DECLARATION
of 6 March 2013
amending Decree No. 136 / 2004 Coll., laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended, and Decree No. 448 / 2006 Coll., implementing certain provisions of the Breeding Act, as amended by Decree No. 57 / 2011 Coll.
The Ministry of Agriculture provides pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 282 / 2003 Coll. and Act No. 130 / 2006 Coll., for implementation of Sections 22 (13), 23 (5) (a) and 23c (4) of the Breeding Act:
Amendment of the Order laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act
Decree No. 136 / 2004 Coll., laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended by Decree No. 199 / 2007 Coll., Decree No. 213 / 2009 Coll. and Decree No. 202 / 2012 Coll., are amended as follows:
1. In Article 4, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The use of electronic identifiers that contain the manufacturer's code in the structure of the code instead of the country code is possible if the European Union11b provisions are directly applicable. For electronic identifiers that contain the country code 203 for the Czech Republic, the number series assigned to the manufacturers of electronic identifiers shall be assigned by the person (4)."
2. in Article 9 (4) (c):
"(c) three times the number of females over 12 months of age on sheep and goat holdings,"
3. in Article 9 (4), the following point (d) is added:
"(d) in the case of breeding breeds of ovine and caprine animals, four times the number of females over 12 months of age, provided that the breeder confirms in the application form that he has kept breeding breeds of ovine or caprine animals."
4. Paragraph 10 (2) reads as follows:
"(2) Each calf must be permanently marked with two plastic ear tags within 20 days of birth, one in each ear, and until then the breeder must ensure that its identity can be established. However, the animal may not leave the holding on which it was born before the indication referred to in paragraph 1. ';
5. in Articles 12 (1) and (2), 15 (1), 21 (2), 24 (1) and (3), 34 (3) (g) and 42 (6), the words "European Communities" are replaced by the words "European Union."
6. In Article 15, the following paragraph 3 is added:
"(3) Electronic identifiers referred to in Article 4 (2) shall be used for the identification of horses. If the horse is identified by an electronic identifier which contains the country code 203 for the Czech Republic in the structure of the code but does not come from a number series assigned by the mandate4) or for other reasons does not comply with the directly applicable European Union11b Regulation, it shall be used as an alternative means of identifying the genetic type of the horse. '
7. Paragraph 28 (5) reads as follows:
"(5) Two or more breeders may keep animals in one stable only with the consent of the Ministry. Breeders shall notify the Ministry or supervisory authorities of their intention. The Ministry shall, on the basis of a recommendation from the supervisory authority, issue a favourable opinion to the delegate on the registration of all holdings together in a single stable. ';
8. Paragraph 32 (1) reads as follows:
"(1) The stock registers, animal registers on the holding, excluding horses, a catch and chamber book and an economic record of fish farming on the fish pond, the descriptive sheets of the fishing area and the record of the economic results achieved on the fishing area may also be kept electronically in the form of a data file approved by the authorised person. The authorised person shall only approve a computer program that allows automatic creation of data files and printing of data in a range and order consistent with the data requirements of this Decree. For the electronic keeping of the poultry register on the holding, the consent of the authorised person shall not be required. ';
9. In Paragraph 32 (2), the words "send in writing on the form and after the approval of the computer programme by the authorised person (4) 'are deleted and the word" electronically' is inserted after the word "also '.
10. In Article 32, the following paragraph 3 is added:
"(3) The documents referred to in paragraph 1, the horse registers on the holding and the reports referred to in paragraph 2 may also be kept and sent directly to the central registration information system. ';
11. in Article 34 (3), the following point 3 is added at the end of point (d):
'3. the date of designation in the event of the identification of the animal on the holding; if the identification of the animal took place within 72 hours of birth, the date of the designation need not be indicated, '.
12. in Paragraph 34 (3) (e), the words "mortality or loss" are replaced by the words "mortality, loss or domestic slaughter."
13. in Paragraph 34 (3) (f) (1), "domestic slaughter" is replaced by "animal identification."
14. in Article 35 (1), the following point (d) is inserted after point (c):
"(d) if the texture is concerned, the date of the designation; if the identification of the animal took place within 72 hours of birth and the date of birth of the animals, their mortality, loss, death and transfer is sent within 7 days of birth, the date of the designation need not be indicated, '.
Points (d) and (e) shall be renumbered as points (e) and (f).
15. in Article 35 (2) (d), the words "if they are sheep and goat breeders" shall be deleted;
16. in Paragraph 35 (3):
"(3) The report on the birth of animals, their mortality, loss, slaughter and transfer and transfer to temporary holdings shall be sent by the breeders authorised by the person (4) within 7 days of the date on which the event occurred, in bulk on the whole holding. At birth, the birth of tures, sheep or goats shall be sent within 7 days of the date of designation of the animal. ';
17. in Paragraph 36 (1), the words "and, if applicable, the date of its designation" shall be added at the end of the text in point (c).
18. in Paragraph 38 (1), the following point 6 shall be added at the end of point (e):
"6. Date of designation,"
19. in Paragraph 38 (1) (g), the word "losses" shall be replaced by "loss, domestic slaughter."
20. in Paragraph 39 (5) (f), the words "immediately binding provisions of the European Communities" shall be replaced by "directly applicable European Union rules."
footnote 18 is deleted.
21. in Paragraph 39, the following paragraph 14 is added:
"(14) In the event of the loss or domestic slaughter of the animal, the breeder shall send part B of the movement certificate of bovine animals authorised by the person (4) within 7 days of the date on which the event occurred. ';
22. in Paragraph 41 (1), the words "in the form of a computer database" shall be replaced by the words "in the central register information system."
23. in Paragraph 41 (3), the words "or, in the case of a form of a computer database in two separate files," shall be deleted.
24. in § 41 (4) and (5) of the introductory part of the provision, the words "or the set" shall be deleted.
25. in Paragraph 41, paragraph 7 is deleted;
26. Paragraph 42 (1) to (3), including footnotes 31 and 32, states:
"(1) On birth of the foal, except for the foal of the English purebred and glider, its owner shall, within 21 days of the date of birth, send the third admission note to the person carrying out the identification of the horses, who shall record the registration data, including the word and graphic description, to the fourth admission note and confirm their validity by his signature. The owner of the horse shall complete the further prescribed information in the fourth admission note and send it to the authorised person.
(2) After the birth of the stallion, the owner shall, within 21 days of the date of birth, send the third admission note to a recognised breeding association which shall keep the stallion's herd book and transmit the stallion identification card to the owner. The owner shall ensure that the foal identification card is recorded in the word and graphic description of the foal, which shall be signed and stamped by the veterinarian, and shall send it back to a recognised breeding association which shall ensure the registration of the genetic type.
(3) After the birth of the foal of the English purebred, its owner shall, within 21 days of the date of birth, send a fourth entry note to a recognised breeding association which shall keep a herd book of the English purebred and transmit to the owner an identification card to the foal. The owner ensures that the foal identification card records the verb and graphic description of the foal, which is confirmed by the veterinarian's signature and stamp. The completed identification card shall be sent by the owner to the person authorised to verify the origin of the foal, together with the samples taken, in accordance with Section 12 of the Act. The person authorised to verify the origin of the horses shall enter the laboratory number of the test32 in the identification card) by which the genetic type of the foal has been established, and the foal identification card shall be sent by the authorised person (4).

