laying down conditions for the implementation of measures to improve the defence of pigs by vaccination
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll. and Act No. 382 / 2022 Coll., and § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
§ 1
Subject matter
This Regulation, following directly applicable European Union1) and in accordance with the European Union's Common Agricultural Policy Strategy Plan in the Czech Republic, regulates the conditions for the implementation of measures to improve the defence of pigs by vaccination.
§ 2
Measures to increase defences in pig breeding by vaccination
(1) The measures to improve the defence of pigs by vaccination are intended for pigs in categories
(a) piglets,
(b) pigs in fattening;
(c) sows; and
(d) sows.
(2) For the purposes of this Regulation:
(a) the piglet shall fly during the period of birth to the end of the prefattening period, but not more than the end of the fourteenth week of age,
(b) pig fattening pig during the period from the end of the prefattening period, but not later than the beginning of the 15th week of age, to the date of slaughter, not classified in the categories referred to in paragraph 1 (c) or (d);
(c) an adult female pig from 5 months to the end of the first pregnancy; and
(d) an adult female pig with at least 1 birth.
§ 3
Applicant for subsidy
(1) The applicant may be a natural or legal person who, at the date of submission of the application for a grant (the application), holds at least 3 livestock units of pigs registered in the central livestock register (the central register). the conversion factors for determining the number of livestock units are set out in the Annex to this Regulation.
(2) The applicant for the grant referred to in paragraph 1 ("the applicant") shall keep the farm animals subject to the subsidy on the holding registered in the central register for as long as the applicant fulfils the conditions for measures to increase the defensibility in pig breeding by vaccination during the period from 1 March of the relevant calendar year for which the subsidy is to be granted until the last day of February of the following calendar year ("the period of compliance") and referred to in the application ("the holding").
§ 4
Request
(1) The application shall be submitted by the applicant to the State Agricultural Intervention Fund (hereinafter referred to as the Fund) by 15 May of the relevant calendar year for which the subsidy is to be granted, using the form issued by the Fund for the calendar year concerned in the single application.
(2) The application referred to in paragraph 1 shall contain:
(a) the formalities laid down in Article 3 (2) of the Agriculture Act;
(b) an indication of the categories of pigs to which the applicant applies for the grant;
(c) a declaration that the applicant undertakes to comply with the cross-compliance rules laid down in the Government Regulation governing cross-compliance rules for farmers;
(d) a list of the registration numbers of the holding on which the applicant fulfils the conditions for measures to increase the defensibility in pig farming by vaccination throughout the period of compliance;
(e) a list of the permanent object numbers used by the applicant for the breeding of each category of pig throughout the period of compliance and belonging to the holding;
(f) the number of animals in each category of pig for which the applicant will comply with the conditions laid down in this Regulation; and
(g) the list of pathogens against which the applicant will vaccinate pigs in each category on the holding.
(3) The Annex to the application referred to in paragraph 1 shall be an immunisation programme for each holding containing:
(a) the serial number of the immunisation programme;
(b) the period for which the immunisation programme is processed;
(c) the registration number of the holding;
(d) the category of pigs referred to in Article 2 (1), which will be vaccinated on the holding;
(e) a description of the vaccination carried out in breeding and not supported by this Regulation or supported under other subsidy programmes;
(f) the list of pathogens referred to in Article 7 against which pigs will be vaccinated in each category;
(g) identification of the veterinarian; and
(h) a certificate signed by the veterinarian.
§ 5
Conditions for granting the subsidy
(1) The Fund shall grant the grant in full if the applicant has, for the entire period from 1 June of the relevant calendar year for which the subsidy is to be granted, to the last day of February of the following calendar year ("retention period"):
(a) in accordance with the conditions laid down in this Regulation and the immunisation programme referred to in Article 4 (3), the individual categories of pigs are vaccinated against the pathogens of infectious swine diseases;
(b) keep on a continuous basis, no later than the following day after the vaccination operation, a record of the purchase and use of the vaccines applied for against the pathogens listed in the application and treat them in accordance with the requirements laid down in another legislation and directly applicable European Union3),
(c) keeps tax, accounting or other evidence of the purchase of vaccines used in the framework of measures to improve the defence of pigs by vaccination according to the holding on which they were applied;
(d) indicate the individual premises with an indication of the category of pigs referred to in Article 2 (1) in the case of holdings of several categories of pigs within a permanent establishment referred to in Article 4 (2) (e); and
(e) it shall clearly indicate, in the register referred to in point (b), the vaccines applied against the pathogens listed in the application and, where appropriate, it shall keep a separate record of those vaccines.
