on compensation to judges who perform their duties in addition to their employment
In agreement with the Central Council of Trade Unions, Ministry of Finance and other participating ministries pursuant to § 60 paragraphs 2 and 3 of Act No. 62 / 1961 Coll., on the organisation of courts:
§ 1
The compensation for the loss of wages paid by undertakings to judges who are employed by them shall include any gross benefits which they have missed by carrying out their duties as judges, including overtime and for higher or exceptional work. The experience shall be calculated on average over the last three months.
§ 2
At their request, judges who are not in employment, such as members of single agricultural cooperatives, or who are domestic workers, shall provide adequate compensation for the net earnings lost by the State to them by exercising their judicial function (administration of courts). The refund shall be granted at the established amount.
§ 3
(1) The Judges shall be entitled to reimbursement of the necessary expenses incurred by them in carrying out their judicial duties, in particular the reimbursement of travel expenses, subsistence, accommodation and, where appropriate, other compensation provided under the rules on travel, removal and other expenses. The provisions governing the granting of such compensation to civil servants shall apply mutatis mutandis when assessing the entitlement to reimbursement of such expenses and determining the amount of the refund. *)
(2) In addition, judges may be granted compensation for other necessary expenditure (increased editions) if they can reasonably prove their amount.
(3) The State (administration of courts) provides compensation for the necessary expenditure (increased editions).
§ 4
Compensation for loss of wages (loss of earnings) shall be included in the assessment basis for sickness insurance benefits in accordance with the principles laid down for its calculation and in the average annual earnings applicable to the calculation of pension benefits.
§ 6
The performance of a judicial function shall mean not only the participation of a judge in a court sitting, but also the exercise of other duties associated with that function, such as participation in training, etc.
§ 7
The right to compensation for lost earnings granted by the State shall be exercised within 15 days of the performance of the judicial function. The jurisdiction of the administration of the courts in charge shall decide on the claim.
§ 8
This decree shall take effect on the day of its publication.
