of 20 December 2006
setting emission limits and other conditions for the operation of other stationary sources of air pollution
The Government orders pursuant to § 55 (1) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended by Act No. 92 / 2004 Coll., Act No. 180 / 2005 Coll. and Act No. 385 / 2005 Coll., ("the Act ') to implement Sections 4 (12) and 5 (12) of the Act:
Subject matter
(1) This Regulation (1) incorporates the relevant provisions of the European Community2) and sets emission limits, operating conditions and the way in which other stationary sources of air pollution (hereinafter referred to as "source") are to be classified into different categories of sources.
(2) This Regulation shall not apply to:
(a) co-incineration of waste with fuels in resources as referred to in special legislation3);
(b) sources which emit volatile organic compounds from solvent application processes and from the storage and distribution of petrol referred to in a separate legislation4).
Basic concepts
For the purposes of this Regulation:
(a) by direct process heating, where the pollutants resulting from the combustion of fuels are carried out together with the pollutants introduced into the air by a technological process;
(b) the maximum performance determined and guaranteed by the supplier, manufacturer or designer, which can be achieved in permanent operation under the conditions laid down in the design documentation of the construction, in the binding opinions and permits issued pursuant to § 17 of the Act or in the integrated permit under the Integrated Prevention Act (6).
Source categorisation
(1) The source categories are set out in Annex 1 to this Regulation, which sets out the categories, emission limits and technical conditions for the operation of resources, and Annex 2 to this Regulation, which sets out the categories, emission factors and plans for the implementation of the principles of good agricultural practice for agricultural resources.
(2) Where a source is not listed in Annex 1 or 2 to this Regulation, it shall be considered as a major source.
(a) a source for which the rated heat output of direct process heating exceeds 5 MW;
(b) a source whose annual emissions of one or more of the pollutants mentioned exceed one of the following quantities at the design power of the source and at a mass concentration corresponding to the general emission limit referred to in the separate legislation5)
1.200 tonnes of solid pollutants,
2.300 t sulphur oxides expressed as sulphur dioxide,
3.4 tonnes of chlorine and its gaseous inorganic compounds expressed as chlorine,
4.10 t volatile organic substances expressed as total organic carbon,
5,200 tonnes of nitric oxide and nitrogen dioxide expressed as nitrogen dioxide,
6.1 t of sulphate,
7.2 t of fluorine and its gaseous inorganic compounds expressed as fluorine,
8.50 tonnes of carbon monoxide,
9.10 tonnes of ammonia, or
(c) a source whose annual emissions of any of the pollutants other than those referred to in (b) or of their specified groups referred to in special legislation5) exceed 10 times the annual emissions determined by calculation of the mass flow applicable to the determination of the general emission limit and the annual operating time of the source set at 1000 hours, at the design power of the source and at the mass concentration corresponding to the general emission limit referred to in the special legislature5).
(3) Where a source is not listed in Annex 1 or 2 to this Regulation, it shall be considered as a medium source
(a) a source for which the rated heat output of direct process heating is from 0,2 MW to 5 MW inclusive;
(b) a source whose annual emissions of one or more of those pollutants are within the following limits, at the projected power of the source and at a mass concentration corresponding to the general emission limit specified in the separate legislation5)
1.20 to 200 tonnes including solid pollutants,
2.30 to 300 t including sulphur dioxide,
3.0,4 to 4 tonnes including chlorine and its gaseous inorganic compounds expressed as chlorine,
4.1 to 10 t including volatile organic substances expressed as total organic carbon,
5.20 to 200 t including nitric oxide and nitrogen dioxide expressed as nitrogen dioxide,
6.0,1 to 1 t including sulphate,
7.0,2 to 2 t including fluorine and its gaseous inorganic compounds expressed as fluorine,
8.5 to 50 t including carbon monoxide,
9.5 to 10 t including ammonia, or
(c) a source whose annual emissions of any of the pollutants other than those referred to in (b) or of their specified groups referred to in special legislation5) exceed the annual emissions determined by calculation of the mass flow applicable to the determination of the general emission limit and the annual operating time of the source set at 1000 hours, at a mass concentration corresponding to the general emission limit referred to in the special legislature5).
(4) Where a source is not listed in Annex 1 or 2 to this Regulation or in paragraph 2 or 3, it shall be considered as a small resource.
(5) For the purposes of categorisation, the parameters determining the classification of a source in the relevant category shall be added to the technologically identical installations of one operator, if they are those located in the same establishment (8) and their emissions are released by a common thread, regardless of the number of chimney vents, or could be released by a common vents with regard to the arrangement, regardless of the number of chimney vents. In the case of small sources, the parameters determining the classification of the source in the relevant category shall be added only to those of other small sources.
Emission limits and conditions for the operation of resources
(1) The emission limits and operating conditions are set out in Annexes 1 and 2 to this Regulation. The conditions for the operation of listed sources include requirements for the design and equipment of the source or for its operation, which complement or replace emission limits.
(2) The medium-sized resource operators referred to in points 1.2, 1.4, 2.1, 2.2.1, 2.2.2, 3.6, 3.7, 5.1 to 5.4., 6.3., 6.7., 6.8., 6.10., Part II of Annex No 1 to this Regulation shall process the operating rules, the content of which is laid down in a separate legislature5).
Plan for implementing the principles of good agricultural practice
The medium-sized agricultural resource operators referred to in Annex 2 to this Regulation shall develop a plan for the implementation of the principles of good agricultural practice. Annex 2 to this Regulation sets out the details and manner of processing of the plan for the implementation of the principles of good agricultural practice.
Repeal
Government Regulation No 353 / 2002 Coll., setting emission limits and other conditions for the operation of other stationary sources of air pollution, is repealed.
Efficacy
This Regulation shall enter into force on 1 January 2007.

