DECLARATION
of 15 December 2006
on the groups of certificates for the driving of vehicles of the armed forces, the conditions for obtaining them and the professional competence of members of the military order service
According to Section 37b of Act No. 219 / 1999 Coll., on the Armed Forces of the Czech Republic, as amended by Act No. 546 / 2005 Coll.:
Subject matter
This decree provides:
(a) a group of certificates for driving vehicles of the armed forces (hereinafter referred to as "driving certificates");
(b) the conditions for teaching, training and testing to obtain a driving certificate;
(c) qualification qualifications of a military order service teacher;
(d) the extent of the professional competence of a military ordered service member;
(e) the conditions for obtaining an authorisation to manage road traffic;
(f) the extent of competence of the military test commissioner for drivers; and
(g) the model driving certificate, the model of the cards and the manner in which the particulars are entered.
Groups of driving certificates
(1) The driving certificate is divided into groups VA, V-B, V-C, V-D, V-T, V-AM, V-B + E, V-C + E, V-D + E, V- H, V- K, V- P and V- Z.
(2) The VA, V- B, V- C, V- D, V- T, V- AM, V- B + E, V- C + E and V- D + E are equivalent to the category of driving licence under the special legislature1) and gives the right to drive:
(a) vehicles included in the category of road vehicles and in the category of military safety vehicles;
(b) vehicles included in the category of military combat vehicles or military special vehicles if they are built on the machine bottom of road or military safety vehicles and whose maximum permissible mass does not exceed 7,500 kg.
(3) The V- H group certificate authorises the driving of vehicles covered by specific legislation (m2) in categories M1 and N1, except off-road vehicles. A trailer with a maximum permissible mass not exceeding 750 kg may be connected to this vehicle.
(4) The V-K driving certificate authorises the driving of vehicles covered by a specific legislature (m3) in the category of military combat vehicles or military special vehicles, provided that they are built on wheeled chassis, with the exception of the vehicles referred to in paragraph 2 (b), and that no further authorisation is required for their use by other legislation4).
(5) The V-P driving certificate authorises the driving of vehicles covered by a specific legislature (m3) in the category of military combat vehicles or military special vehicles, provided that they are built on a belt chassis and that no further authorisation is prescribed for their use by other legislation4).
(6) The V- Z group driving certificate authorises the driving of vehicles covered by specific legislation (m2) in category S - working machinery and R - other vehicles and special legislation (m3) in category military special vehicles, with the exception of those referred to in paragraph 2 (b), provided that they are required to be operated by other legislation4).
(7) For the driving of a road combination consisting of a motor vehicle as defined in paragraph 6 and a trailer with a maximum permissible mass exceeding 750 kg, the driver shall hold the corresponding category of driving licence in accordance with the special legislation1).
Conditions for teaching, training and testing for certification to drive vehicles of the armed forces
(1) The training of drivers to obtain individual categories of driving certificates shall take the form of basic training or improvement training in driving schools operated by the Ministry of Defence or in military training facilities (hereinafter referred to as training facilities). The combination of several groups of driving certificates can be obtained in the framework of joint teaching and training.
(2) The training of drivers to obtain individual categories of driving certificates shall be organised according to the needs of the armed forces and in accordance with the professional assignment of a soldier in active duty ("soldier ') or in accordance with the assignment of a civil servant to a post.
(1) Training and certification training are aimed at legislation and internal regulatory acts governing the use of vehicles, vehicle control and maintenance, driving theory and safe driving principles, practical training in vehicle control and maintenance with a view to carrying out the tasks of the armed forces.
(2) Before commencing practical training in the driving of a vehicle of the armed forces, the driver shall be familiar with the control, operation and driving technique of the vehicle of the armed forces at which he will conduct the driving training.
(1) The training of drivers to obtain a driving certificate is organised, managed and trained by the person holding:
(a) professional certification5) to the extent appropriate to the different groups of driving certificates and teaching subjects; in preparation for obtaining a certificate to drive a group of military combat vehicles of a belt range of at least B1) driving licences and in preparation for obtaining a certificate to drive a group of military combat vehicles of at least C1) driving licences; and
(b) a certificate for driving the group concerned and for practical training in driving the vehicle trained on the vehicle.
(2) In addition to the conditions laid down in paragraph 1, a military combat vehicle management teacher shall be eligible for the organisation and conduct of training in the control, maintenance and operation of military combat vehicles.
(1) The training of drivers to obtain a driving certificate shall be completed by an examination which the driver shall submit to within 1 month of the date of completion of the preparation.
(2) The test for obtaining a driving certificate consists of a part of:
(a) a theoretical examination of the knowledge of the legislation and internal normative acts governing the use, control and maintenance of the vehicle; is carried out by a test or orally; and
(b) a practical examination of management and maintenance skills; is carried out on a vehicle of a category corresponding to the group concerned.
(3) In the group driving test
(a) V-B + E, V-C + E or V-D + E by the holder of a certificate to drive group V-B, V-C or V-D shall be tested only in accordance with paragraph 2 (b);
(b) The test shall be carried out only in accordance with paragraph 2 (a).
