Ministry of Forestry and Water Management of the Czech Socialist Republic
of 1 July 1987
on Czech Water Inspection
The Ministry of Forestry and Water Management of the Czech Socialist Republic provides according to § 12 paragraph 1 of the Act of the Czech National Council No. 130 / 1974 Coll., on State Administration in the Water Economy:
§ 1
Basic provisions
(1) A Czech water inspection (hereinafter referred to as "inspection") is hereby established as an expert inspection body on water quality protection and water management.
(2) The inspection is managed and the Director appointed and withdrawn by the Minister for Forestry and Water of the Czech Socialist Republic is responsible for its activities.
(3) The inspection is a state budget organisation. Inspections shall be broken down at headquarters and inspectors; the details of the organisation of the inspection are laid down in the rules of organisation.
§ 2
Inspection tasks
(1) Inspection under top water management supervision (1)
(a) discharges waste and special waters into surface, groundwater and public sewerage;
(b) the operation and maintenance of waste water treatment plants and other water-based works for the disposal, reduction or elimination of water pollution, shall also monitor the construction process of such plants;
(c) the protection of surface and groundwater from pollution and degradation by substances other than waste water;
(d) general use of surface water and use of surface water for navigation, so that such use does not jeopardise the purity of waters;
(e) by influencing the water economy and protecting the natural accumulation of water and water resources from pollution;
(f) carrying out the obligations imposed by the decisions of the water authorities on those who dispose of the waters or manage the water works, if any
1. monitoring the quantity and quality of surface, groundwater, special and waste water;
2. monitoring of substances other than waste water, including radioactivity;
3. preparing preventive measures to protect water from pollution;
(g) economic and nationwide management of water;
(h) compliance with the provisions on the payment of discharges of waste water into surface waters, (2) in particular with regard to the level of remuneration in relation to actual pollution of water.
(2) The inspection carries out additional tasks arising from specific regulations, 3) as well as tasks of the expert inspection body on water quality and water management, imposed by the Ministry of Forestry and Water Management of the Czech Socialist Republic.
§ 3
Performance of inspection activities and cooperation with inspection authorities
(1) The inspection shall identify deficiencies in the organisations checked, their causes and the persons responsible for their establishment or duration; it shall, depending on the nature of the case, also identify the causes of the deficiencies in the bodies governed by the audited organisation (hereinafter referred to as "the authorities'). When identifying gross deficiencies or deficiencies which are not possible within the scope of the audited organisation, the intervention of the superior authority.4)
(2) The inspection shall discuss the results of the inspection with the inspected organisation and recommend its proposals for the water quality and rational water management section. On the basis of audit findings, inspections by the authorities of the audited organisations shall familiarise themselves with the conclusions of their findings and propose measures to improve management and control quality, to implement economic instruments and to improve overall work on water quality protection, rational water management and to ensure systematic monitoring of their compliance. For the purpose of prevention, it shall generalise and publish the results of its checks.
(3) The inspection is required to cooperate with the inspection services in the audited organisations and their superior bodies as well as with other inspection bodies.
§ 4
Cooperation of inspections with national committees
(1) The inspection proposes to the national committees, as water authorities, measures to remedy the deficiencies identified and to impose fines on organisations and workers; 5) it provides the national committees with the necessary supporting documents.
(2) The inspection shall cooperate with the national committees in carrying out the tasks, taking into account their requirements when drawing up the control plans and transmitting to them the findings obtained in carrying out the activities to be used for the exercise of water management supervision.
(3) The inspection provides technical assistance to the national committees and their managed or managed organisations, in particular water pipelines and sewerage undertakings, for their request, in particular opinions on investment activities, for the preparation of changes in the production process or in the scope of the production of organisations, and for the modification and modification of water-related water-related works with regard to the protection of water purity. provide them with expert assistance also for preventive action, in particular in the development, implementation and evaluation of measures to prevent and manage pollution of water. 5)
§ 5
Cooperation of inspection with other authorities and cooperation with institutions and workers
(1) The inspection in the performance of its tasks shall cooperate with the central authorities of the State, the control, inspection and other expert bodies, in particular the sanitary services, the State Mining Administration, the supervision of nuclear safety, nature conservation and the prosecution authorities.
(2) The inspection shall be based on the experience and initiative of the workers and shall benefit from their complaints, initiatives and notifications. It takes advantage of the initiative of social organisations, especially the Revolutionary Trade Union, the Socialist Youth Union, the Czech Union of Protectors of Nature and the Czech Fisheries Union and provides them with methodological and advisory assistance.
§ 6
Repeal
Decree No. 136 / 1960 Coll., on State Water Inspection, as amended by Decree No. 55 / 1966 Coll.
§ 7
Efficacy
This Decree shall take effect on 1 October 1987.