Category, emission limits and technical conditions of operation of resources
Labels used and explanations of abbreviations
(a) Reference conditions A for the emission limit - concentration of the substance concerned at a pressure of 101,325 kPa and 273,15 K ("normal conditions") in dry gas, sometimes indicating the reference content of a substance in waste gas, usually oxygen,
(b) Reference conditions B for the emission limit - the concentration of the relevant substance in wet gas under normal conditions, sometimes indicating the reference content of a substance in waste gas, usually oxygen,
(c) reference conditions C for the emission limit - concentration of the relevant substance in the waste gas under normal operating conditions;
(d) NO2 - nitrogen oxides expressed as nitrogen dioxide,
(e) TZL - solid pollutants,
(f) SO2 - sulphur oxides expressed as sulphur dioxide, unless otherwise specified in the text of this Annex,
(g) HCl - gaseous inorganic chlorine compounds expressed as HCl, excluding chlorine
(h) HF - fluorine gaseous inorganic compounds expressed as HF,
(i) O2R - reference oxygen content;
(j) EL - emission limit,
k. PAH-polycyclic aromatic hydrocarbons;
(l) VOC - volatile organic substances expressed as total organic carbon.
Binding conditions for the operation of waste gas incineration plants
All, including emergency, waste gas disposal facilities shall be designed to ensure optimum combustion mode conduction and reduction of pollutant emissions to the air during the combustion of waste gases.
1. Fléra (torch) is a device for reducing emissions of air pollutants which acts as
(a) emergency discharge of gases into ambient air
(b) the connection of technological spaces with external air; or
(c) in the case of continuous and otherwise hard-to-process excess gas.
2. Each flyer is assessed individually with regard to its design, location and combustion gas medium. When assessing these devices, priority shall be given to assisted flours, i.e. flours, which have the structural ability to influence the amount of air supplied and the temperature of combustion.

