of 28 January 1992
on youth homes
The Ministry of Education, Youth and Sports of the Czech Republic provides pursuant to § 24 paragraph 3 of Act No. 29 / 1984 Coll., on the System of Primary and Secondary Schools (Education Act), as amended by the Act of the Czech National Council No. 171 / 1990 Coll., § 13 paragraph (a) and (f) of the Act of the Czech National Council No. 564 / 1990 Coll., on State Administration and Self-Government in Education, and § 45 paragraph 2 of the Act of the Czech National Council No. 76 / 1978 Coll., on Education Equipment, as amended by the Act of the Czech National Council No. 31 / 1984 Coll.
HOME ORGANISATION
§ 1
(1) Youth homes (hereinafter referred to as "home") 1 shall be broken down into accommodation units to determine the amount of payment. Accommodation units means rooms which are classified according to equipment
(a) category I, if they have central heating, bathroom or shower with hot water and no more than 3 beds;
(b) to Category II, unless they meet one of the aspects referred to in (a).
(2) The home must be equipped with a room designed to separate the location of the student from the other pupils in the event of his sudden illness.
§ 2
(1) The primary organisational unit of the educational activity in the home is the educational group, which covers the number of:
(a) 24 students; or
(b) 15 non-resident pupils; or
(c) equal to the number of pupils in the special school class, 3) for pupils in special schools.
(2) If the composition of the pupils is possible, they shall be included in educational groups separately by sex, schools, years and age.
(3) Exemptions from the maximum number of pupils in the education group provided for in paragraph 1 (a) and (b) shall be determined by the head of home or by the head of the secondary school of which it is part.
§ 3
DIRECTOR
(1) The home manager established as a legal person (hereinafter referred to as "home manager") shall appoint and withdraw his representative. The head of a secondary school, a special secondary school, a teaching centre or a vocational training centre, the home of which is (hereinafter referred to as "the principal of a secondary school '), shall appoint and dismiss the leading educator.
(2) The Director of Home or the Director of the Central School shall issue the Home Code and the Home Day Scheme; with the internal rules of home and the regime of the day of home, the pupils shall be informed when they enter home.
§ 4
ADVISORY AUTHORITIES
The head of the home may set up a teaching board as his advisory body. Its members are pedagogical workers of the home. The pedagogical staff of a home which is part of a secondary school shall be members of the pedagogical board of a secondary school or other similar advisory body. If the pedagogical council or similar advisory body is not established, the principal of the secondary school shall establish a pedagogical council of the home.
§ 5
_
(1) The head of the home or the head of the secondary school shall, according to the capacity of the pupils, be placed in the home in the following order:
(a) from children's homes;
(b) on social or health grounds;
(c) whose parents have long worked abroad;
(d) gifted and talented,
(e) foreign nationality whose parents live permanently outside the territory of the Czech and Slovak Federal Republic (hereinafter referred to as "foreign nationality"),
(f) other commuters, depending on the distance between the place of permanent residence and the school, the time needed to commute and the difficulty of transport connections.
(2) Application to home is submitted by the legal representatives of the pupil (4) or by the pupil, provided that he is of age or foreign nationality to the head of the home or to the director of the secondary school within the time limit set by him.
(3) The head of the home or the head of the secondary school shall inform the legal representative of the pupil or pupil, if he is of an age or foreign nationality, within 15 days of the date set for filing the application. Placing at home is valid for student accommodation in the home for the immediately following school year.
(4) In the course of the year, the Director of Home or the Director of Secondary School shall terminate the student's placement in the home if:
(a) in writing, the legal representative of the pupil or pupil shall request this if he is of an age or a foreign nationality;
(b) the legal representative or pupil does not pay a contribution to cover the costs of accommodation for a period of two months, except for serious reasons which may temporarily impede the contribution (e.g. the death of the student's parents);
(c) the pupil stopped being a secondary school pupil,
(d) the pupil has been permitted to discontinue his studies;
(e) the pupil has completed accommodation in a home for home violations pursuant to § 11 (3) (d).
§ 6
HOUSE OPERATING
(1) The head of home or the head of a secondary school may, under operational conditions, interrupt the operation of the home on the days on which it is not taught and during the school holidays; in particular justified cases, they shall ensure that pupils who cannot leave their home have alternative accommodation and meals.
(2) If there are more than one home, the home provider shall, at the time of the interruption of its operation, ensure, in agreement with the directors of the pupils who are unable to leave the home, accommodation and meals in the home which they designate. This accommodation and catering can be provided in one home for a maximum period of one month during the main holidays.
(3) The amount by which the cost of accommodation and meals secured pursuant to paragraph 1 or 2 is increased shall be borne by the founder.
(4) In homes in which the pupils referred to in § 5 (1) (b), (c) and (e) are staying, the operation is not interrupted.
§ 7
REPEAL OF HOME
Home can be cancelled as of 31 August of the current year if:
(a) the number of students under 24 will fall;
(b) the organiser shall provide alternative accommodation for resident pupils;
(c) at least 24 pupils have not applied for accommodation for the following year.
