DECLARATION
Ministry of Forestry and Water Management of the Slovak Socialist Republic
of 9 June 1976
on water operators
The Ministry of Forestry and Water Management of the Slovak Socialist Republic provides, pursuant to § 16 paragraph 2 of the Slovak National Council Act No. 135 / 1974 Coll., on State Administration in the Water Economy, in agreement with the participating authorities of the State Administration:
Determination of water farms
(1) Organisations are required to designate qualified personnel ("water operators") to ensure professional management of water and waste water treatment:
(a) where they collect or otherwise use surface or groundwater, or where they use public water for production purposes in total quantities exceeding 1250 m3 per month or 15 000 m3 per year;
(b) if they discharge waste or special waters exceeding that at their origin:
1. pollution characterised by the BSK5 indicator in quantities exceeding 5 tonnes per calendar year;
2. undissolved substances in quantities exceeding 25 tonnes per calendar year;
3. Petroleum substances exceeding 10 mg / l and a total quantity of 5 tonnes per calendar year,
4. dissolved inorganic salts exceeding 1000 mg / l and a total quantity of 50 tonnes per calendar year;
5. substances with apparent acidity or apparent alkalinity exceeding 0,5 mval / l and a total quantity of 500 kg ecv per calendar year,
6. radioactive substances or infected substances (e.g. waste water from hospital infectious departments, sanitation, rendering, vaccine production, etc.),

(2) If the conditions referred to in paragraph 1 are met by an individual plant or operation, the organisation shall also designate a water operator for that plant or operation.
(3) Organisations which collect or otherwise use water for farming purposes are not required to designate water operators, even if they otherwise satisfy the conditions laid down in paragraph 1 (a).
The management organisations and bodies and their central authorities shall designate a water operator where one of the organisations managed by them has an obligation to designate a water operator pursuant to Paragraph 1.
If useful and not prejudicial to the performance of tasks, the functions of a water operator may be combined with other activities or the water operator may be designated jointly for several plants or plants, or, where appropriate, for individual plants, the water operator of the organisation may be entrusted with this function.
Organisations shall notify the names and workplaces of persons designated as water operators to the water authority responsible for authorising the treatment of waters which establishes an obligation for the organisation to designate a water operator, if this obligation is based on the collection of water from a public water pipeline, to the district national committee in whose territorial district water supply is withdrawn; notifications shall also be made in the event of a change or redesignating a water operator.
Operation of water farms
The water operators designated in accordance with Article 1 shall perform the following tasks in order to ensure the professional management of water and waste water treatment for the organisation, plant or operation for which they have been designated, in particular:
(a) monitor compliance with generally binding legislation issued on the water sector and comply with the decisions of the water authorities;
(b) prepare, propose and evaluate water management measures related to the development of production and, where appropriate, changes in technology;
(c) carry out regular technical and economic analyses;
(d) develop proposals to improve water management and improve the quality of waste or special waters discharged;
(e) ensure compliance with and compliance with the current status of the water management of operations, plants or organisations;
(f) continuously monitor and control the status and operation of water management and waste water treatment facilities;
(g) monitor and control water management;
(h) in the event of failure of cleaning equipment or of operational failures which, or may result in, a short-term deterioration of water quality, propose and monitor the implementation of the necessary measures, or carry out such measures themselves,
(i) ensure that a water law decision relating to the operation, plant or organisation is available for both water and upper water surveillance.
The water operators designated in accordance with Article 2 shall carry out, in particular, the following tasks when providing professional water management and waste water treatment for the superior organisation, body or central authority for which they have been designated:
(a) develop water management and waste water treatment concepts;
(b) methodically manage and control the water operators of subordinate organisations,
(c) regularly evaluate the management of water and waste water treatment in subordinate organisations and carry out the necessary technical and economic analyses;
(d) draw up overall reports on water management;
(e) pursue water-based interests in investment activities.
Water management qualification
(1) The water management may be a worker who has a university or full secondary vocational education in the water, chemical and technological or other related direction, or a full secondary general education, supplemented by a specialised course for water operators. The degree of required education shall be determined by the organisation in proportion to the nature of the workplace for which the water operator is designated. When assessing another relative, account shall be taken of the nature of the workplace for which the water operator is intended and of the full curriculum of the school.
(2) Exceptionally, a worker who has only a full secondary general education may also be designated as a water management worker if, within 3 years of his designation, he has completed a specialised course for the water operator.
(3) Waterkeepers are required to continuously complement their knowledge on the water management and protection sectors.
Workers who, on the dates of application of this decree, performed the functions of water operator under the regulations in force, shall be deemed to be eligible for the duties of water operator even if they do not meet the requirements of education under § 7.
Transitional and final provisions
(1) The first notification pursuant to Article 4 must be made by the organisation within 6 months of the date of entry into force of this Decree; otherwise within 15 days of the date of designation of the water operator.
(2) The organisation of the agricultural production sector shall designate the water operators referred to in Article 1 gradually and no later than 1 January 1978. This is without prejudice to the obligation for the sector to designate a water operator under § 2 for senior organisations and bodies and their central authorities as soon as one of the organisations managed by them fulfils the conditions for the designation of a water operator under § 1.
The duties of the organisations under this decree shall be carried out by military services, economic organisations and economic organisations in the field of the Federal Ministry of Defence under a special statute.
The Directives of the Ministry of Agriculture, Forestry and Water Management no. 58 880 / 73- 1961 and the Ministry of Health no. HE- 3240 / 19.11.1961 for the activity of racing, business, branch and department water farms (registered in the amount of 31 / 1966 Coll.) are hereby repealed.
This Decree shall take effect on 1 July 1976.