27. in Paragraph 42, paragraph 4 is deleted;
Paragraphs 5 to 7 shall be renumbered paragraphs 4 to 6.
28. In Article 42 (6), the words "horse pass up to 14 'are replaced by the words" horse pass copy up to 28'.
29. Paragraph 44, including the title, reads:
Registration of a horse moved from another Member State or imported from a third country
(1) In the case of a horse moved from another Member State or a horse imported from a third country, with the exception of the dispatch of animals (hereinafter referred to as the "permanently imported horse '), the owner of the horse authorised by the person (4) shall send a report on the permanent importation of the horse (hereinafter referred to as" the report') within 30 days of the movement or within 30 days of the completion of the border veterinary inspection.
(2) If the horse is permanently imported with a horse identification issued in accordance with the provisions directly applicable to the European Union, the owner of the horse shall send a report together with a copy of the horse identification (4). If the horse is accompanied by a certificate of origin, the owner of the horse shall send a copy of the horse together with the report. The authorised person (4) shall register the horse and shall send the horse's identification card back to the owner within 7 days of its delivery.
(3) If the horse is not permanently imported from a third country with a horse passport issued in accordance with the provisions directly applicable to the European Union, the owner of the horse authorised by the person (4) shall send a report completed by the horse labeling person on the basis of which he / she shall issue a horse card (4). If the horse is accompanied by a certificate of origin, the owner of the horse shall send a copy of the horse together with the report.
(4) Where a permanently imported horse remains in the possession of a foreign owner, the documents referred to in paragraphs 1 to 3 shall be sent by the breeder with whom the horse is kept.
(5) The model of the permanent import report for a horse is set out in Annex 8. '
30. in Article 45 (2) (b), the words "the year for which" shall be replaced by the words "the years for which."

