on the evaluation of the activities of national business managers and the rights of their widows and orphans.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
(1) The duration of the activity of the national administrator of the business undertaking, after which the company was properly managed within the meaning of the provisions of Section 21 of the Decree of the President of the Republic of 19 May 1945, No 5 Coll., on the nullity of certain non-freedoms and on the national administration of the assets of Germans, Hungarians, traitors and collaborators, and of certain organisations and institutes, in Slovakia, within the meaning of Section 20 of the Slovak National Council Regulation of 5 June 1945, No 50 Coll. SSR, on the national administration, is counted into the prescribed period of auxiliary (tovarisch) employment in the relevant trade.
(2) For the trades referred to in § 38 (3) and (4) (53) (3) and (4) (z), the condition is that the national administrator has learned business before its provision. For other trades linked to a licence, the condition is that the national administrator has been employed in the same field before his provision for a period equal to at least two thirds of the total training period prescribed or normally required for the licence; In doing so, however, he must be taught in the trade where he is required to be taught.
(3) The Office (authority) designated by the national administrator shall issue a certificate that the national administrator has managed the business undertaking properly.
(1) The right of the national administrator to allocate small business enterprises pursuant to § 5, paragraph 1 of the Act of 14 February 1947, No 31 Coll., on certain principles in the distribution of enemy assets confiscated under the decree of 25 October 1945 of the President of the Republic, No 108 Coll., on the confiscation of enemy assets and National Recovery Funds, is passed on to the widow, if it was not its own fault, or to minors who are not dependent. Entitlement to the allocation of a business undertaking shall be exercised by such persons no later than the time prescribed for the application for the allocation of a small business undertaking. However, if the national administrator died following the filing of the application, the claim must be exercised before the undertaking is surrendered.
(2) For persons referred to in paragraph 1, the conditions laid down in Sections 5, 1, 1 and 2 of Law No 31 / 1947 Coll. and the formalities laid down in the Trade Code (Act) for the pursuit of trade must be fulfilled. If they do not have a prescribed licence or a certificate of substantive knowledge, they may be granted a business undertaking and granted a trade licence only if they establish an eligible deputy in accordance with Paragraph 55 (71 (z)). Persons who have been granted a trade licence without a licence or in-kind knowledge shall not be exempt from the licence or in-kind knowledge in the event of a transfer of a trade outside the municipality of the original post or of the reoperation of the trade if its performance has been interrupted.
(3) The right to trade in widows and underage dependent children is valid only for the duration of widower's or underage.
Save as otherwise provided for in this law, the provisions of the Trade Code (Trade Code) and its amendments shall remain unaffected.
This Act shall take effect on the day of its publication; It shall be implemented by internal trade, industry and health ministers in agreement with the ministers involved.
