DECLARATION
of 10 December 2004
implementing the Civil ID Act and the Travel Documents Act
The Ministry of Interior shall determine, pursuant to Articles 4 (2), 5 (1) (b), 12 (4) and 26 of Act No. 328 / 1999 Coll., on Civil Documents, as amended by Act No. 320 / 2002 Coll. and Act No. 559 / 2004 Coll., hereinafter referred to as "the Act on Civil Documents', and Article 5 (3) (a) and Article 20 (5) of the Act No. 329 / 1999 Coll., on Travel Documents and Amendment to Act No. 283 / 1991 Coll., on the Police of the Czech Republic, as amended, (Act on Travel Documents), as amended by Act No. 559 / 2004 Coll., hereinafter referred to as" the Act on Travel Documents':
CITIZENS
Model of identity card with machine-readable data
(1) The model of the identity card with machine-readable data is set out in Annex 1.
(2) The machine-readable data are recorded in a specified zone at the bottom of the ID card.
(3) The data referred to in Articles 3 (3) and 3 (4) of the Civil ID Act, as well as data on the place of birth, address of permanent residence, surname and family or personal status [Paragraph 3 (2) (a) of the Civil ID Act] are entered on the back of the identity card in the model set out in Annex 1.
Model ID card without machine-readable data
The model of the identity card without machine-readable data is set out in Annex 2.
Marked part of the ID card
(1) The marked part of the identity card, the model of which is given in Annex 1, means the two upper corners of which are marked in colour on the back of letters A and B.
(2) When reporting the change in residence, the part marked with A shall be separated.
(3) In the case of a change in the mandatory data entered on the identity card, in addition to the change in the permanent residence address referred to in paragraph 2, the part marked with the letter B shall be separated.
Model of the certificate and model of the application
(1) The model form for the certificate of identity card is set out in Annex 3.
(2) The model form of the certificate of amendment to the particulars entered on the identity card is set out in Annex 4.
(3) The model of the application form for an identity card with machine-readable data is set out in Annex 5.
(4) The model of the application form for the issue of the identity card without machine-readable data is set out in Annex 6.
Requirements for the technical execution of the photograph for the issue of the identity card
(1) The photograph or similar image recording (hereinafter referred to as "photographs") attached to the application for the issue of a card has a smooth surface, shall conform to long-term image stability tests and shall be in black and white or colour. The photograph is rectangular with dimensions 35 mm x 45 mm, built on a shorter side, with straight or rounded corners with radius r = 3 mm + / - 0,5 mm, thickness from 0,13 mm to 0,27 mm. The picture dimensions are shown in Annex 7, Figure 1.
(2) The photograph shows the head and upper part of the arms of the person displayed in the front view so that the central vertical plane of the face is an extension of the vertical plane of the lens of the sensing system and the horizontal plane of the face formed by the eyes is an extension of the horizontal plane of the lens of the sensing system. The position of the lens of the sensing system vis-à-vis the person is shown in Annex 7, Figure 2. The view of the person displayed is directed to the lens.
(3) The photograph must correspond to the person displayed at the time of application. A view over the shoulder, twisted or tilted head are not allowed. The depicted person shall have a neutral expression and a closed mouth, the eyes shall be open and the hair shall not be covered.
(4) The distance between the upper edge of the head and the upper edge of the photograph is at least 2 mm. The height of the facial part of the head, which consists of a distance from eyes to chin, shall be at least 13 mm. The head size of the person displayed, including its location, is shown in Annex 7, Figure 3.
(5) The background behind the person displayed is white to light blue, or light grey, and the smooth transition of these colours is permitted. The photo is without glare which would hide or significantly change the characteristic identification characteristics of a person, which are in particular the shape and location of eyebrows, eyes, nose, mouth, chin and the overall shape of the face. It is not possible to perform reproductions or other modifications of the negative or positive photo, or digital processing of the image of the citizen or his printing.
TRAVEL DOCUMENTS
Model passport with machine-readable data and biometric data carrier
(1) The model passport with machine-readable data and a biometric data carrier is set out in Annex 8.
