Regulation on the criminal jurisdiction of local national committees

of 11 October 1957
on the criminal jurisdiction of local national committees.
The Government of the Czechoslovak Republic orders pursuant to § 7 (2) of Act No. 89 / 1950 Coll., on Administrative Criminal Procedure (Administrative Criminal Code):
§ 1
(1) The local national committees prosecute in the first storehouse the offences referred to in the following provisions of the Administrative Criminal Act No. 88 / 1950 Coll., amended and supplemented by Acts No. 102 / 1953 Coll. and No. 14 / 1957 Coll. (hereinafter referred to as the Administrative Criminal Act):
Article 52 (ensuring the collection of raw materials),
§ 55 (field and forest pride),
§ 58 (protection of fishing),
§ 59 (protection of birds and animals useful for agriculture),
§ 60 (protection of animals against abuse),
Article 93 (failure to comply with the notification obligation),
§ 96 (damage to public decrees),
Section 122 (protection of teaching),
§ 129 (protection of public entertainment),
Article 131 (radio interference); and
§ 136 (exceeding the closing hour).
(2) In addition to the offences referred to in paragraph 1, local national committees in the first chair shall, in accordance with the relevant provisions of the Administrative Criminal Law, prosecute infringements against the provisions of generally binding regulations and other general legislation of local national committees and their executive bodies.
§ 2
The Council of the Regional National Committee shall determine which local national committees are prosecuting in the first chair, in addition to the offences referred to in Section 1, other of the offences referred to in the following provisions of the Administrative Criminal Code:
§ 35a (theft and damage to property owned by the socialist),
Article 43 (protection of construction),
§ 46 (misdemeanor in other business),
§ 79 (ensuring fair distribution of apartments),
§ 85 (combating alcoholism),
Section 87 (black trade),
§ 88 (nutritional and supply offences),
§ 89 (price violations),
§ 127 (protection of civil coexistence - general provision),
Article 137 (gambling); and
Article 137a (damage to personal and private property).
§ 3
(1) The criminal jurisdiction of the local national committees to which trade unions are established shall be exercised by such trade unions in their field of competence and, as regards the prosecution of more serious offences, by a three-member criminal commission established under Paragraph 90 of the Administrative Code. Only the criminal commission is responsible for imposing the following penalties: corrective action, public reprimand, a fine exceeding 500 CZK and a ban on action.
(2) The criminal jurisdiction of local national committees not established by trade unions is exercised by three-member criminal commissions.
§ 4
The provisions of the Administrative Code shall apply to infringement proceedings under previous provisions carried out by criminal commissions and other executive bodies of local national committees. However, the criminal commission and the other executive bodies of the local national committees may not take action under § § 12 to 20 of the Code of Criminal Procedure (on detention, detention, other restrictions and search).
§ 5
Transfers initiated before the application of this Regulation shall be dealt with by the authorities competent under the existing rules.
§ 6
Government Decree No. 78 / 1951 Coll., on the criminal jurisdiction of local national committees, is hereby repealed.
§ 7
This Regulation shall enter into force on 1 January 1958. They shall be carried out by the Home Secretary in agreement with the participating members of the Government.