(2) The Fund will grant a full grant if the applicant has, throughout the period of fulfilment of the conditions:
(a) register pigs in the central register;
(b) keeping on that holding farmed animals in such a way as to avoid their abuse or killing by unauthorised means (4); and
(c) complies with the cross-compliance rules laid down in the Government Regulation governing cross-compliance rules for farmers.
(3) For the purposes of this measure, the eligible animal referred to in Article 2 (2) (a) to (d) shall be the animal in which, during the retention period, a complete completed vaccination has been carried out under the conditions of registration of the vaccine administered or the conditions of use laid down by the manufacturer for the autogenic pathogen vaccine in accordance with the immunisation programme ("complete vaccination ').
(4) The Fund shall grant a subsidy to the number of livestock units determined according to the number of animals detected in each category of pig referred to in Article 2 (1) during the whole retention period for holdings meeting the conditions laid down in this Regulation.
§ 6
Report of complete vaccination
(1) The applicant shall send electronically after the end of the retention period of the Fund, using the form issued by the Fund for the relevant calendar year, a report on the total number of eligible pigs in each category for which a complete vaccination has been carried out ("final report") separately for each holding and certified by the treating veterinarian.
(2) The final report shall also include a list of pathogens against which pigs have been vaccinated in each category in accordance with the immunisation programme. In the final report, the applicant for the category of sows shall indicate the number of animals corresponding to the number of vaccinations carried out before each end of pregnancy for each vaccinated sows during the retention period.
(3) The final report shall be submitted by the applicant to the Fund no later than the twentieth day following the end of the retention period for which the report is sent.
§ 7
Grant rate
(1) The subsidy rate is:
(a) in the case of vaccination of the category of pigs referred to in § 2 (1) (a) against infectious swine diseases caused by pathogens
1. Escherichia coli resulting in weaning diarrhoea EUR 25 per livestock unit of piglets,
2. Escherichia coli causing oedema disease EUR 51 per livestock unit of piglets,
3. Pigs circovirus type 2 47 EUR per piglet livestock unit,
4. by Mycoplasma spp. EUR 29 per piglet livestock unit;
5. Lawsonia intracellularis EUR 50 per livestock unit of piglets,
6. Actinobacillus pleuropneumoniae EUR 70 per livestock unit of piglets, or
7. other agents of infectious diseases in the holding can be solved by one or more registered vaccines or autogenic vaccines EUR 50 per piglet livestock unit;
(b) in the case of vaccination of the category of pigs referred to in Article 2 (1) (b) against infectious disease caused by pathogens
1. Actinobacillus pleuropneumoniae EUR 7 per livestock unit of fattening pigs,
2. Lawsonia intracellularis EUR 5 per livestock unit of fattening pigs; or
3. other agents of infectious diseases in breeding, by means of one or more registered vaccines or autogenic vaccines EUR 10 per livestock unit of fattening pigs,
(c) in the case of vaccination of the category of pigs referred to in § 2 (1) (c) against infectious swine diseases caused by pathogens
1. Clostridium perfringens EUR 13 per livestock unit of gilts,
2. pig circovirus type 2 8 EUR per livestock unit of pigs,
3. Glaesserella (Haemophilus) parasuis EUR 6 per livestock unit of pigs,
4. by Mycoplasma 5 EUR per livestock unit of sows,
5. rotavirus EUR 1 per livestock unit of gilts,
6. leptospira 4 EUR / 1 livestock unit,
7. influenza A viruses of EUR 13 per livestock unit of pigs; or
8. Other agents of infectious diseases in breeding, which can be solved by one or more registered vaccines or autogenic vaccines EUR 6 per livestock unit of gilts; or
(d) in the case of vaccination of the category of pigs referred to in § 2 (1) (d) against infectious swine diseases caused by pathogens
1. Clostridium perfringens EUR 7 per livestock unit of sows,
2. pig circovirus type 2 3 EUR per livestock unit of sows,
3. Glaesserella (Haemophilus) parasuis 2 EUR per livestock unit of sows,
4. Mycoplasma 2 EUR / 1 livestock unit of sows,
5. rotavirus EUR 1 per livestock unit of sows,
6. leptospira 2 EUR / 1 livestock unit of sows,
7. influenza virus type A 4 EUR per livestock unit of sows; or
8. Other agents of infectious diseases in breeding, which can be solved by one or more registered vaccines or autogenic vaccines EUR 3 per livestock unit of sows.