(2) The machine-readable data are recorded in a specified zone on the lower part of the other side of the passport listed in Annex 8, where the data referred to in § 6 (3) (a) and (b) of the Travel Documents Act are entered.
(3) The biometric data carrier is located on the other side of the passport listed in Annex 8 and is only legible when the travel document is opened.
(4) On page 3 of the passport set out in Annex 8, the particulars listed in Section 7 (1) of the Travel Documents Act are entered.
(5) On pages 6 and 7 of the passport listed in Annex 8, a register is given (1) with the translation of the names of the relevant information entered in this passport in the German, Italian, Spanish, Portuguese, Dutch, Swedish, Danish, Finnish, Greek, Irish, Slovak, Slovenian, Polish, Hungarian, Maltese, Lithuanian, Estonian, Latvian and Russian languages.
Model of passport without machine-readable data and without biometric data carrier
(1) The model of a passport without machine-readable data and without a biometric data carrier is set out in Annex 9.
(2) On page 31 of the passport set out in Annex 9, the particulars listed in Section 7 (1) of the Travel Documents Act are entered.
The passports referred to in § 6 and § 7 are travel documents of the type of book and contain 32 pages.
Model travel licence
(1) The model of the travel document is set out in Annex 10.
(2) The travel document referred to in Annex 10 is a travel document of a type of book and contains 8 pages.
(3) The information provided for in Section 7 of the Travel Documents Act is entered in the official records on page 8.
Model of another travel document issued under an international contract
The models of another travel document issued under an international contract, unless provided for in this contract, are set out in Annex 11.
Models of application forms
(1) The model of electronically processed application for the issue of a passport with machine-readable data and a biometric data carrier is set out in Annex 12.
(2) The model of the application form for a passport without machine-readable data and without biometric data carrier is set out in Annex 13.
(3) The model of the application form for a travel document is set out in Annex 14.
(4) The models of the application forms for the issue of other travel documents issued under international agreements (travel annex and card) are set out in Annex 15.
(5) The model of the application form for changes to or additions to the travel document is set out in Annex 16.
Requirements for the technical execution of the photograph attached to the travel document application
The provisions of Section 5 shall apply mutatis mutandis to the technical execution of the photograph attached to the travel document application.
TRANSITIONAL, REPEAL AND FINAL PROVISIONS
Transitional provision
(1) The forms of the certificate of identity card, the certificates of change of family status and, where applicable, the change of surname in connection with the change of marriage status, the application for the issue of a card, the application for a passport, the application for the issue of a travel licence, the application for the issue of other travel documents issued under international agreements and the request for data changes and the entry of the child in the travel document issued before the date of entry into force of this decree may be used until 31 December 2006.
(2) Passports without machine-readable data and travel cards in accordance with the models in the current legislation2) may be issued until 31 December 2006 at the latest.
(3) Passports with machine-readable data in accordance with the model in the current legislation2) may be issued until 30 April 2005 at the latest.
Repeal
They shall be deleted:
1. Decree of the Ministry of Interior No. 177 / 2000 Coll., implementing the Act on the Registration of Citizens, the Act on Civil Documents and the Act on Travel Documents.
2. Decree of the Ministry of Interior No. 248 / 2001 Coll., amending Decree of the Ministry of Interior No. 177 / 2000 Coll., implementing the Act on the Registration of Residents, Act on Civil Documents and the Act on Travel Documents.
3. Decree of the Ministry of the Interior No. 543 / 2002 Coll., amending Decree of the Ministry of the Interior No. 177 / 2000 Coll., implementing the Act on the Registration of Citizens, Act on Civil Documents and the Act on Travel Documents, as amended.
Efficacy
This Decree shall take effect on 1 January 2005.

In the event that a citizen has made a declaration of entry into a partnership or its partnership has died of the death of one of the partners by declaring one of the partners dead, or by cancelling the decision of the court, the model of the back of the identity card with machine-readable data shall be as follows:
