DECLARATION
Federal Ministry of Foreign Trade
of 29 May 1980
on the control of foreign business
The Federal Ministry of Foreign Trade provides pursuant to § 10 (2) of Act No. 42 / 1980 Coll., on Economic Relations with Foreign Affairs:
(1) The control of foreign trade pursuant to Section 12 of the Act is carried out by the Federal Ministry of Foreign Trade by its authorities (hereinafter referred to as the "supervisory authority").
(2) The subject of the inspection is a foreign business activity (Section 6 of the Act) carried out on the basis of a legal act or an authorisation granted (Section 7 of the Act):
(a) foreign trade organisations (§ 3 (c) of the Act);
(b) Czechoslovak legal persons who are socialist organisations but are not foreign trade organisations;
(c) other Czechoslovak legal persons and foreign persons.
(1) The control of external trade organisations is carried out by the Federal Ministry of Foreign Trade as their superior central administration body in the extent and manner laid down in the generally binding regulations and regulations of the Federal Ministry of Foreign Trade.
(2) The control of foreign trade activities carried out by Czechoslovak legal persons, which are socialist organisations authorised for foreign trade activities, is carried out by the supervisory authority in view of the effectiveness of the involvement of the Czechoslovak national economy in the international division of labour, focusing on compliance with the legislation governing foreign trade activities and the conditions laid down in the authorisation granted.
(3) The inspection of other Czechoslovak legal persons and foreign persons having a foreign trade permit shall be carried out by the supervisory authority with a view to compliance with the legislation governing foreign trade and the conditions laid down in the authorisation granted.
The supervisory authority shall be entitled to all operations required to carry out a control of foreign trade; in particular he shall be entitled to:
(a) require that documents and documents be submitted to him within the specified time limits, complete written or oral information on facts relating to the foreign trade activities of the persons checked and the causes of the defects detected, even if they are covered by economic or professional secrecy. If the inspection body is shown by special mandate of the Federal Ministry of Foreign Trade, it must also be presented by the Czechoslovak legal persons referred to in Article 1 (2) (a), (b) with the required documents containing facts constituting state secrets;
(b) require that original written documents be issued to him on written confirmation;
(c) in the exercise of control activities, require the cooperation of control and other organisational units of controlled Czechoslovak legal entities referred to in § 1 (2) (a), (b).
Controlled persons shall be obliged to create conditions for the control authority to exercise control without delay. In particular, they shall:
(a) submit to him the required documents and provide information and explanations on the circumstances which are of direct or indirect importance for the assessment of the activity under scrutiny;
(b) to allow him to inspect and extract accounting and other records and documents relating to the controlled activity;
(c) without delay, remove the detected defects and their causes and report in writing to the control authority within a specified time limit on the measures taken to remedy the detected defects and their fulfilment.
The supervisory authority shall notify the results of the checks on the Czechoslovak legal persons referred to in Article 1 (2) (b) to the central authorities of those persons.
The inspection authority shall also notify the authorities to which it is competent to take action under specific rules in such cases.
This Decree shall take effect on 1 July 1980.
