of 23 December 1991
on the Trade Bulletin
The Government of the Czech and Slovak Federal Republic orders pursuant to § 770 of Act No. 513 / 1991 Coll., Commercial Code, and pursuant to § 79 of Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation, as amended:
§ 1
The publication of the Commercial Journal ("the Bulletin ') is ensured by the Federal Competition Authority (" the Office') through the publishing house.
§ 2
(1) The Bulletin publishes information in cases where publication is provided for in the Commercial Code.
(2) The following shall be published in the Bulletin from the data entered in the Commercial Register under Article 28 (1) and (2) of the Commercial Code:
(a) the particulars referred to in § 28 (1) (a) to (d), (f) to (h) of the Commercial Code and the names and addresses of persons authorised to act as entrepreneurs;
(b) from the information referred to in § 28 (2) of the Commercial Code for the company and the cooperative, the amount of the capital, the number, type and nominal value of the shares, the company of the company of the founder and of the joint stock,
(c) the date of entry of the data referred to in points (a) and (b), as well as the amendment and termination of the recorded facts which have been published.
(3) The Bulletin is also published in accordance with Act No. 328 / 1991 Coll., on bankruptcy and settlement, an extract from the court order on the declaration of bankruptcy and on the authorisation of the settlement.
(4) Other notices and particulars shall also be published in the Bulletin, except in the cases referred to in paragraphs 1 to 3, where that obligation is provided for in law 1)
§ 3
(1) Data may be published in the Bulletin in cases where the law provides for the obligation to publish them but does not specify the manner of publication.
(2) The following may also be published in the Bulletin:
(a) judgments in commercial matters where the court has recognised the right of publication in the judgment,
(b) the notification or decision of the public authorities concerning entrepreneurs.
§ 4
(1) The original or officially certified copies of the data, notifications or decisions to be published or published shall be the basis for publication or publication in the Bulletin.
(2) The publication or publication price must be paid by the publisher in the cases referred to in Article 2 by the person concerned by the published information, in other cases by the person who requested the publication or by the judgment to whom the price has been paid.
§ 5
(1) Data intended for publication in the Bulletin shall be sent directly to the publisher in the cases referred to in Section 2; other proposals for publication or publication shall be submitted to the Office, which shall verify that such data can be published in the Bulletin.
(2) The petitioner shall be responsible for the accuracy of the documents for publication or publication. The publishing house shall be responsible for the compliance of the content of the published or published data with the material provided. Printer errors are corrected by editorial announcements to the publisher's cargo.
§ 6
This Regulation shall enter into force on the day of its publication.
