Decree amending Decree No. 375 / 2003 Coll., implementing certain provisions of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended, and on veterinary requirements for animal products

amending Decree No. 375 / 2003 Coll., implementing certain provisions of Act No. 166 / 1999 Coll., on Veterinary Care and amending certain related laws (Veterinary Act), as amended, and on animal health requirements for animal products
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll. and Act No. 316 / 2004 Coll., ("the Act ') for the implementation of Sections 18 (5), 21 (7) (a) and 22 (2) (b) of the Act:
Čl. I
Decree No. 375 / 2003 Coll., implementing certain provisions of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended, and on veterinary requirements for animal products, are amended as follows:
1. in Article 3 (2) (b):
"(b) edible after special treatment or further processing (hereinafter referred to as" edible after treatment "), unless they meet one of the requirements referred to in paragraph 1 (a) and (b), the health reasons or changes in sensory properties do not give rise to them being unedible;"
2. In Article 3 (2) (c), the words "and in the territory of the capital city of Prague of the Municipal Veterinary Administration in Prague (the Regional Veterinary Administration) 'shall be inserted after the words" Regional Veterinary Administration'.
3. Paragraph 3 (3) reads as follows:
"(3) Foodstuffs of animal origin referred to in paragraph 2 (b) shall be treated by:
(a) heat-treated products by a process which ensures that in all parts an effect corresponding to a temperature of at least 70 ° C is achieved for at least 10 minutes;
(b) a can which ensures that the effect of a temperature of at least 121 ° C is achieved for at least 10 minutes. "
4. In Article 3, the following paragraph 4 is added:
"(4) The Regional Veterinary Administration may decide pursuant to Article 49 (1) (m) of the Act on a procedure other than that referred to in paragraph 3 which guarantees the health of the final product. '
5. in Paragraph 4 (2) (b), including footnote 4a:
"(b) animal products which have been taken over at the time of acceptance of the goods and show a manufacturing (technological) defect, sensory undetectable at the time of acceptance of the goods without infringing the integrity of the product, provided that they have been kept until their return under the animal health conditions laid down for animal products of that kind. Such products may only be taken back by the manufacturing undertaking (supplier) provided that their proper entry back is ensured and that the traceability of these products is maintained; their further use or disposal shall be decided by the official veterinarian.
"(4a) Article 3 of Regulation (EC) No 178 / 2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety."
6. Article 21 shall be deleted, including the title.
7. Paragraph 29 (2) is deleted.
Paragraph 3 shall become paragraph 2.
8. In Paragraph 40, paragraphs 2 to 5 are deleted.
Paragraph 6 shall become paragraph 2.
9. in Paragraph 43 (2) (d), "higher than minus 0,515 ° C" is replaced by "higher than minus 0,520 ° C";
10. Head title In the Annex to Implementing Regulation (EU) No 540 / 2011, the following entry is added:
11. in Article 53 (2), the words "to the same product" shall be replaced by the words "to the same product."
12. A common heading is inserted above Article 54: "Labelling of meat and organs of animals for slaughter '.
13. in Paragraph 54 (b) (1) and (2) read:
"1. the production shall be marked with a stamp of a circular shape of 4 cm in diameter, covered by two parallel lines which cross this circle horizontally, at least 1 cm apart and placed so that the text in the stamp remains legible;
2. intended for cans, they shall be marked by means of a stamp of a circular shape of 4 cm in diameter, with two straight lines crossing at a right angle and lying on that stamp so that their intersection is in the middle and the data can be read, '.
14. in Paragraph 55 (4):
"(4) The marking of meat and organs of animals for slaughter, assessed as inedible, shall be carried out on parts of meat and organs by dyeing, whole bodies, halves and quarters by deep cuts into the tissues and the stamp shall be on all parts of the meat and organs of the animals for slaughter. ';
15. A common heading is inserted above Article 57: "Labelling of raw materials and foodstuffs of animal origin originating in undertakings with a fixed transitional period which have been assessed as edible '.
16. In Paragraph 57, the title is deleted.
17. in Paragraph 57 (1) (a), the words "of a regular hexagon shape of 23 mm on the sides, 12 mm on the poultry and rabbits" shall be replaced by "of a square shape of 4 cm on the side, 2 cm on the side."
18. in Paragraph 57 (1) (b) (1) and (2):
"1. the production shall be marked by means of a square-shaped stamp of a side length of 4 cm with two parallel lines which cross this square horizontally and are at least 1 cm apart and placed so that the text in the stamp remains legible;
2. intended for cans shall be marked with a square-shaped stamp of a side length of 4 cm, in the case of poultry and rabbits of a side length of 2 cm, with two straight lines crossing at right angles and lying diagonally on the stamp so that their intersection is in the middle and the data can be read. ';
19. in Paragraph 57 (2), the words "regular hexagon" are replaced by the words "squares of a length of 4 cm."
20. In Paragraph 57 (3), the words "regular hexagon shape 'are replaced by the words" square shape' and the words "place of processing (territorial administrative unit) 'are replaced by the words" FOR THE CR'.
21. A common heading is inserted above Paragraph 58: "Labelling of animal products intended for animal feed '.
22. Paragraph 58, including footnote 10a, reads:
„§ 58
(1) Animal products which have been assessed and intended to be fed to animals 10a) shall be marked with a stamp of a rectangular shape of 4 cm x 10 cm, in the case of poultry and rabbits 2 cm x 5 cm, the upper part of which shall bear the name CZ and the veterinary approval number and the space code of the administrative unit. The height of these letters and figures shall be 1 cm, in the case of poultry and rabbits 0,6 cm. In the lower part, the word "FAMILY 'with a letter size of 1,5 cm, in the case of poultry and rabbits of 0,6 cm.
(2) The labelling of the animal products referred to in paragraph 1, intended for approved and registered feed manufacturers, shall be carried out on each package of meat and organs with a label bearing the stamp referred to in paragraph 1; for whole bodies, halves and quarters, deep cuts into the tissues, the stamp must be on all parts of the meat and organs of the slaughter animals.
(10a) Article 6 (1) (a) to (j) of Regulation (EC) No 1774 / 2002 of the European Parliament and of the Council of 3 October 2002 laying down health rules concerning animal by-products not intended for human consumption. '
23. A common heading is inserted above Article 59: "Labelling of raw materials and foodstuffs of animal origin '.
24th Paragraph 59 (1) reads as follows:
"(1) The stamp of the circle shall bear:
(a) in the upper line, the abbreviation "CZ," in the middle line, the veterinary approval number of the holding and in the lower line, the place of processing (territorial administrative unit); or
(b) in the upper line, the abbreviation "CZ" and the veterinary approval number of the holding and in the lower line, the place of processing (the administrative unit). ";
25. In Paragraph 59, the following paragraph 2 is inserted after paragraph 1:
"(2) The height of letters and figures shall be at least 0,8 cm and, if the poultry or rabbits are slaughtered, at least 0,2 cm. ';
Paragraphs 2 to 4 shall become paragraphs 3 to 5.
26. A common heading is inserted above Paragraph 62, which reads: "Domestic defeats'.
27. in Article 62, the title shall be deleted;
28. In Article 65 (1), the words ", edible for feeding pet animals' shall be inserted after the words" (production or intended for preservation) '.
29. in Article 69 (a), the words', edible for feeding pet animals' shall be inserted after the words' (production or intended for preservation) ';
30. The following Section 73a is inserted after Section 73:
„§ 73a
The labelling of food of animal origin on consumer packaging may be reduced proportionally, but only in such a way that the data are always legible. '

Efficacy
This Decree shall take effect on 1 January 2005.
