DECLARATION
Ministry of Chemical Industry
of 16 May 1960
on the renovation of irreversible wooden packaging
The Ministry of Chemical Industry, in agreement with the participating central authorities and authorities and with the Councils of the Regional National Committees, provides for Article 3 of Decree No. 109 / 1945 Coll., on Production Management and pursuant to Section 2 of Decree No. 107 / 1949 Coll., on certain measures concerning unused material:
Inrefundable wooden containers
(1) Non-refundable wood packaging under this Decree means:
(a) wood packaging in which foreign goods have been imported and the importing foreign trade undertaking has not refunded them;
(b) wooden packaging included in the price of the goods or invoiced by the supplier in agreement with the customer separately and which the customer is not obliged to return to the supplier, *)
(c) wood packaging which the customer has not returned to the supplier in accordance with the applicable rules on the management of packaging in the course of the circulation of the goods, * *)
(d) other wooden containers unfit for circulation.
(2) The following provisions shall not be regarded as non-refundable wood packaging:
(a) wooden containers in which, as usual, the goods are issued directly to the consumer;
(b) wood packaging made of sawn wood up to a thickness of 10 mm;
(c) wood packaging which, for health or other reasons, are not fit for further use or reprocessing.
(3) In the cases at issue, it shall decide whether the non-refundable wood packaging under this Order is the authority of the District National Committee responsible for the place where the non-refundable packaging is.
Obligation to tender
(1) Organisations holding non-refundable wooden packaging and components thereof are required to offer them without undue delay after their discharge to the nearest undertakings or other organisations of the national committees responsible for the purchase (hereinafter referred to as "undertakings").
(2) This obligation does not apply
(a) for non-refundable wooden packaging which the holder himself continues to use exclusively for packaging purposes;
(b) to non-refundable wood packaging which the holder leaves exclusively for packaging purposes to another organisation subject to the same superior authority after prior agreement of that authority;
(c) non-refundable wood drums intended for the transport of wires, ropes and cables, provided that the holder leaves them to the manufacturer for packing purposes.
Purchase and renovation
(1) Renovation of non-refundable wood packaging consists of repair, modification or reprocessing of wood packaging in order to further serve the transport of goods.
(2) Exclusive purchases and renovations of non-refundable wooden packaging are entrusted to undertakings designated by the authorities of the Regional National Committees.
(3) The undertakings responsible for the purchase and renovation of non-refundable wooden packaging are obliged to:
(a) to buy and remove the offered non-refundable wooden packaging not later than 30 days after the date of receipt of the offer pursuant to Article 2 (1), unless the parties concerned agree on other time limits;
(b) designate one of its establishments to carry out the renovation of the redeemed non-refundable wooden packaging and equip it with the necessary machinery and storage spaces and create other necessary conditions to enable it to carry out this activity successfully.
(4) The repair, modification and reprocessing of purchased non-refundable wooden packaging must be carried out in such a way as to ensure the highest possible use of the material obtained from the recovered packaging.
(5) Material from purchased packaging may be used by the purchasing undertaking for purposes other than packaging if it is used more economically. However, the proportion of wood of renovated packaging shall not be less than half of the wood obtained from the packaging purchased and processed during the calendar quarter.
(6) Supervision of compliance with buyout and renovation obligations for non-refundable wooden packaging shall be carried out by the authorities of the national committees.
Holders of non-refundable wooden packaging may conclude long-term agreements with undertakings in charge of the purchase of closer terms and conditions of supply and purchase.
Registration
The operational records of the stocks of undertakings responsible for the purchase and renovation of non-refundable wooden packaging shall show how much (in kg) of non-refundable wood packaging they have purchased.
Purchase price
(1) The purchase price of non-refundable wooden packaging shall be determined by agreement between the supplier and the ransom undertaking according to the types, dimensions and construction of such packaging and according to the quality of the packaging material, at least Kčs 0,15 per 1 kg and not more Kčs 0,40 per 1 kg packaging weight. This price means the loco establishment (warehouse) of the supplier.
(2) For special military packaging of unconventional quality, a price higher than Kčs 0,40 per kg may be determined by agreement.
(3) If the agreement referred to in paragraph 1 or 2 is not reached, the saving committee shall decide in the district national committee responsible for the place where the non-refundable packaging is located.
Prices of renovated packaging
The prices of refurbished packaging shall not exceed those of new packaging of the same type, which shall be valid according to the relevant prices of the Ministry of Consumer Industry.
Transitional provision
Holders of non-refundable wooden packaging which obtained them before the date of application of this decree and do not use them exclusively for packaging purposes shall be required to offer them for redemption in accordance with Paragraph 2 (1) within 30 days of the date of application of this decree.
Final provision
The Decree of the Minister for the Local Economy, pp. 333 / 3-515.100-229 / 1955 of 24 March 1955, published in the Official Journal of the European Union in 1955 designating the undertakings of the local economy responsible for the repair of the wooden packaging used, is hereby repealed.
Efficacy
This Decree shall take effect from 1 June 1960.
