GOVERNMENT REGULATION
of 4 February 2004
fixing quantitative restrictions on exports of cereals and cereal products from the Czech Republic
The Government mandates pursuant to § 65 (a), § 69 (2) and § 70 (2) of Act No. 62 / 2000 Coll., on certain export or import measures and on licensing and amending certain laws:
§ 1
(1) Cereals and cereal products listed in Annex 1 to this Regulation may only be exported from the Czech Republic on the basis of a non-automatic licence.
(2) Cereals and their products, as referred to in paragraph 1, are subject to quantitative restrictions; the quantity limit is set out in Annex 1 to this Regulation for each type of cereal or product concerned.
§ 2
(1) An application for a non-automatic licence shall be submitted to the Ministry of Industry and Trade (hereinafter referred to as "the Ministry") from the day following the date of publication of this Regulation.
(2) The Ministry shall decide according to the chronological order of the requests received, the applications received on one day being considered to have been received at the same time. Non-automatic licences shall be granted until the quantity of exports of the product referred to in Annex 1 to this Regulation has been exhausted.
(3) Where applications received on the same day exceed the quantities not yet exhausted of the intended product, the requirements of individual applicants for non-automatic licences shall be met in proportion to the maximum quantity requested by the applicant concerned.
(4) Non-automatic licences shall be granted for the period from the date of entry into force of this Regulation until 30 April 2004. The original of the licence shall be presented to the customs office when the products are exported.
§ 3
The model of application for a non-automatic licence is set out in Annex 2 to this Regulation.
§ 4
(1) This Regulation shall enter into force on the day of its publication.
(2) This Regulation shall expire on 30 April 2004.
