DECLARATION
Ministry of Forestry and Water Management of the Czech Socialist Republic
of 16 June 1975
on the obligations of organisations to report on groundwater detection and to report data on their sampling
The Ministry of Forestry and Water Management of the Czech Socialist Republic provides, pursuant to § 28 paragraph 2 of Act No. 138 / 1973 Coll., on Water (Water Act):
Reporting on groundwater detection
(1) An organisation which discovers a source of groundwater (1) of more than 1 l / s in the construction of a groundwater collection facility or in the verification or research of supplies and groundwater regime is required to submit a written report to the Prague Hydrometeorological Institute.
(2) The same obligation is on the organisation which:
(a) in the case of an investment activity other than that referred to in paragraph 1, the source of groundwater shall be found in an unusual quantity (e.g. in such quantities as to require a change in the construction technology or to avoid abandonment of construction on this site, etc.);
(b) in any of its activities, it shall identify a source of groundwater with a tension level (artesian water) of more than 0,5 l / s.
(1) The organisation's report shall specify:
(a) its name and registered office;
(b) the exact location of the place of occurrence (county, district, municipality, cadastral territory and parcel number of the land);
(c) the date on which the groundwater source is detected;
the organisation is obliged to report within 7 days of the date of detection of the groundwater source.
(2) However, an organisation which, in the activities referred to in Paragraph 1 (2), ascertains the nature, quality, quantity and condition of the groundwater level shall provide such additional information in a report which it shall submit within 60 days of the date of the finding of the source, unless it agrees with the Prague Hydrometeorological Institute and on a longer period.
(3) The hydrometeorological centre of Prague is entitled to require explanations from the organisations for the notified data and other necessary data and the notified data by its personnel on the premises and properties of the organisations as well as to verify the presence of groundwater at all.
An organisation which intends to carry out research or research into groundwater for the purpose of sampling as from 1 January 1976 shall, before the work begins, establish the state of groundwater exploration in the interest areas at the Prague Hydrometeorological Institute and use the data found in those works.
Notification of groundwater sampling data
(1) An organisation using groundwater shall report data on withdrawals in quantities exceeding 15 000 m3 in one year or exceeding 1250 m3 in one month by 15 February of the current year to locally relevant watercourses managers of water-relevant (2) (hereinafter referred to as "flow managers') within the scope and in the manner set out in the Annex to this Regulation.
(2) The flow managers shall notify the national committee by 31 December of each year of aggregate data on groundwater sampling, the competent authority to authorise groundwater sampling.
(3) When taking groundwater from springs, artesian wells or wells, the organisation is required to determine its unused yield and notify it at the same time as the sampling data for the relevant flow managers.
(4) In cases to be determined by the National Committee on the proposal of flow managers to authorise the collection of groundwater, the organisation shall be required to measure the water meters and, where appropriate, other measuring instruments.
(5) The flow managers shall be entitled to request from the organisation explanations and documentary evidence of the notified data and to verify such data by their staff.
Transitional and final provisions
The groundwater organisation shall send the first notification of the sampling data (Section 4 (1)) to the relevant flow manager within three months of the date of the entry into force of this Decree.
This decree shall take effect on 1 July 1975.

Explanatory notes to the form
The form shall be filled in separately for each water consumption. Exceptionally, one multi-sampling form shall be filled in only if the water is taken from one source by a larger number of storage facilities whose identification data 01-06 are the same.
In this case, the total water consumption is decisive for reporting.
01 buyer number:
the organisation number according to the "Single code list of organisations' (FSÚ 1972) shall be indicated.
02 hydrological order number:
the designation of the river basin where the collection takes place according to the hydrological conditions of the CSSR issued by the Hydrometeorological Institute in Prague in 1965.
03 region, district, village, cadastral territory:
the indication of the territory on which the collection takes place, according to the "Single code list of municipalities' (FSÚ 1972).
04 enterprises Water:
the number of the holding of the Flood in whose territory the procurement takes place, according to the following code list:

05 hydrogeological area:
the designation of the hydrogeological area in which the water is collected, according to the map Annex to the CSSR GMP issued by MLVH ČSR (in print).

shall be marked with a numerical symbol according to the following code list:

In the middle part of the form, in the case of "other modifications', the form shall be followed by a password such as deacidification, hardening, iron content, manganese, decarbonisation, demineralisation, one-stage - two-stage separation, etc.
10 method of determining the sampling values:
the numerical symbol shall indicate how the sampling values were determined in the last year (actual sampling):

11 capacity of the drawing equipment:

12 number of the register of the aquatic permit:
within the meaning of the MLVH Water Registration Order (the numeric symbol - 999999 shall be given until the time of the allocation of the registration number).

14 Water management permit:
(a) quantity - the quantity allowed in l / s shall be indicated in the strongly framed part Where a water-based permit contains an indication in a unit other than l / s, this indication (including the unit) shall be given under a strongly framed section; If there is no figure in the aquatic permit, it shall be written under the strongly framed part - undetermined;
(b) issued - the abbreviation of the water operator issuing the authorisation (e.g. ONV Prostějov) shall be given;
(c) number - the reference number broken down by the year of issue of the authorisation shall be given.
15 the protection zone has declared:
the abbreviation of the water management authority and the reference number broken down by the year of the decision shall be given.
16 plot in map:
Delete as appropriate.
The drawing shall be transmitted only on the first notification or on the change of sampling point.
17-22 groundwater sampling:
the values are given in one decimal place. The specified time levels apply only to reports submitted in 1975. In general, time levels are characterised as follows:

shall be reported in rounded order of hours. The time levels indicated on the form are valid only for 1975, generally characterised as follows:

Each year, headings and rows 01 and 17 to 26 shall be completed. Other rows are to be filled in only on the first notification or if any data is changed. In this case, the form shall be completed in its entirety.
1) Article 2 of Act No. 138 / 1973 Coll., on Water. Note: This decree does not apply to mining waters [§ 40 (2) of Act No. 41 / 1957 Coll., on the use of mineral resources (upper law)] and to sources of natural medicinal water and natural mineral waters of table water (§ 31 (2) of Decree No. 26 / 1972 Coll., on the protection and development of natural medical baths and natural medical resources).
2) Watercourses managers of water-relevant importance are the State Water Management Organisations of the Water Elbe, the Water Vltava, the Water of the Fire, the Morava and the Water Odra.