1.2. Cocaine Production - Coking Battery
Notes:
(1) 0,1 kg TZL / t of total spayed coke in wet cooling of coke.
2) To the extent provided for in § 12 (2) (d) of Decree No. 205 / 2009 Coll., on the detection of emissions from stationary sources and on the implementation of certain other provisions of the Air Protection Act.
Technical conditions of operation:
(a) Only desulphurised coke oven gas may be used for heating coke oven chambers.
(b) The filling gases when filling the coke oven chambers are transferred to the raw coke oven gas or to another coke oven chamber. The operating cycle conditions shall be determined by the operating schedule.
(c) the equipment of the chemical plants of coke plants shall be secured against VOC leakage into ambient air. Water from direct gas cooling shall not be in direct contact with the air.
(d) The sulphur content of coke oven gas at the outlet of chemical plants shall not exceed 500 mg / m3. The content of the sulphate shall be determined by continuous operational measurement.
(e) The release of coke oven gas into the air is not permitted. The conditions for its possible controlled incineration in accordance with Part I should be laid down in the operating rules.
(f) The seal of the doors of the coke oven chambers shall be permanently secured by regular cleaning, adjustment, repair and replacement, so that the apparent emissions assessed from a distance of about 30 m are not more than 10% of the doors of the chambers on both the machine and coke sides, leakage control and their range shall be specified in the operating order.
(g) When extracting coke from the chambers, waste gases must be collected and introduced into the dusting plant.
h) The extinguishing towers shall be equipped with emission reduction bulkheads. For new extinguishing towers, their minimum height shall be at least 30 m.
(i) In the event of a failure to suck the raw coke oven gas out of the batteries and if necessary to burn it on flers, the extrusion and filling of the chambers must be stopped.
1.3. Gas gasification and liquefaction of coal, mineral oil production and refining, gas production and refining, energy gas production.

2.3. Processing of iron metals
2.3.1. Hot and cold rolling mills, including heat-treatment furnaces and ovens
Category: large power supply - rolling mill with a design power greater than 10 tonnes of processed steel per hour,
medium power supply - a rolling mill with a design output of less than or equal to 10 tonnes of processed steel per hour.
Notes:
1) Applies to heating furnaces not using natural gas.
2) These emission limits apply to furnaces with direct process heating or using a special protective atmosphere. The combustion of fuels used for heating, which is not a direct process heating, is subject to the provisions governing the conditions for combustion sources (categorisation, emission limits, other operating conditions).
2.3.2. Blacksmiths - heating and heat treatment furnaces
Category: large source - forge with designed heat output exceeding 5 MW,
medium source - forge with designed heat output 1 to 5 MW inclusive.

1) Applies to heating furnaces not using natural gas.
2) These emission limits apply to furnaces with direct process heating or using a special protective atmosphere. Technical conditions of operation:
(a) Limitation of VOC emissions resulting from the production of forms and cores by commonly available means, e.g. by minimising the consumption of the binder, replacing the alcohol-based coatings with water-based coatings, using non-aromatic solvents for the production of coldbox kernels.
(b) In the case of cold storage units, the restriction of CO emissions by commonly available means, e.g. by improving the heat efficiency of the storage unit, managing the quality of coke at the input, by additional incineration, using a biofilter.

Technical conditions of operation:
(a) In the case of electrolytic aluminium production, the specific production emissions of TZL recorded from daily averages shall not exceed 5 kg / tonne aluminium and the specific production emissions of HF shall not exceed 0,5 kg / tonne aluminium.
(b) Limitation of VOC emissions resulting from the production of moulds and cores, e.g. by minimising the consumption of the binder, replacing the alcohol-based coatings with water-based coatings, using non-aromatic solvents for the production of coldbox kernels.
(c) Organic compounds containing chlorine shall not be used for the melting of aluminium.
2.6. Surface treatment of metals, plastics and other non-metallic objects
Applies to plating and non-metallic articles, but does not apply to coating. Applies to pickling, galvanising, phosphatizing and polishing processes using electrolytic or chemical processes, as well as enamelling, blasting and related operations.
Category: large source - if the volume of the bath (excluding rinsing) is greater than 30 m3,
mean source - if the volume of the spa (excluding rinsing) is from 3 to 30 m3 inclusive, processes without the use of the spa.
Notes:
1) Applies to the use of nitric acid in continuously working equipment.
2) Applies when HCl is used for surface treatment.
3) Reference conditions B applies to large sources, C reference conditions apply to medium-sized sources.
