amending and supplementing Decree No. 45 / 1964 of the Ministry of Justice Coll., implementing certain provisions of the Civil Code
The Ministry of Justice of the Czech Socialist Republic, in agreement with the central authorities involved, provides for the implementation of Sections 447 (2) and 448 (2) of the Civil Code:
Decree No. 45 / 1964 Coll., implementing certain provisions of the Civil Code, is amended as follows:
1. Paragraph 18, including the title, reads:
"Compensation for loss of earnings
(K § 447 (2))
(1) Compensation for loss of earnings, together with the earnings of the injured party and any invalidity pension or partial invalidity pension, must not exceed the amount of 2500 CZK per month.
(2) Invalidity pension or partial invalidity pension are those pensions after deduction of any special pension tax. "
2. Paragraph 19, including the title, reads:
"Reimbursement of maintenance costs for survivors
(K § 448 (2))
The calculation of the cost of maintenance of the survivors shall be based on the average earnings of the deceased; However, the amounts by which the average earnings exceed the amount of CZK 2500 per month shall not be taken into account. '
On the basis of a proposal from the injured party, submitted within one year of the date of the entry into force of this Order, any adjustment shall be made to the compensation referred to in Article 1 (1) (a) of the Regulation. Even from the beginning of the application of this decree and where those refunds have already been definitively decided or have been agreed upon.
This Decree shall take effect on 1 July 1973.
