THE LAW
of 29 January 2002
amending Act No. 44 / 1988 Coll., on the Protection and Use of Mineral Wealth (Mining Act), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 44 / 1988 Coll., on the Protection and Use of Mineral Wealth (Mining Act), as amended by Act No. 541 / 1991 Coll., Act No. 10 / 1993 Coll., Act No. 168 / 1993 Coll., Act No. 132 / 2000 Coll., Act No. 258 / 2000 Coll., Act No. 366 / 2000 Coll. and Act No. 315 / 2001 Coll., is amended as follows:
1. In Paragraph 35, the following paragraph 2 is inserted after paragraph 1:
"(2) The old mine is also an abandoned quarry after mining of reserved minerals, the original operator or his legal successor does not exist or is not known. '
Paragraphs 2 to 5 shall be renumbered paragraphs 3 to 6.
2. In Article 35, the following paragraph 6 is inserted after paragraph 5:
"(6) The Ministry of the Environment of the Czech Republic ensures, to the extent necessary, the disposal of the old mining works referred to in paragraphs 1 and 2, provided that the existence of such works prevents further development of the territory and complies with the territorial plan of the large territorial unit. In other cases, the Ministry of the Environment of the Czech Republic will decide whether this has occurred in agreement with the Ministry of Local Development of the Czech Republic and the Ministry of Industry and Trade of the Czech Republic."
Paragraph 6 shall become paragraph 7.
Efficacy
This Act shall take effect on the day of its publication.