(2) The subsidy for the relevant calendar year shall be calculated as the product of the number of livestock units detected in each category of pig referred to in Article 2 (1) and the rates referred to in paragraph 1.
(3) The Fund will grant a subsidy in the currency of the Czech Republic; the subsidy rate referred to in paragraph 1 shall be converted at the exchange rate at 31 December of the year preceding the year for which payment is granted and published in the Official Journal of the European Union. If the exchange rate is not fixed at that date, the nearest preceding shall apply.
(4) The Fund will not grant a subsidy to the applicant's holding if at least one of the permanent buildings referred to in the application is located in the territory of the capital of Prahy 5).
§ 8
Reduction or non-grant
(1) The subsidy for the relevant calendar year shall not be granted on the holding for the category of pigs concerned if the Fund finds that the applicant has not complied with one of the conditions laid down in Articles 3 (1) or (2), 4 (3), 5 (1) (b), 5 (2) (a) or 6 (1).
(2) The subsidy for the calendar year in question shall not be granted if the Fund finds that the applicant has not complied with the condition laid down in Article 5 (2) (b) or has infringed Article 2, 4 or 5 of the Code on the protection of animals against abuse on one of its holdings.
(3) If the Fund finds that the number of livestock units detected by animals kept by the applicant during the retention period is
(a) higher than the number of livestock units indicated in the application referred to in Article 4 (1) for the category of pig in question on the holding of the applicant, shall use the number of livestock units indicated in that application for the calculation of the subsidy; or
(b) lower than the number of livestock units indicated in the application referred to in Article 4 (1), the subsidy for the category of pig concerned shall be reduced or, where appropriate, not granted.
(4) If the Fund finds that the applicant has failed to comply with the condition laid down in Article 4 (2) (e), the subsidy for the category of pigs in question shall be reduced by 3%.
(5) If the Fund finds that the applicant has not complied with the condition laid down in Article 5 (1) (c), it shall reduce the subsidy for the category of pigs concerned to the holding by 20%.
(6) If the Fund finds that the applicant has not complied with the condition laid down in Article 5 (1) (d), it shall reduce the subsidy for the category of pigs concerned to the holding by 10%.
(7) If the Fund finds that the applicant has failed to comply with the deadline laid down in Article 6 (3), but has reported no later than 30 days after the end of the retention period, it shall reduce the subsidy for that category of pigs on the holding by 3%.
(8) The limit for determining the calculation of the reduction or non-grant for the category referred to in Article 2 (1) (a) is 15 piglets.
(9) If the Fund finds that the applicant for the selected pathogen, which is the content of the application, has not declared any eligible animal in that category of pigs in the final report, it shall not grant a vaccination grant for the selected pathogen within that category of pigs on the holding.
§ 9
Rounding
The Fund shall apply mathematical rounding to 2 decimal places when calculating the figures under this Regulation.
§ 10
Start of implementation period for 2023
For 2023, the period from 1 April 2023 shall be considered as beginning of the period of performance referred to in Article 4 (2) (d).
§ 11
Efficacy
This Regulation shall take effect on 1 April 2023.
