Government Regulation
of 21 March 1947
on the reimbursement of parts of the service clothes of civil civil servants and of those of the service uniforms of Czechoslovak national railway staff, not allocated between 1943 and 1945.
The Government of the Czechoslovak Republic hereby orders, pursuant to § 146 and § 210, paragraph 1 of the Act of 24 June 1926, No 103 Coll., on the modification of the pay and certain service conditions of civil servants (the Law of Pay):
(1) The clothing compensation provided for in Article 12 of the Decree of 15 June 1934, No 133 Coll., on the service of civil servants, for the unallocated personal clothing components to which the employees referred to in Article 2 of that regulation were entitled in the period 1943 to 1945, or for the fitting-out of such components which were not paid for exceptional circumstances between 1943 and 1945 until 30 November 1945 shall be granted at the level of the estimated cost of the State after the price increase (adjustment) at the end of 1945 but not more than twice the cost of the respective allocation period. The acquisition costs of the State within the meaning of the preceding sentence shall be determined by the Minister of Finance on the proposal of the Supreme Bureau of Price in an agreement with the Ministry of Internal Trade, on the basis of the proposal of the Food and Supply Officer in an agreement with the Finance Officer, and, in the case of clothing components which are present in the field of one ministry (delegate), on the proposal of the Ministry (delegate).
(2) If the staff member has carried out a service giving entitlement to service, only part of the year (period of use), but not less than 6 months, the compensation shall be granted in proportion. The condition of continuous service 6 months shall not apply if, before the expiry of that period, the staff member has been transferred to retirement or active service removed for one of the reasons set out in Sections 1 and 4 of the Decree of the President of the Republic of 17 August 1945, No. 53 Coll., on the atonement of injustices to Czechoslovak public servants.
(3) The prerequisite for providing clothing compensation is that the staff member is statestically and nationally reliable.
(4) The clothing refund shall be paid without the licence provided for in § 12 (1), last sentence of the second sentence of Article 133 / 1934 Coll.
Similarly, the same amount can be granted to workers who would have received clothing compensation under Paragraph 4 (3) of the Law No. 133 / 1934 Coll. from 1943 to 1945 had they borrowed clothing components as inventory if it had not been prevented from the lack of fabrics.
Clothing compensation shall be granted mutatis mutandis in accordance with Section 1, in the case of which it may be granted mutatis mutandis in accordance with Section 2 also for the unallocated service uniform of Czechoslovak national rail staff pursuant to the Government Decree of 15 June 1934, No. 134 Coll., on the service uniform and service badge of Czechoslovak national rail staff and private railway staff.
This Regulation shall enter into force on the day of its publication; All members of the government will do it.
