DECLARATION
of 23 November 2004
on the marking and passports of dogs, cats and ferrets in their non-commercial movements and amending Decree No. 296 / 2003 Coll., on animal health and protection, on the movement and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities
The Ministry of Agriculture provides pursuant to § 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll. and Act No. 316 / 2004 Coll., ("the Act ') for the implementation of Sections 4 (1) (g) and 6 (9) of the Act:
MARKING AND PASSPORTS OF DOGS, CATCHES AND FREQUENCY IN INTERESTED ANIMALS IN THEIR NON-COMMERCIAL TRANSPORT
Subject matter
This decree (1) regulates following the directly applicable rules of the European Community2)
(a) the labelling of pet dogs, cats and ferrets ("pet animal") in their non-commercial movements (3);
(b) the method of issuing and numbering passports (4) of pet animals;
(c) keeping records of pet passports and model of pet passport.
Movement of pet animals
(1) Pets older than three months may be moved,
(a) if marked (5) by means of identification provided for directly applicable European Communities Regulation (6); and
(b) if they are accompanied by a passport issued by a private veterinarian complying with the requirements laid down in the directly applicable Regulation of the European Communities for the purpose of carrying out a serological test demonstrating the antibody titre against rabies (8) and approved for that activity in accordance with Article 49 (1) (h) (4) of the Law by the Regional Veterinary Administration (the "approved veterinarian"), in particular where vaccination or re-vaccination of an animal against rabies is confirmed.
(2) Pets less than three months old which are not vaccinated against rabies may be moved from the territory of other Member States of the European Union to the territory of the Czech Republic if the conditions laid down in the directly applicable European Communities Regulation (9) are met.
Labelling of pet animals by tattoos and electronic chip
(1) The labelling of pet animals and the marking of pet animals by electronic chipe11) shall be carried out by a private veterinarian or a person competent under Article 59 of the Act.
(2) A clear and legible tattoo of the pet animal must be carried out in accordance with the animal welfare rules (12).
(3) Prior to the identification of the pet animal by tattoo, parts of the tattoo pliers that come into contact with the animal's tissues and instead of the tattoo must be disinfected.
Passports and their records
(1) Person authorised by the Ministry of Agriculture pursuant to § 44 (1) (h) of the Act
(a) keep a database on the assigned passports of pet animals; and
(b) assigns a registration number of 13) passports.
(2) The registration number contains:
(a) in the first two places the letters "CZ,"
(b) at the following locations a maximum of 15 digit alphanumeric code.
(3) The data provided by an approved veterinarian shall be the basis for keeping a register of passports of pet animals, including:
(a) the name and, where applicable, the name and surname, the address of the place of residence of the owner of the pet animal and, where applicable, the residence of the owner of the pet animal abroad;
(b) the means of identification of the pet animal;
(c) the passport registration number; and
(d) details of pet animals - their species, breed, date of birth, sex, colour.
(1) The owner of the pet animal shall transmit to the person referred to in Article 4 (1) information on the death or killing of the pet animal, the change in his place of residence or, where appropriate, his residence abroad and the change in the person of the owner of the pet animal, indicating:
(a) passport registration number;
(b) the date on which the death or killing of the pet animal took place or the change in the person of the owner of the pet animal;
(c) the name and, where applicable, the name, address of the place of permanent residence and, where appropriate, the place of residence of the new owner of the pet animal;
(d) the change in the place of permanent residence or, where appropriate, the stay abroad of the owner of the pet animal.
(2) The report on the mortality or killing of the pet animal, the change in the place of residence or, where applicable, the stay abroad, or the change in the person of the owner of the pet animal shall be transmitted by the owner of the pet animal within 7 days of the date on which the death, death, death, change in the place of residence or, where applicable, stay abroad, or change in the person of the pet animal owner.
(1) The passport shall be issued in accordance with the provisions directly applicable to the European Community7) by an approved veterinarian, who has access to the Internet.
(2) The approved veterinarian shall keep a record of passports issued by him for six years.
(3) Sample 15) of the pet passport is set out in the Annex.
EFFECTIVE
This Decree shall take effect on the date of its publication, except for Article 7, which shall take effect on 1 January 2005.

1) It is issued on the basis and within the limits of the law, the content of which allows the relevant provisions of the European Communities to be incorporated by decree.
