THE LAW
of 19 March 2014
amending Act No. 477 / 2001 Coll., on Packaging and on the Amendment of Certain Acts (Law on Packaging), as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 477 / 2001 Coll., on Packaging and amending certain laws (Law on Packaging), as amended by Act No. 274 / 2003 Coll., Act No. 94 / 2004 Coll., Act No. 237 / 2004 Coll., Act No. 126 / 2004 Coll., Act No. 444 / 2005 Coll., Act No. 66 / 2006 Coll., Act No. 296 / 2007 Coll., Act No. 25 / 2008 Coll., Act No. 126 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 281 / 2009 Coll., Act No. 77 / 2011 Coll., Act No. 18 / 2012 Coll., Act No. 167 / 2012 Coll., is amended as follows:
1. in Sections 1 (1), 4 (5) (a) and 6 (d), 6, 25 (b) and 32 (q), the words "European Communities" are replaced by the words "European Union."

2. Annex 1 shall read as follows:

"Annex No 1 to Act No. 477 / 2001 Coll.
Criteria and examples specifying the concept of packaging
Criterion 1
A product which meets the definition of packaging referred to in Section 2 (a) and which also fulfils or can fulfil a function other than that of packaging shall be considered as packaging only if:
(a) is not an integral part of another product;
(b) it is not necessary for it to close, carry or store the product for its lifetime; and
(c) all parts are not intended to be used together, consumed or removed.
Indicative examples illustrating the application of criterion 1
Packaging
Candy boxes
Film case for CD
Postal bags for catalogues and magazines (with printed matter inside)
Paper bakers' wares sold with bakery or pastry products
Rings, tubes, tubes and cylinders on which flexible materials are wound up, such as plastic foil, aluminium foil (aluminium foil) or paper, excluding rolls, tubes, tubes and cylinders which serve as part of production machines and which are not used to present the product as a sales unit
Flowers intended only for the sale and transport of plants and not for the whole life of the plant
Glass vials for injection
Roller-type spindle CD covers (sold with CDs, not intended for disk storage)
Clothes hangers (sold with clothing)
Box of matches
Sterile barrier systems (bags, trays and materials necessary to maintain product sterility)
Capsules for drinking systems (for example, coffee, cocoa, milk) which remain empty after use
Repeatability steel cylinders of a kind used for different types of gases, excluding fire extinguishers
Subject not covered
Flowers intended for the whole life of the plant
Cases, cases and cases for tools
Tea bags
Wax layers on cheese
Syringe of sausages
Clothes hangers (sold separately)
Coffee capsules for drinking systems, aluminium foil coffee bags and filter paper coffee pads removed with the coffee product used
Printer cartridges
CD, DVD and video cases (sold with CD, DVD or video inside the case)
Spindle type CD cylindrical packaging (sold empty, for CD storage)
Solvent detergent bags
Tomb lamps (candlelight receptacles)
Mechanical grinder (built in a container that can be refilled, for example, refillable pepper grinder)
Criterion 2
Articles designed and intended to be filled at the point of sale shall be considered as packaging if they function as packaging.
Indicative examples illustrating the application of criterion 2
Packaging which is designed and intended to be filled at the point of sale
Carrying paper or plastic bags and bags
Disposable plates and cups
Adhesive film
Sandbags
Aluminium foil
Plastic foil for cleaned laundry linen

Mixer
Disposable cutlery
Packaging paper (sold separately)
Paper baking moulds (sold empty)
Paper baking cupcakes sold without bakery or pastry products
Criterion 3
The packaging components and auxiliary elements included in the packaging shall be considered as the packaging parts in which they are incorporated. Auxiliary elements which are suspended directly on the product or are attached to the product and fulfil the function of the packaging shall be considered as packaging only if:
(a) are not an integral part of this product; and
(b) if all parts are not intended to be used together or removed.

Packaging
Labels and tags which are directly suspended on or attached to the product
Subject to packaging
A mascara brush which is part of the mascara cap
Self-adhesive labels affixed to other parts of the packaging
Clasps, clips, clamps
Plastic changing labels (shrinkable)
Dosing device which is part of the container cap with detergents
Mechanical grinder (built into a container which cannot be refilled and which is filled with a product such as pepper grinder filled with pepper)

The rate of recycling or the total use of sales packages to the consumer shall be determined as a proportion of the quantities of packaging waste recovered from the consumer and the quantity of sales packaging placed on the market or put into circulation by the person. The denominator does not include sales packages which are simultaneously industrial packaging.
Packs containing at least 70% by weight of packaging shall be regarded as one material.
Recycling and total recovery are determined as a percentage by weight and recycling is included in the total use as one of its forms, together with energy recovery and organic recycling § 4 (1) (c). '

This Act shall take effect on the day of its publication.
