GOVERNMENT REGULATION
of 16 November 2004
amending Government Regulation No. 26 / 2003 Coll., laying down technical requirements for pressure equipment
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll. and Act No. 205 / 2002 Coll., ("the Act ') to implement Sections 11a (2) (c) and 12 (3) of the Act:
Government Decree No. 26 / 2003 Coll., laying down technical requirements for pressure equipment, is amended as follows:
1. In Paragraph 1 (1), the word "work 'is replaced by" leave'.
2. in § 1 (2) (c), § 1 (3) (s) and Annex 1 (2.2.3.2) (a) and 7.4 (b), the word "working" is replaced by the word "allowed."
3. in Paragraph 1 (2) (d), the word "work" is replaced by the word "leave."
4. in Article 2 (2) (a) (1) and (2), in Article 2 (2) (c) (1) and (2) and in Annex 1 (7.4) (a), the word "working" shall be replaced by "leave."
5. in Paragraph 4 (1) (d) (4), "11" is replaced by "13."
6. In the first sentence of Article 4 (3), the word "management 'is deleted.
7. In Paragraph 4 (4), "4 'is replaced by" 2';
8. In Section 4 (5) of the introductory part of the provision, the words "paragraph 4 (e) 'are replaced by the words" paragraph 3'.
9. In Article 4 (5) (c), the word "accessible 'is replaced by" admissible'.
10. in Article 5 (3) and (4), the words "the Official Journal of the European Communities" shall be replaced by the words "the Official Journal of the European Union";
11. in the first sentence of Article 6 (1), the word "v" shall be inserted after the words "for the performance of the tasks indicated."
12. in Article 9 (a), the words "container not responding" are replaced by the words "pressure equipment or assembly not responding."
13. in Annex No 1, point 2.2.4, the word "v" shall be inserted at the beginning of point (c).
14. in Annex 1, point 2.10 (a), "paragraph 1 shall be replaced by" paragraph 2 ";
15. in Annex 1, points 2.2.2 (b), 2.11.2 and 7.3 and in Annex 2, point 3 (a), the word "work" is replaced by the word "allowed."
16. in Annex 1, points 2.2.4 (a) and 7.4 (a), the word 'working' shall be replaced by 'allowed';
17. In Annex No 1, point 3.1.2, fourth sentence, the word "recognised 'and the text" § 6c' shall be replaced by "§ 6 'after the words" notified person or'.
18. In Annex 1, point 3.1.2, fifth sentence, the word "recognised 'and the text" § 6c' shall be replaced by "§ 6 'after the words" notified person or'.
19. in Annexes 1, 3 and 6, the words "Paragraph 4 (2)" are replaced by the words "Paragraph 2 (4)."
20. In the second sentence of point 3.1.3 of Annex 1, the word "recognised 'is inserted after the word" agreed' and the text "§ 6c 'is replaced by" § 6'.
21. in Annex 1, point 3.3.1 and point 3.3.2 (a), "7" is replaced by "8."
22. In Annex 1, point 3.3.2, the word "measure 'is replaced by the word" designation'.
23. in Annex 1, point 4.2 (b) (2):
"2. the use of materials covered by a material certificate or European approval for materials referred to in Article 5; or"
24. In Annex No 1 to the title of point 5 and in point 5.1 (b), "3 'is replaced by" 2'.
25. In Annex 1, point 7.1, the designation "7.1.1 'is inserted before the heading" Tags'.
26. In Annex 1, point 7.5, the word "working 'is replaced by" leave'.
27. In Annex No 2, point 2, the words "under § 1 (1) (a) (3) and referred to in § 3 (3) (d) 'are replaced by the words" under § 1 (2) (a) (3) and under § 2 (2) (d)'.
28. In Annex No 2, point 3, the words "under § 1 (1) (a) (4) and referred to in § 3 (3) (d) 'are replaced by the words" under § 1 (2) (a) (4) and under § 2 (2) (d)'.
29. In Annex No 2, Chart 4, the words ", point 3 'are deleted.
30. In the second sentence of point 2 of Part 1 of Annex 3, the words "not established in the Community 'are replaced by the words" not established in a Member State of the European Union'.
31. In Annex 3, Part 3, point 7, the words "communicate to the Authority 'shall be replaced by the words" communicate to the Authority for Technical Standardisation, Metrology and State Testing (hereinafter "the Office') '.
32. In the second sentence of point 3 of Part 5 of Annex 3, the words "Where neither the manufacturer nor his authorised representative is established, the technical documentation shall be kept 'shall be replaced by the words" If neither the manufacturer nor his authorised representative is established in the Member State of the European Union, the technical documentation shall be kept'.
33. In Annex 3, Part 5, point 4 (b), last sentence, "his' is replaced by" his'.
34. In Annex 3, Part 6, point 5 (b), the words "point 2 (3.4) 'are replaced by the words" point 2 (3.4)';
35. In Annex 3, Part 8, point 6, the words "the Office and 'shall be inserted after the words" providing'.
36. In Annex 3, Part 9, point 6 (c), the word "paragraphs' shall be inserted after the word" second '.
37. In Annex 3, Part 9, point 6 (d), the words "the last point of point 4.3, the last point of point 4.4 'are replaced by the words" the last paragraph of point 4.3, the last paragraph of point 4.4'.
38. In Annex 3, Part 12, point 5 (b), the words "second point of point 4.4 'are replaced by the words" second paragraph of point 3.4'.
39. In Annex 3, Part 12, point 5 (c), the words "in accordance with the last point 3.3, the last point 3.4 and points 4.3 and 4.4 'are replaced by the words" in accordance with the last paragraph of point 3.3, the last paragraph of point 3.4 and points 4.3 and 4.4.';
Efficacy
This Regulation shall enter into force on 31 March 2005.