(4) The result of the test shall be assessed by "benefit 'or" benefit'. If the driver has been assessed in a part of the test with a "no good 'grade, he may repeat that part of the test not more than twice. Each repeated part of the test may be carried out not earlier than 5 working days, but not more than 3 months after the date of that part of the first test, at which the driver was assessed as" not successful'.
(5) After successful passing of the test, a driving certificate shall be issued to the driver indicating the group concerned. The driving certificate shall be 54 x 86 mm. The model of the driving certificate is set out in Annex 1 to this Regulation.
(6) If the driver is a holder of the relevant category of driving licence under the special legislation (1) and successfully passed the test to obtain the certificate to drive the group:
(a) VA shall also be issued a certificate for the management of the V-AM group,
(b) V-H shall also be issued a certificate for the management of the V-AM group,
(c) V- B shall also be issued a certificate for the management of groups V- H, V- T, V- AM and V- B + E,
(d) V- C or V- C + E shall also be issued a certificate to drive groups V- B, V- B + E, V- H, V- T and V- AM,
(e) V- D shall also be issued a certificate for the management of groups V- H, V- T, V- AM and V- D + E,
(f) VK shall also be issued a certificate for the management of the V- H, V- T and V- AM groups,
(g) V- Z shall also be issued a certificate for the management of the V- H and V- AM groups; and
h) VK shall also be issued a certificate for the management of the V-C group, only if practical management training for the V-K group has been increased by half and the increase has been carried out on the relevant military security vehicle.
(7) If the driver is in possession of a specified authorisation under a special legislation (4) and has successfully passed the test to obtain a certificate for driving group V- B, V- C, V- D, V- T, V- K or V-P, he shall also be issued a driving certificate for group V- Z.
Qualification requirements and competence of a military order service teacher and a military order service member
A soldier holding a category B1 driving licence may be a military order service teacher (hereinafter referred to as "the teacher '), have received basic training for teachers and passed the prescribed examination successfully. The basic training of the teacher shall be carried out by a training establishment focusing on:
(a) legislation and internal regulatory acts governing the conditions of use of vehicles on the road;
(b) the organisation and methodology of training of members of the military order service;
(c) teaching principles and methodological procedures for teaching and training; and
(d) practical training in road traffic management.
(1) The basic training of the teacher is completed by examination before the Committee of Training Devices. The examination shall be carried out no later than 1 month after the date of completion of the basic training.
(2) The test consists of:
(a) a theoretical examination of the knowledge of legislation and internal normative acts; and
(b) a practical examination of the skills in the management and organisation of road traffic teaching and management.
(3) The result of the test shall be assessed by "benefit 'or" benefit'. If the teacher has been assessed in some part of the examination by "failed ', he may only repeat that part once. The repeated part of the examination may be carried out not earlier than 5 working days, but not more than 3 months after the date of the first part of the examination, at which the teacher was assessed as" not successful'.
(4) After a successful examination, the teacher shall be issued a military order service teacher's licence with a period of validity of 5 years. The validity of a military order service teacher's licence may be extended for a further period of 5 years after the examination referred to in paragraphs 2 and 3.
(5) The licence of the military order service teacher is 105 x 74 mm. The model of the Master Certificate of Military Order Service is set out in Annex 2 to this Order.
(1) Only a soldier holding a driving licence of at least category A1 or B11 may be a member of a military order service, has received basic training of a military order service member and has successfully passed an exam of a military order service member.
(2) The basic training of members of the military order service is organized by commanders of military services, commanders of military rescue services or by chiefs of military facilities of the armed forces of the Czech Republic. Theoretical and practical teaching is carried out by military order teachers.
(3) The content of the basic training of a member of military order service is aimed at:
(a) legislation and internal regulatory acts governing the conditions of use of vehicles on the road;
(b) the rights and obligations of a military orderly service in the management of road traffic; and
(c) practical training in road traffic management.
(4) Basic training shall be carried out within 30 hours.
(1) The basic training of a member of the military order service shall be completed by an examination before a commission appointed by the master. The examination shall be carried out no later than 1 month after the date of completion of the basic training.
(2) The test consists of:
(a) a theoretical examination of the knowledge of legislation and internal normative acts; and
(b) a practical examination of the road traffic management skills.
(3) The result of the test shall be assessed by "benefit 'or" benefit'. If a member of a military order service has been assessed "failed 'in one part of the test, he may only repeat that part once. The repeated part of the test may be carried out not earlier than 5 working days, but no more than 3 months after the date of that part of the first test in which the member of the military order service has been assessed as" failed'.
(4) Upon successful completion of the examination, a member of the military order service shall be issued a military order service licence with a period of validity of 5 years. The licence of a military ordered officer may be extended for a further period of 5 years after the examination referred to in paragraphs 2 and 3.
(5) The licence of a member of a military order service is 105 x 74 mm. The model of the licence of a member of the military order service is set out in Annex 3 to this Order.
