Legal measures of the Bureau of the National Assembly
of 15 December 1955
on transitional arrangements for the limitation of certain claims on money.
The Bureau of the National Assembly of the Czechoslovak Republic has decided on the following legal measure under Article 66 of the Constitution:
(1) Cash claims arising from civil claims on foreign countries and from which the limitation period began before 1 January 1952 and which, pursuant to Article 1 (1) of Act No 101 / 1953 Coll., on the transitional arrangements for the limitation of certain claims on money has not yet expired, shall be barred from the date laid down by the Government by the Regulation.
(2) Cash claims arising from civil law relations with abroad and between which the limitation period has ended for at least three years, between 31 December 1948 and 31 December 1953, may be used, unless a final decision is prevented from doing so, until the date laid down by the Government by the Regulation.
(3) Government regulations pursuant to paragraphs 1 and 2 shall be published at least six months in advance.
Paragraph 1 cannot be applied to claims for personal needs under the law, to claims for employment and brokering contracts and to claims for exchange rates.
It is also appropriate to set aside the claims which the statutory measure allows for, from 31 December 1948 until the end of 1955. This is without prejudice to specific provisions excluding the netting of claims against the State.
This legal measure shall take effect on 31 December 1955; they shall be carried out by the Minister of Justice in agreement with the participating members of the Government.
