on the arrangements for Members of national committees and citizens elected to be members of national committees
The Government of the Czechoslovak Republic orders pursuant to § § 41 and 45 paragraph 2 (c) of Act No. 65 / 1960 Coll., on National Committees:
§ 1
(1) The national committee Member shall be a representative of his constituents in the national committee. He is obliged to perform the function to which the people called him, conscientiously and honestly, for the benefit of socialist society and its citizens. He is guaranteed to perform his duties without prejudice to his working earnings.
(2) In order not to interfere with the functioning of the national economy and to ensure the greatest possible economy, the national committees shall organise the activities of their Members in a fundamental way so that they can perform their duties mainly outside working hours.
§ 2
(1) An economic, budgetary or other organisation (hereinafter referred to as "organisation") is required to provide its staff member, who is a member of the National Committee, with the necessary time to fulfil the obligations arising from the duties of a member of the National Committee (hereinafter referred to as "the exercise of his duties").
(2) The organisation shall, at the request of the Board of National Committees, provide unpaid leave to the Presidents, their Vice-Presidents, the Secretaries of the National Committees and other members of the Board of National Committees, as well as the chairmen of the Social Security Assessment Committees of the Regional and District National Committees, who are fully relieved of their duties.
(3) In accordance with the principles referred to in paragraphs 1 and 2, they shall also release their members of the single agricultural cooperatives and other folk cooperatives for the performance of their duties.
§ 3
(1) For the period of leave provided under Paragraph 2 (1), the staff member shall be entitled to all benefits from the organisation as if he had worked for it during that period. The benefits of staff members during their leave shall be calculated on an average basis over the last three months.
(2) Members of the national committee who are domestic workers or who are not in employment, such as members of single agricultural cooperatives, shall, at their request, provide the national committee with adequate compensation for the earnings lost from their duties.
(3) Members of the local national committees who, in their capacity as chairman, deputy or secretary of the local national committee, are required to provide compensation for lost earnings up to a maximum of 20 hours a month. In exceptional cases where more leave of absence would be necessary, they shall be paid by the National Committee for additional hours of service. If these officials are not employed or are domestic workers, the National Committee shall provide them with the full compensation of the earnings lost in the performance of their duties.
(4) Members of national committees shall be entitled to reimbursement of the necessary expenses incurred in the performance of their duties. This expenditure shall be borne by the national committee. The rules applicable to civil servants shall apply mutatis mutandis to the right to reimbursement and to the determination of the amount of the expenditure.
§ 4
The functionalities of the national committees referred to in Article 2 (2) shall be provided by the National Committee, starting with the 1960 functional period, by remuneration for the performance of its duties. The remuneration is an appreciation of the extent of responsibility and the importance of the function and includes compensation for lost earnings for officials of national committees who are fully relieved of their duties.
§ 5
The functionaries of the national committees referred to in Article 2 (2), who are fully relieved of their current employment, shall be assessed in terms of the rules on paid leave for recovery and for sickness and pension insurance purposes as staff of the national committees.
§ 6
(1) A staff member who has been granted leave of employment (paragraphs 1 and 2 of Section 2) cannot therefore be reduced to the rights and entitlements arising from the employment relationship (for example, in the case of inclusion in the working or salary classes and groups with regard to the entitlement to and the length of the vacation, in terms of sickness insurance, pension insurance, loyalty allowance, etc.).
(2) The role of Member of the National Committee cannot justify the transfer (transfer, transfer) of a staff member to a post which would make it impossible for him to perform his duties or work with less qualified qualifications, or for the removal of employment. If an organisation infringes this provision, the competent authority shall, on a proposal from the Board of the National Committee, seek immediate redress.
§ 7
Paragraph 1, § 2 (1) and (3), § 3 (1), (2) and (4) and § 6 shall also apply to citizens elected by the national committee to be members of its commission.
§ 8
More detailed regulations will be issued by the Ministry of Interior in agreement with the Ministry of Finance, the Central Council of Trade Unions and the State Social Security Office.
§ 9
This Regulation shall enter into force on 12 June 1960. they shall be carried out by the Home Secretary in agreement with the participating members of the Government.