Horse ID
"(1) The horse passport (33) shall be issued by the authorised person (34) within 28 days of the date of service of the fourth admission ticket (31) or from the date of service of the registered horse or from the date of service of the report of the permanent importation of the horse.
(2) In the case of breeding horses born in the Czech Republic and registered in a herd book abroad, which has not been issued by the issuing authority abroad, the horse passport shall be issued by the mandated person (4) on the basis of the registration report of the horse pursuant to § 42 born in the Czech Republic. If a horse was born from imported pregnant mare, the mandated person (4) will issue a horse pass on the basis of a registration report of a horse born in the Czech Republic filled out by the person carrying out the horse marking and a copy of the horse registration document in a foreign herd book.
(3) If the owner of the horse changes, the original owner of the horse will hand over the identification of the horse along with the horse to the new owner. When moving a horse to a slaughterhouse, the original owner shall, together with the horse, hand over the identification of the horse to the slaughterhouse operator, who shall send it to the authorised person within 5 working days of the slaughter.
(4) On transfer to a third country of an English clover or glider to another Member State, or export to a third country of an English clover or glider, the original owner shall send the horse card to the person in charge together with the notification of the change, at least 14 days before the movement or export of the horse.
(5) The owner of the horse shall ensure that preventive tests, testing or castration, as confirmed by the veterinarian, are recorded on the sides of the horse's licence for that purpose. Any change in the owner of the horse in the horse's licence shall be confirmed by the new owner of the horse by the recognised breeding association, which shall keep the relevant breeding book and, where appropriate, by the authorised person (4), which shall be returned without delay to the owner.
(6) If the horse is lost and the horse cannot be identified, the owner shall request a replacement identification document (4).

33. in Article 60 (4) (b), the words "loss or culling" shall be replaced by "loss, killing or domestic slaughter."

35. in Article 64a (1), the words "poultry, with the exception of holdings referred to in Article 64 (1)," shall be replaced by the words "poultry for breeding or fattening outside chickens reared for meat."
36. in Article 65 at the end of the text of point (b) and in Article 71 at the end of the text of point (a), the word "hatchery" shall be added.
37. in Article 66a (1), the words "with the exception of the breeders referred to in Article 66 (1)" shall be replaced by the words "for fattening including chickens reared for meat or with a flock of more than 500 poultry reared for rearing."
38. in Paragraph 82 (e), the words "name and code of the cadastral territory" shall be replaced by the words "code number of the cadastral territory, parcel number, type of parcel."
39. Paragraph 97 (4) is deleted.
40. Paragraph 99 (3) is deleted.

Transitional provisions
1. The electronic management of the equine register on the holding referred to in Article 41 may be used until 31 December 2013.
2. The current herd register forms for turnips, sheep and goats may be used if the animals are marked within 72 hours of birth or if the date of designation is recorded in the form on the spot reserved for the endorsement.
3. The notification of the birth of animals, their mortality, loss and transfer for bovine animals may be used for the notification of the birth of the calf, provided that they are marked within 72 hours of birth and the notification is sent within 7 days of birth.
Amendment of the Decree implementing certain provisions of the Breeding Act
In Annex No 8 in the last row of Table 18 and in Annex No 10, Part B, point 2 of Decree No 448 / 2006 Coll., on the implementation of certain provisions of the Breeding Act, as amended by Decree No 57 / 2011 Coll., the number "14 'is replaced by" 21'.
EFFECTIVE
This Decree shall take effect on 1 April 2013.