Scope of professional competence and licence of the Military Test Commissioner for Drivers
(1) Only a member of the Military Police who holds a driving licence of a group or a sub-group for at least 5 years, to which the applicant for the driving licence of the group or sub-group concerned and the driver for the driving certificate will be entitled to be tested, holds a professional certificate (5), has received training for the military test commissioner of drivers and has passed the prescribed test.
(2) Basic training for the military pilot-in-command of drivers shall be carried out by a training facility focusing on knowledge:
(a) road traffic legislation, related and internal regulatory acts;
(b) the construction, control and maintenance of the vehicle;
(c) the foundations of psychology and pedagogy,
(d) the methodology for teaching and training applicants for driving licences;
(e) medical training;
(f) the content of teaching and practical training; and
(g) the methodology for organising the tests to obtain a driving licence and a driving certificate.
(3) The basic training of the military test chief of drivers referred to in paragraph 2 shall be carried out within a range of at least 60 hours.
(4) The basic training of the Military Test Commissioner of Drivers shall be completed by an examination before a committee of training equipment of which at least one member is a member of the Military Police. A member of the Examination Board may also be an authorised official of the Ministry of Transport. The examination shall be carried out no later than 1 month after completion of the basic training.
(5) The test consists of a part of:
(a) a theoretical examination of the knowledge of road traffic legislation and medical training, internal normative acts governing road traffic conditions, regulations related to road traffic legislation, testing of road traffic legislation and regulations related to vehicle control and maintenance and testing of vehicle control and maintenance, management theory and safe driving principles; and
(b) a practical examination of the practical control skills of the vehicle of the group or subgroup of driving licences concerned and of the practical driving test with the training vehicle.
(6) The result of the test shall be assessed by "benefit 'or" benefit'. If a military pilot-in-command of drivers has been assessed "failed 'in a part of the test, he may only repeat that part once. The repeated part of the test may be carried out not earlier than 5 working days, but no more than 3 months after the date of that part of the first test, in which the military examiner was assessed as" failed'.
(7) After the successful completion of the test, the licence of the Military Test Commissioner of Drivers shall be issued for a period of 5 years. The licence of the Military Test Commissioner of Drivers may be extended for a further period of 3 years after completion of the training and test.
(8) Improvement training for the military pilot-in-command of drivers and its examination shall be carried out by the training equipment to the half-extent provided for in paragraph 3 and under the conditions laid down in paragraphs 4 to 6.
(9) The licence shall be a four-sided form of 150 x 108 mm, comprising the name, surname and date of birth of the holder, the scope of the licence to carry out tests on drivers for certification of driving, the number of the stamp, the series and the licence number, the date of issue (extension) and its duration. The model of the licence of the Military Test Commissioner for Drivers is set out in Annex 4 to this Decree.
Common provisions on the entry of data in the driving certificate, the military law school teacher's licence, the military law enforcement officer's licence and the driver's test chief's licence
The data shall always be entered in the driving certificate, the military order service teacher's licence, the military order service member's licence and the driver's military test commissioner's licence in black ink on the computer printer or typewriter. The entry in the box "Other records' may also be made by means of a black or blue pen legibly. The signature of the authorised person issuing or extending the certificate of driving, the licence of a military officer, the licence of a military officer and the licence of a military examiner shall be carried out by means of a black or blue ink pen and shall be endorsed by the stamp.
Transitional provisions
(1) The holder of a certificate of completion of a military order service teacher course issued before the date of entry into force of this Order is required to submit a valid certificate of completion of a military order teacher course and a valid driving licence with a minimum category B1 licence to the competent training establishment within one year of the date of entry into force of this Order. The training establishment shall issue a certificate of military order teacher on the basis of the documents provided. If they fail to comply with this obligation, the current certificate of completion of the course of the military order service teacher will expire on the expiry of the last day of the period set for the communication of data and documentary evidence.
(2) Military driving licences issued before the date of entry into force of this decree are considered to be a certificate for driving pursuant to § 37 (2) of Act No. 219 / 1999 Coll., on the Armed Forces of the Czech Republic, as amended. Military police shall exchange a military driving licence for a driving licence on the basis of an application submitted in case of extension of the driving certificate for another group and in case of loss, impairment or theft of a military driving licence, change of personal data and in other justified cases.
(3) At the latest one year after the date of entry into force of this Decree, the Military Examination Commissioner of Drivers may submit a request to the Military Police for an exchange of the licence of the Military Examination Commissioner of Drivers issued before the date of entry into force of this Decree. If they do not do so, the current licence of the military examiner shall cease to be valid on the expiry of the last day of the period prescribed for the application.
Repeal
Decree No. 277 / 1999 Coll., determining the scope of the preparation of drivers of vehicles of the armed forces of the Czech Republic, the qualification requirements of the military test commissioner of drivers and the models of the military driving licence and the licence of the military test commissioner of drivers, shall be deleted.
Efficacy
This Decree shall take effect on 1 January 2007.