§ 8
HUMAN SECURITY
Home provides accommodation and catering for the students.
ESTABLISHMENT AND STABILITY OF THE REQUESTS OF THE MULTIPLE TRAINING SCHOOL, SPECIFIC MULTIAL TRAINING SCHOOL, GYMNASSIA AND SPECIFIC GYMNESSES
§ 9
(1) Students of secondary vocational schools, special secondary vocational schools, gymnastics and special gymnastics (hereinafter referred to as "secondary vocational school and gymnasium") are granted accommodation in room I. category for 300 to 1,200 CZK per month and in room II. category for 300 to 800 CZK per month.
(2) On a case-by-case basis, the Director of Homestay (5) or the Director of Secondary School5) shall decide on the amount of the monthly reimbursement for accommodation in a home, taking into account the room category, the level of services provided and the social situation of the student in the accommodation.
(3) The amount of the monthly reimbursement for accommodation in the home does not change even if the pupil is not accommodated for all days of the month. If the student is in the home only part of the month due to the organisation of the teaching, the amount of payment for accommodation shall be determined in proportion to the number of days during which he is staying.
(4) The difference between the payment referred to in paragraph 2 and the actual value of the accommodation in the home shall be borne by the founder.
(5) The provision of catering for pupils of secondary vocational schools and colleges is laid down in a specific Regulation (6).
§ 10
(1) Reimbursement for accommodation and meals shall be paid by legal representatives of pupils or pupils, if they are of an age or foreign nationality.
(2) Teachers staying in a home eat there all day. Exemptions from meals in agreement with the legal representative of the pupil or pupil, if he is of an age or foreign nationality, shall be authorised by the home director or the head of the secondary school. If the distance of home from the secondary school were to disturb the continuous attendance of pupils between the morning and afternoon classes, the secondary school to which the pupil goes will provide midday meals for pupils. Where a home dining room serves pupils of several schools, the teachers of those schools shall also supervise the school in the dining room in agreement with the home manager or the head of the secondary school.
§ 11
OBLIGATIONS TO BE FULFILLED AND SUPPORT MEASURES
(1) The student is obliged to comply with the provisions of the home rules and follow the instructions of the home workers.
(2) For good behaviour, for good performance of duties, for brave action or for exceptional merit in favour of the collective, the pupil may be awarded praise or other award. The degree of praise shall be determined by the head of the home or the head of the secondary school in the internal order of the home.
(3) Where a pupil is in violation of the rules of his or her home, one of the following educational measures shall be granted according to the seriousness of the offence:
(a) a warning given by the educator,
(b) reprimand granted by the Director;
(c) conditional termination of accommodation in a home with a trial period;
d) termination of accommodation in the home.
(4) The home accommodation shall be terminated by the home manager or by the secondary school director, on a proposal from the educator, after consultation with the teaching board and the pupil's self-administration. When the accommodation is suspended, the Director of the Home or the Director of the Secondary School shall determine a trial period of between one and five months. The student to whom the accommodation has been completed may be left at home by the head of the home or by the head of the secondary school for the period necessary to ensure the replacement accommodation, but no more than one month from the date specified for the termination of the accommodation in the home. Replacement accommodation is provided to the pupil by legal representatives or by the pupil if he is of an age or foreign nationality. If a student commits himself or her in the time strictly necessary to provide for replacement accommodation of another disciplinary offence, he or she shall terminate his or her residence immediately.
(5) The educational measures referred to in paragraph 3 (b) to (d) shall be notified in writing to the legal representative of the pupil, the organisation for which the pupil is preparing, to another legal person or to the natural person at whose cost the pupil is preparing and, where appropriate, to the school.
§ 12
HOUSE WORKERS
(1) Educational and organisational activities in the home are provided by the Director, the Deputy Director or the lead educator, educators and assistant educators.
(2) Auxiliary educators perform night duty. Their number shall be determined by the head of the home or the head of the secondary school, taking into account the number of buildings, their location, the number of pupils, the principles of safety and economy. In the event that the night service is not provided by auxiliary educators, they shall perform night duty and supervision outside the working hours from 22.00 to 6.00.
(3) Technical and operational personnel are responsible for the economic, administrative and operational tasks of the home.
(4) The head of the home or the head of the secondary school shall determine the number of teaching staff and other staff of the home; In determining the number of staff, it shall take into account the specificities of operating conditions, in particular when the home is operated on Saturdays and Sundays, when it is located in more than one building, or when secondary school pupils with exchange instruction are housed in the home.
FINAL AND REPEAL PROVISIONS
§ 13
Special regulations apply to the accommodation and catering of pupils of secondary vocational schools, special secondary vocational schools, vocational schools and homeschools. 7)
§ 14
The Decree of the Ministry of Education, Youth and Sports of the Czech Republic No. 59 / 1989 Coll., on youth homes administered by the Regional National Committees is hereby repealed.
§ 15
EFFECTIVE
This decree shall take effect on the day of its publication.
