DECLARATION
of 6 December 2004
amending Decree No 200 / 2003 Coll., on animal health requirements for egg products, and Decree No 203 / 2003 Coll., on animal health requirements for milk and milk products
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll. and Act No. 316 / 2004 Coll., ("the Act ') for the implementation of Sections 20 (8), 21 (7), 22 (2) and 24 (2) of the Act:
Amendment of the Decree on animal health requirements for milk and milk products
Decree No 203 / 2003 Coll., on veterinary requirements for milk and milk products, is amended as follows:
1. In footnote 1, at the end, the words "Council Directive 2002 / 99 / EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption 'shall be added.
2. In Section 1, paragraph 3 is added, including footnotes 1a and 1b:
"(3) This decree is without prejudice to the provisions of European Communityregulations (1a) or specific legislation1b).
(1a) Council Regulation (EC) No 1255 / 1999 of 17 May 1999 on the common organisation of the market in milk and milk products, as amended. Council Regulation (EEC) No 1898 / 87 of 2 July 1987 on the protection of designations used in the marketing of milk and milk products, as amended.
1b) Decree No. 77 / 2003 Coll., laying down requirements for milk and milk products, frozen creams and edible fats and oils, as amended by Decree No. 124 / 2004 Coll. '
3. In Article 3, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) Undertakings approved for the treatment of milk and approved processing undertakings shall be checked, on the one hand, by the operator and, on the other hand, officially in the framework of the exercise of national veterinary supervision in accordance with Sections 13 and 14 and Part VI of Annex 3 to this Regulation. ';
4. The following Section 3a is inserted after Section 3, including footnotes 1c and 1d:
(1) Raw milk, including raw milk intended for the manufacture of drinking heat-treated milk and milk products, must be obtained from animals which:
(a) satisfy the animal health requirements for animals of the species concerned laid down by law and by specific legislation1c);
(b) they do not come from a production farm, assembly centre, standardization centre, a milk treatment undertaking, a processing undertaking, a territory or part of a territory which is subject to restrictive or prohibited veterinary measures, adopted in the light of the occurrence of foot-and-mouth disease, classical swine fever, swine vesicular disease, African swine fever, rinderpest, Newcastle disease, avian influenza or small ruminants in accordance with the rules laid down by law and specific legislation1d) and relating to the animals and their products.
(2) The Regional Veterinary Administration may, in accordance with Article 49 (1) (g) of the Act and subject to the disease control measures referred to in paragraph 1 (a). (b) authorise the production, processing and putting into circulation of raw milk, consumed heat-treated milk and milk products originating in the territory or part of the territory which is subject to restrictions or prohibiting veterinary measures referred to in paragraph 1 (b) but not from a production holding in which the presence of one of the diseases referred to in paragraph 1 (b) has been confirmed. (b) or suspected of such a disease, provided that:
(a) are subject to the treatment provided for in Annex 4 to this Decree in an undertaking approved for that purpose;
(b) are clearly marked;
(c) have been obtained, processed, stored and transported in a space or in time separate from animal products complying with all animal health requirements and the Regional Veterinary Administration has approved the conditions for their transport from the territory or part of the territory subject to restrictions or prohibiting veterinary measures.
1c) For example, Decree No. 296 / 2003 Coll., on animal health and protection, on the movement and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, Decree No. 382 / 2003 Coll., on animal health requirements for trade in animals and on animal health conditions for their importation from third countries.
1d) For example, Decree No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, Decree No 202 / 2004 Coll., on measures to prevent and control African swine fever, Decree No 389 / 2004 Coll., on measures to control and prevent foot-and-mouth disease and amending Decree No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to man, as amended by Decree No 356 / 2004 Coll. '
5. in Article 5, the words "for human consumption 'are replaced by the words" for direct human consumption';
6. in Paragraph 6 (3) (a), "not more than -0,515 ° C" is replaced by "not more than -0,520 ° C" and "more than -0,515 ° C";
7. in Article 10 (2) (a), the words "dispatched to Member States," shall be replaced by the words "subject to trade with Member States,"
8. In Paragraph 10 (2) (b), the words "dispatched to Member States," are replaced by the words "subject to trade with Member States,"
9. Paragraph 10 (7) is deleted.
10. In Paragraph 12 (2), after the word "milking ', the dot is replaced by a comma and the words" set out in Annex No 1, Part II and III to this Decree' are added.
11. in Article 13 (1) (a), a comma shall be inserted after the word "procedures" and the words "to notify the authorities carrying out veterinary surveillance."
12. in Paragraph 14 (1) (a), the following point 3 is added:
'3. carry out random checks on compliance with the requirements of Sections 13 (2) and (3); ';
13. Paragraph 16 (2), including footnote 7, reads as follows:
"(2) For health labelling in enterprises, establishments or other establishments referred to in Article 10 (1) and (2), a circle marking shall be used in accordance with the specific legislation (7).
7) Article 59 of Decree No. 375 / 2003 Coll., implementing certain provisions of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended, and on animal health requirements for animal products. '
14. in Annex 1, Part I, point 1 (a), first indent, the words "legislation governing animal health conditions of trade in animals" shall be replaced by the words "Annex 23 to Decree No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans."
15. in Annex 1 (I) (1) (b):
"(b) from ovine and caprine animals belonging to an officially brucellosis-free or brucellosis-free (Brucella melitensis) holding as referred to in Annex 24 to Regulation No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, with the exception of milk intended for the production of cheese aged at least 2 months."
16. In Annex 1, Part In point 3, the words "with measures adopted by the European Commission (" the Commission ')' shall be replaced by the words "with a decision of the European Commission (" the Commission ').';
17. in Annex No 1, Part I, point 4, at the end of point (a), the words "laid down by Decree No 291 / 2003 Coll., on the prohibition of the administration of certain substances to animals whose products are intended for human consumption and on the monitoring (monitoring) of the presence of unauthorised substances, residues and contaminants for which animal products could be harmful to human health, animals and their products," shall be added.
18. In Annex No 1, Part IV, Section and the table in point 1 is replaced by "Commission ';
19. In Annex No 2, Part II, Section In point 4, the words "(Decree No. 252 / 2004 Coll., laying down the hygiene requirements for drinking and hot water and the frequency and scope of control of drinking water) 'are inserted after the words" water'.
20. In Annex 3, Part II, Section In the case of Salmonella spp. the words "Absence in 1 g (c) 'are replaced by the words" Absence in 25 g (c)' in both cases.
21. In Annex 3, Part V, point 8:
'8. Additional conditions for the storage and transport of certain milk products may be laid down by the Commission. '
22. The following Annex 4 is inserted after Annex 3:
