of 26 November 2004

amending certain laws following the implementation of the reform of public finances in the field of remuneration

Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

Amendment of the Law laying down exceptional measures for the years 2004, 2005 and 2006 in order to determine the amount of salary and certain reimbursement of expenses associated with the performance of the duties of representatives of the State and of certain State institutions, Members of the European Parliament, Judges and prosecutors

Čl. I

Act No. 427 / 2003 Coll., laying down exceptional measures for the years 2004, 2005 and 2006 to determine the amount of salary and certain reimbursement of expenses associated with the performance of the duties of representatives of the State and of certain State institutions, Members of the European Parliament, Judges and prosecutors, the amount of other salaries of such persons for the first and second half of 2004, and amending certain related laws, as amended by Act No. 359 / 2004 Coll., is hereby amended as follows:

1. In the title of the Act, the words "years 2004, 2005 and 2006 'are replaced by the words" years 2004' and the words "additional salaries of such persons for the first and second half of 2004, 2005 and 2006 'are replaced by the words" additional salaries of such persons for the first half of 2004'.

2. In the heading of Part One, the words "years 2004, 2005 and 2006 'are replaced by the words" year 2004' and the words "additional salaries for the first and second half of 2004, 2005 and 2006 'are replaced by the words" additional salary for the first half of 2004'.

3. In Article 1, the following comma is inserted at the end of point (n) and the following point (o) is added:

"(o) President of the Office for the Protection of Competition."

4. In Section 1, "2004, 2005 and 2006 'is replaced by" 2004'.

5. In Section 2, the words "and the second half of 2004, 2005 and 2006 'are replaced by the words" half of 2004'.

6. In Article 3, "2006 'is replaced by" 2004'.

Amendment of the Salary Act and other formalities relating to the performance of the duties of representatives of the State and of certain state bodies and judges and Members of the European Parliament

Čl. II

Act No. 236 / 1995 Coll., on the salary and other formalities associated with the performance of the duties of representatives of State authority and of certain State bodies and judges and Members of the European Parliament, as amended by Act No. 138 / 1996 Coll., Act No. 287 / 1997 Coll., Act No. 155 / 2000 Coll., Act No. 231 / 2001 Coll., Act No. 309 / 2002 Coll., Act No. 420 / 2002 Coll., Act No. 362 / 2003 Coll., Act No. 427 / 2003 Coll., Act No. 49 / 2004 Coll., and Act No. 359 / 2004 Coll., is amended as follows:

1. in Paragraph 2 (1), point (b) shall be deleted;

Points (c) to (e) shall be renumbered (b) to (d).

2. In Article 2 (2), the words "and additional salary 'are deleted.

3. In Paragraph 3 (4), "2007 'is replaced by" 2005', "2006 'is replaced by" 2004', "2004 'is replaced by" 2002' and "2005 'is replaced by" 2003'.

4. Article 4 shall be deleted, including the title.

5. In Section 8, the words "and additional salary 'are deleted from the heading.

6. In the first sentence of Article 8 (1), "1.00 'is replaced by" 1.08'.

7. in Paragraph 8 (1) (a), "0,10" is replaced by "0,11."

8. in Paragraph 8 (1) (b), "0,20" is replaced by "0,22."

9. in Paragraph 8 (1) (c), "0,40" is replaced by "0,44."

Act No. 201 / 1997 Coll., on the salary and certain other requirements of the prosecutors and amending and supplementing Act No. 143 / 1992 Coll., on the salary and remuneration for on-call time in the budget and in certain other organisations and bodies, as amended, as amended, Act No. 155 / 2000 Coll., Act No. 14 / 2002 Coll., Act No. 279 / 2002 Coll., Act No. 309 / 2002 Coll., Act No. 420 / 2002 Coll., Act No. 192 / 2003 Coll., and Act No. 427 / 2003 Coll., is amended as follows:

1. In Paragraph 2 (1), the words "and additional salary 'are deleted.

2. In Paragraph 3 (4), "2007 'is replaced by" 2005', "2006 'is replaced by" 2004', "2004 'is replaced by" 2002' and "2005 'is replaced by" 2003'.

3. Paragraph 3 (6) reads as follows:

"(6) The payment coefficient referred to in paragraph 2 shall be determined by the prosecutor:

Amendment to the Ombudsman Act

Čl. IV

In Article 8 (2) of Act No 349 / 1999 Coll., on the Ombudsman, the words "additional salary," are deleted.

Amendment to the Securities Commission Act

Čl. V

Act No. 15 / 1998 Coll., on the Securities Commission and amending and supplementing other laws, as amended by Act No. 30 / 2000 Coll., Act No. 362 / 2000 Coll., Act No. 370 / 2000 Coll., Act No. 308 / 2002 Coll., Act No. 309 / 2002 Coll. and Act No. 257 / 2004 Coll., are amended as follows:

1. In Paragraph 25 (2), the words "additional salary," are deleted.

2. In Paragraph 25 (3), the words "additional salary," are deleted.

Čl. VII

Amendment of the Act on the service relationship of members of the Security Corps

Čl. XI

Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended by Act No. 186 / 2004 Coll. and Act No. 436 / 2004 Coll., is amended as follows:

1. in Paragraph 113, point (e) is deleted;

Points (f) and (g) shall become points (e) and (f).

2. Paragraph 121 shall be deleted, including the title.

3. In Paragraph 219, "2004 'is replaced by" 2005'.

4. In Section 223, "2004 'is replaced by" 2005'.

5. In Article 224 (6), "2005 'is replaced by" 2006'.

6. In Paragraph 226, "2004 'is replaced by" 2005'.

7. Article 229 is deleted.

8. Paragraph 231, including the title, reads:

Efficacy

Čl. XII

In Act No. 362 / 2003 Coll., on the amendment of laws related to the adoption of the Act on the Service Ratio of Members of the Security Corps, as amended by Act No. 186 / 2004 Coll., Act No. 281 / 2004 Coll. and Act No. 359 / 2004 Coll., Article XLII reads:

„Čl. XLII

This Act shall take effect on 1 January 2006. '.

1. In Paragraph 1 (9), the words "additional salary 'are deleted and the words" President of the Office for the Protection of Personal Data under the Special Act (2)' are replaced by the words "President of the Supreme Audit Office '.

Amendment of the law amending certain laws on the public health protection sector

Čl. XVII

In Article II (17) and (18) of Act No. 274 / 2003 Coll., amending certain laws on the section of public health protection, as amended by Act No. 426 / 2003 Coll., the words "until 31 December 2004 'are replaced by the words" until the full effectiveness of the Staff Act becomes effective'.

Amendment to the Financial Control Act

Čl. XVIII

In Article 32 (4) of Act No. 320 / 2001 Coll., on financial control in public administration and amending certain laws (Act on Financial Control), as amended by Act No. 123 / 2003 Coll. and Act No. 426 / 2003 Coll., the words "From 1 January 2005 'are replaced by the words" From the date on which the full effectiveness of the Staff Act becomes effective'.

Amendment to the Plant Health Act

Čl. XIX

In Section 89 of Act No. 326 / 2004 Coll., on Plant Health and on the amendment of certain related laws, the following paragraph 8 is added:

"(8) Until the full effectiveness of the Staff Act 52), the Minister for Agriculture shall appoint and dismiss the Director of the Plant Health Administration. '
