of Transport, as regards the machinery for printing tickets of cardboard, train transport graphics, operating orders, regulations and aids for the performance of the service and for the production of printed matter by air information services;
(b) the Federal Ministry of Communications with regard to machinery for the printing of stamps, stamps, valuables and printing of regulations and aids for the performance of the service of postal, telecommunications and radio communications,
(c) Ministry of Education of the Czech Socialist Republic, in respect of puppy teaching machines at industrial and art schools;
d) Czech Office of Geodetic and Cartographic with regard to machines for printing cartographic works, maps and graphic materials and expert geodetic and cartographic texts,
e) Ministry of Forestry and Water Management of the Czech Socialist Republic with regard to special maps, graphics and tables, which are an essential part of forest and water economic plans,
(f) State price printing works for banknote printing machines, statuses and other prices,
g) The Association of Czech Artists and the Czech Fund of Fine Arts as regards machines for making artistic reproduction and for the education of artistic artists,
(h) blind institutes as regards machines serving the educational and educational purposes of blind persons;
(i) treatment facilities serving the purposes of rehabilitation care, which will be determined by the Ministry of Health of the Czech Socialist Republic in agreement with the Ministry of Industry of the Czech Socialist Republic.
(1) The Ministry of Industry of the Czech Socialist Republic entrusts
a) Polygraphic industry, branch headquarters in Prague
1. concentrate
(a) requests from authorities and organisations to give consent to the establishment and operation of printers and reproduction plants;
(b) requests by authorities and organisations to purchase printing machinery and spare parts from domestic or import;
(c) requests from authorities and organisations for the transfer or sale of printing machinery, hand fonts, matrices, spare parts or other equipment;
(d) requests by authorities and organisations to export used printing machinery;
(e) a report on the recording of printing machinery,
2. examine requests and reports received, in particular from the point of view of the use of machine capacity and custom supplies of printers and duplicates and submit observations to the Ministry of Industry of the Czech Socialist Republic;
b) Graphechnu, n., Praha:
1. concentrate on the design of the institutions and organisations for the disposal of printing machinery and equipment.
The manager (owner) is obliged to report to Graphechnik, n., Prague within 30 days of the approval of the liquidation and to submit the liquidation protocol, confirmed by Mr. Kovokrit, that the waste from the printing machinery has been submitted.
2. arrange services for surplus printing machinery intended for sale or transfer.
c) Research Institute of Polygraphic in Prague to provide expert opinions on printing machines and products made of them.
(2) The authorities and organisations are required to submit, upon request, to the Polygraphic industry, the branch office in Prague, the necessary documentation to ensure the tasks arising from this decree.
Final and repeal provisions
The provisions of this Order shall not apply to the following authorities and organisations:
(a) the Federal Ministry of National Defence and the Federal Ministry of Interior and their components, the Federal Ministry of Foreign Affairs, the Federal Ministry of Foreign Trade, the State Planning Commission, the Federal Statistical Office,
b) Ministry of Interior of the Czech Socialist Republic and its components, Czech Planning Commission, Czech Statistical Office,
(c) KSČ printing enterprises;
(d) national enterprises of the printing industry.
The Ministry of Industry of the Czech Socialist Republic keeps records of printers and duplicates with business activity and checks compliance with the provisions of this decree.
The Ministry of Industry of the Czech Socialist Republic may, for serious reasons, allow exemptions from this decree.
The following shall be deleted:
(a) Decree No 163 / 1958 of the Minister for Consumer Industry of the Czech Republic on the reporting of printing and reproduction machinery and equipment;
(b) Decree No 192 / 1958 of the Minister for Consumer Industry and the Minister for the Interior of the Ú. l., on the establishment and competence of printers and reproduction plants and on measures concerning printing and reproduction machinery and equipment;
(c) Directive No 27 / 1959 of the Ministry of Consumer Industry of the Czech Republic on the purchase, sale, allocation, transfer, registration of printing machinery and the disposal of discarded printing machinery.
This decree shall take effect on the day of its publication.
