DECLARATION

on the scope and manner of keeping of the packaging records and reporting of data from that register
According to § 50 (2) of Act No. 477 / 2001 Coll., on Packaging and on the amendment of certain laws (Act on Packaging), as amended by Act No. 94 / 2004 Coll., ("the Act '), the Ministry of the Environment provides for the implementation of § 15 (3) of the Act:
Method and scope of keeping records
(1) The person who places packaging or packaged products on the market or put into circulation shall keep a continuous record of packaging at least to the extent that it is required to report pursuant to Article 2 (1) to (3).
(2) The authorised company shall keep records of the quantities of packaging and the quantities of waste from packaging and the manner in which they are used at least to the extent that it is required to report pursuant to Article 2 (4).
Scope of reporting of records data
(1) A person who places on the market or puts into circulation packaging or packaged products, unless he is a person referred to in paragraph 2 or 3, shall report to the Ministry of the Environment (hereinafter referred to as "Ministry") the records in the form of the completed annual statements set out in Annexes 1 and 3; where that person also places on the market or puts into circulation reusable packaging, meeting the conditions laid down in Article 13 (2) of the Act, he shall also report the records in the form of the completed annual statement set out in Annex 2.
(2) A person who places on the market or puts into circulation only reusable packaging, complying with the conditions of Paragraph 13 (2) of the Act, shall report to the Ministry the records in the form of the completed annual statements set out in Annexes 1 and 2.
(3) A person who has proven to place on the market or put into circulation less than 300 kg of packaging per calendar year shall report to the Ministry the records in the form of the completed annual statements referred to in Annexes 1 and 4.
(4) The Authorised Society reports to the Ministry data from the records in the form of the completed statement set out in Annex 5.
Repeal
Decree No. 117 / 2002 Coll., on the scope and manner of keeping the packaging records and reporting of data from this register are hereby repealed.
Efficacy
This Decree shall take effect on 1 January 2005.
