of 11 March 1999
amending Act No. 54 / 1956 Coll., on sickness insurance of workers, as amended, Act No. 32 / 1957 Coll., on sickness care in the armed forces, as amended, and Act No. 88 / 1968 Coll., on extended maternity leave, on maternity benefits and on allowances for children from sickness insurance, as amended
Parliament has decided on this law of the Czech Republic:
Amendment to Act No. 54 / 1956 Coll., on Staff Health Insurance, as amended

1. Paragraph 17 (1) reads as follows:
"(1) The sickness insurance shall be determined on the basis of the daily assessment basis established in accordance with Paragraph 18."
2. Paragraph 17 (3) reads as follows:
"(3) The amount of sick leave per calendar day shall be rounded up to the full crown."
3. In Paragraph 18, the following paragraphs 8 and 9 are inserted after paragraph 7:
"(8) If the daily measurement basis calculated according to the previous paragraphs exceeds CZK 360, the amount of CZK 360 is calculated in full, 60% is calculated from the amount above CZK 360 to CZK 540 and no account is taken of the amount exceeding CZK 540.
(9) The amount of the daily measurement basis shall be rounded up to the full crown. If the daily measurement base exceeds 360 CZK, it shall be rounded up after adjustment according to paragraph 8. "
Paragraphs 8 to 10 shall be renumbered paragraphs 10 to 12.
4. the fourth part, including the title and footnote 12, shall read:
IMPLEMENTATION OF THE DETERMINATION BASIS
(1) The Government shall, by regulation of 1 January, increase the amounts referred to in Article 18 (8) and (9), or the amounts referred to in Article 18 (8) and (9), as last amended by the Government Regulation, by the Government Regulation, if the conversion rate for the adjustment of the general assessment basisfor the purposes of pensions (12) is greater than 1; the increase shall be fixed by multiplying those amounts by the coefficient shown in the part of the sentence before the semicolon and the resulting amounts rounded up to the nearest 10 krone.
(2) The amount of sickness insurance benefits to which entitlement arose before 1 January of the calendar year from which the amounts referred to in Article 18 (8) and (9) were last increased and that entitlement is maintained at least on that date shall be adjusted without application from that date, according to the new amount of those amounts.

In Act No. 32 / 1957 Coll., on Disability Care in the Armed Forces, as amended by Act No. 58 / 1964 Coll., Act No. 87 / 1968 Coll., Legislative measure of the Bureau of the Federal Assembly No. 8 / 1982 Coll., Act No. 109 / 1984 Coll., Act No. 180 / 1990 Coll., Act No. 37 / 1993 Coll., Act No. 308 / 1993 Coll., Act No. 182 / 1994 Coll., Act No. 118 / 1995 Coll. and Act No. 113 / 1997 Coll., § 17 including footnote 1), the following:
(1) The sickness allowance is determined on the average amount per calendar day of the monthly salary due at the time of incapacity for service. If the amount shown in the previous sentence exceeds CZK 360, the amount of CZK 360 is calculated in full, 60% is calculated from the amount above CZK 360 to CZK 540 and no account is taken of the amount exceeding CZK 540; The resulting amount shall be rounded up to the whole crown, with the amount exceeding the amount referred to in the first sentence being 360 CZK, until it has been adjusted according to the part of the sentence before the semicolon.
(2) The Government shall, by regulation of 1 January, increase the amounts referred to in paragraph 1 or the amounts referred to in paragraph 1 as last increased by the Government's regulation, provided that the conversion rate for adjusting the general assessment base for the purposes of pensions (1), as last established by the Government's regulation, is greater than 1; the increase shall be fixed by multiplying those amounts by the coefficient indicated in the part of the sentence before the semicolon and the resulting amounts shall be rounded up to the nearest ten crowns.
(3) The amount of sickness benefit to which entitlement was acquired before 1 January of the calendar year from which the amounts referred to in paragraph 1 were last increased and that entitlement is maintained at least on that date shall be adjusted without application from that date on the basis of the new amounts.
(4) The amount of sick leave per calendar day is rounded up to the full crown.

Transitional provision
The amount of sickness, maternity aid (cash aid), assistance for the care of a member of the family and compensation allowance for pregnancy and maternity, to which entitlement was established before 1 October 1999 and which continues after 30 September 1999, shall be adjusted without application as from 1 October 1999 under this Law; However, after 30 September 1999 the amount of such benefits may not be less than the amount fixed in accordance with the rules in force on 30 September 1999.
Efficacy
This Act shall take effect on 1 October 1999.
