on granting temporary accommodation in private with the agreement of the National Committee
The Government of the Czech Socialist Republic orders according to § 397 (4) of the Civil Code:
The citizen may repeatedly leave the property (e.g. family house, holiday cottage, land) or part thereof (e.g. apartment, room) to another for temporary use for compensation for tourist accommodation (hereinafter referred to as "temporary private accommodation ') only with the approval of the local national committee, 1) in whose district the property is situated (2) (hereinafter referred to as" national committee').
A citizen may provide temporary private accommodation in the cases referred to in § 1 only through an organisation legally operating a travel agency service, 3) with which he has concluded a contract (hereinafter referred to as the "entrusted organisation ').
(1) In the request for consent, the citizen shall indicate:
(a) his name, last name, place of residence, ID card number;
(b) the indication of the area where the temporary accommodation will be provided in private, its description, location and equipment;
(c) the period for which the consent is to be given.
(2) The request shall be accompanied by the consent of the owner (co-owners) or the property manager and, as a general rule, by the comments of the entrusted organisation.
(3) The citizen shall be obliged to provide any additional information requested by the National Committee.
The national committee in its decision granting its consent,
(a) include an area where temporary accommodation will be provided in private, according to the equipment in the group concerned, (4) on this basis the price of accommodation will be determined according to price regulations;
(b) determine the period for which the consent is given;
(c) determine with which organisation a citizen will conclude a contract adjusting the conditions under which a citizen will provide temporary accommodation in private.
The citizen is obliged to provide temporary accommodation in private in accordance with the decision granting his consent, with a contract concluded with the entrusted organisation and with generally binding legislation, in particular with hygiene legislation. 5)
The national committee may withdraw the consent,
(a) if, when providing temporary accommodation in private, the citizen has infringed the obligations laid down in general binding legislation or does not comply with his or her obligations resulting from a decision of the national committee or from a contract concluded with the designated organisation;
(b) where this requires an important interest of the company.
The granting of temporary accommodation in private contrary to this Regulation shall be subject to special rules. 6)
A citizen who has concluded a private temporary accommodation agreement with a Socialist organisation before the application of this Regulation may, until 31 December 1984, provide temporary accommodation in accordance with the contract concluded without the consent of the National Committee pursuant to Article 1.
This Regulation shall enter into force on 1 August 1984.
