adjusting certain details of the establishment, cancellation and organisation of company archives
The Ministry of Interior of the Slovak Socialist Republic provides, pursuant to § 33 paragraph 1 (g) of the Slovak National Council Act No. 149 / 1975 Coll., on archiving (hereinafter referred to as "the Act"):
§ 1
Under Article 25 (1) of the Act, the organisations referred to in that provision are required to set up a company archive. The obligation to set up a company archive shall be exempt from those organisations which, with the agreement of the Ministry of the Interior of the Slovak Socialist Republic (hereinafter referred to as "the Ministry of Interior '), shall, for reasons of efficiency, transmit archive documents originating from their activities to the State Archives.
§ 2
(1) An organisation which is obliged to set up a company archive (hereinafter referred to as the organisation) shall establish it within five years of its establishment; However, if it takes over archive documents in whole or in part after its predecessor, it shall also set up a company archive, unless the company archive set up by its predecessor has been transferred to it.
(2) If, for reasons of efficiency, the organisation transfers, with the agreement of the Ministry of Interior or on the basis of its decision, archival documents originating from its activities to the custody of the State Archives (Section 25 (1), second sentence and (3) of the Act), it shall bear the costs associated with it by its means.
§ 3
(1) An organisation may set up a branch of its company archive for its lower organisational component, if the urgent need to use stored archival documents is required by that branch or if it is useful because of its distance from the company archive.
(2) Organisations may conclude an economic agreement that archive documents will be stored in a common archive (a joint enterprise archive) established by one of them. In order to establish such an archive, the consent of the Ministry of the Interior, which may be withdrawn if the conditions laid down are not complied with, is necessary.
(3) The economic contract shall specify the shares which the organisations contribute to the costs of setting up and managing the combined business archive and shall provide for a procedure for its possible division.
§ 4
(1) If the organisation managing the farm archive is cancelled without the appointment of a successor, the Ministry of the Interior shall, after consultation with the authority which ordered the cancellation of the organisation or, where appropriate, which managed the cancelled organisation, in which the archive documents from its business archive will be deposited or how the archive documents will be handled, if the combined business archive is used.
(2) If the organisation is divided or merged, the company archive will also be decided upon. This Decision shall be subject to the approval of the Ministry of the Interior, which shall also decide how to deal with archival documents stored in this company's archive if no agreement is reached.
§ 5
(1) An organisation which has set up a company archive (a joint archive, a branch) is required to manage the archive properly, in particular to ensure its activities on the personnel, financial, material and investment side, and to take full care of its development.
(2) The organisation managing the farm archive shall approve and monitor the implementation of the annual plans for the main tasks of the farm archive; the annual plans and reports on their implementation shall also be submitted to the relevant national archives.
(3) The archive documents stored in the company archive are also part of the organisation's scientific and technical and information system.
(4) Archiving documents in company archives are recorded separately and stored separately from those in central and special files. 1)
§ 6
(1) The head of the organisation shall entrust the management of the farm archive to the staff of the organisation competent to carry out the professional archiving work (hereinafter referred to as "the head of the archive") and to manage the activities of the staff of the company archive (its branch).
(2) The management of the archive may be linked to other activities in the organisation only exceptionally, unless this makes it difficult to carry out the proper work related to the management of the company archive.
(3) The head of the archive is in charge of the operation of the employees of the company archive (its branch) and is responsible for the proper storage and professional processing of archive documents.
(4) The head of the archive shall in particular:
(a) ensure receipt, registration, making available and use of archive documents and their universal protection, including their preservation;
(b) submit to the head of organisation draft annual plans for the main tasks of the farm archive;
(c) ensure that the organisation and, where appropriate, its organisational components comply with the rules on file handling and that the documents are properly discarded. 2)
§ 7
(1) The Ministry of the Interior shall supervise compliance with the rules governing the professional archival activities of the company archives, which shall propose to the competent authorities measures to address the deficiencies identified.
(2) The authorised personnel of the Ministry of the Interior and, where appropriate, authorised personnel of the State Archives (Section 13 (2) of the Act) are entitled to enter the premises where the archives and the registers are located in connection with the performance of the health check of the company archives and files.
§ 8
The Order of the Ministry of the Interior of the Slovak Socialist Republic No 22 / 1973 Coll., on Business Archives is hereby repealed.
§ 9
This Decree shall take effect on 1 July 1976.
