GOVERNMENT REGULATION
of 13 January 2003
on the method and extent of security of the system of exchange of information on best available techniques
The Government mandates pursuant to § 47 (1) of Act No. 76 / 2002 Coll., on integrated pollution prevention and control, on an integrated pollution register and on amending certain laws (the Act on Integrated Prevention) ("the Act ') for the implementation of Article 27 (3) of the Act:
Security of the best available techniques information system
(1) The Ministry of Industry and Trade shall, in cooperation with the Ministry of the Environment, the Ministry of Agriculture, the Czech Environmental Inspection ("Inspection"), the county and the contributory organisation providing professional support for the performance of the state administration in the field of integrated prevention under Section 5 of the Act ("Agency"), provide for an exchange of information on best available techniques, the outputs of which are part of an information system accessible through the public administration portal (1).
(2) The Ministry of Industry and Trade establishes a meeting of experts called the Forum for the Exchange of Information on Best Available Techniques, to which they appoint representatives of the Ministry of Industry and Trade, the Ministry of the Environment, the Ministry of Agriculture, Inspection, Region and Agency, in order to ensure the exchange of information on the development of best available techniques and to prepare a uniform procedure in the negotiations in the relevant European institutions, in particular the European Forum for the Exchange of Information on Best Available Techniques convened by the European Commission (hereinafter the "European Forum") and the European Technical Working Groups for the preparation of European Communities documents on best Available Techniques (hereinafter the ").
(3) The ministries referred to in paragraph 1 set up technical working groups in their field of competence, as provided for by law.
Scope of the best available techniques information exchange system
(1) The Forum for the Exchange of Information on Best Available Techniques pursuant to Paragraph 1 (2) shall carry out the following tasks:
(a) unify the procedure for the exchange of information on best available techniques at European Community level, in particular in the European Forum and European Technical Working Groups;
(b) monitor and evaluate the activities of the technical working groups;
(c) discuss expert comments and interpretations on the best available techniques documents of the European Communities;
(d) monitor translations of European Communities' documents on best available techniques;
(e) on the basis of monitoring the development of best available techniques, issue recommendations for their application in the integrated prevention process.
(2) The technical working groups referred to in Article 1 (3) ensure the preparation of supporting documents for the relevant European Technical Working Group, monitor the development of the best available techniques in the relevant area in the Czech Republic and at the level of the European Communities or international organisations, prepare translation and technical corrections of the relevant European Communities document on best available techniques, propose its technical interpretation, comment and provide information on the development of the best available techniques. The Technical Working Groups shall authorise translations of the European Communities' reference documents on best available techniques, in particular by assessing their level of expertise and clarity.
The Ministry of Industry and Trade, the Ministry of Agriculture, the Ministry of the Environment, Regions, Inspection and the Agency shall publish on the Central Portal the results of the evaluation of the application of the best available techniques in their field of application, as provided for by law, and shall transmit this information to the Ministry of Environment in paper form no later than 15 April of the current year for the previous calendar year. The Ministry of Environment will use the documents for the cumulative processing of the results and their transmission according to § 29 (h) of the Act. The first results of the evaluation of the application of the best available techniques will be transmitted for 2003 by 15 April 2004.
Efficacy
This Regulation shall enter into force on the day of its publication.
