laying down details of lotteries and other similar games
The Ministry of Finance of the Czech Socialist Republic provides pursuant to § 19 paragraph 2 of the Act of the Czech National Council No. 37 / 1973 Coll., on public collections and on lotteries and other similar games:
Purpose and conditions of lotteries and other similar games
(1) Lottery and other similar games (hereinafter referred to as "lotteries") are authorised to cover the costs of actions the purpose of which is to benefit the public and whose costs cannot be covered by the organisation's budgetary resources.
(2) Lottery is operated according to a game plan which contains, in addition to the formalities laid down in Section 2 (4) of the Act, information on:
(a) the amount of the individual bet, ticket price, etc.;
(b) the number of tickets issued or the determination of the total amount of deposits (bets) or, where applicable, the number of lots issued;
(c) the number of winnings, their individual and aggregate price, or, where applicable, the amount of winnings and their aggregate price, and the proportion of winnings to the total amount of deposits received (bets);
(d) the way in which the composition is carried out and, where appropriate, the circumstances determining the winning event;
(e) the way in which the lottery results are notified and the place where the winning instrument can be obtained;
(f) the issue of wins and the latest date for their collection;
(g) the arrangements for supervising the operation of the lottery;
(h) other necessary conditions according to the type of lottery.
(1) The circumstances which determine the win (the result of the composition, sports match, races, races and other future events) must not be known to anyone in advance and must be such that the events or circumstances which determine the win cannot be influenced by the organiser or betting party. If a win is decided by a circumstance or event that cannot be checked at any time (e.g. composition), it must always be ascertained under the cooperation of the state notary, unless it is ascertained by a representative of the supervisory authority. It is not allowed for another lottery to decide on winning, including foreign lotteries.
(2) The number of lots to be issued, their individual price and the total gaming principal shall be fixed in such a way that the planned net proceeds of the lottery do not exceed the amount of economically justified expenditure needed to meet the purpose of the lottery.
(3) The aggregate winning price, except for the lotteries listed in § 3 and the raffle, must not be less than 20% and not more than 50% of the game principal.
Lottery lots in kind to promote the collection of raw materials shall be issued only as a consideration of the raw materials surrendered and shall not be sold for money. The total value of winnings shall be equal to the gambling principal minus the planned costs associated with the implementation of the lottery and its promotion and, where appropriate, additional costs needed. Any surplus may only be used by organisations to further promote the collection of raw materials, or for purposes to be agreed by the authority which authorised the lottery.
(1) The winnings paid in respect of cash in kind must not exceed 100 CZK.
(2) Issue of authorisation to operate lotteries is subject to administrative level.1)
Authorisation of lotteries
Before authorising the lottery, the competent authority of the state administration shall:
(a) whether it is ensured that the financial reimbursement of the costs associated with the implementation of the action is secured mainly by the own funds of the organisation requesting the authorisation of the lottery and whether the authorisation of the lottery will allow only the financing of an unsecured deficit;
(b) whether the implementation of the action to which the proceeds of the lottery are to be secured belongs to the tasks of the organisation applying for the authorisation and where effective and economical use of the proceeds is guaranteed.
In the case of raffle held by local components of social organisations during festivities and entertainment, where winnings are mainly subsidised by gifts in kind of membership, the national committee responsible shall exceptionally decide on the authorisation at its discretion and local level.
Cannot allow a lottery whose purpose is to cover
(a) ordinary administrative or expenditure to be covered by current revenue, by their nature;
(b) expenditure on the organisation of festivities, entertainment and similar events at which no admission fee is levied or whose costs are in a clear disproportion to the intended amount of admission,
(c) the costs of any action, if the provisional budgets already show ineconomy both in the organisation of the lottery and in the planned use of its revenue.
The decision to authorise the lottery shall include, in addition to the particulars of the decisions laid down in the administrative rules: 2)
(a) the purpose for which the lottery was authorised;
(b) the number of tickets issued, their price and the total amount of the game principal;
(c) the number and total price of wins;
(d) place and date of composition;
(e) the time limits for submitting the bill of account and the proceeds of the action for which the lottery has been authorised for security;
(f) the designation of the authority responsible for supervision.
Implementation of lotteries
(1) Only tickets printed by the State Printer of Prizes in Prague can be drawn for lotteries with a gambling security above 10,000 CZK.
(2) For raffle and in-kind lotteries up to 10 000 CZK, lots or otherwise named saleable papers may be drawn up if they are numbered and stamped by the organisation and the approval of which has been given by the administration authorised to authorise the lottery.
The tickets with the game principal above 10,000 CZK must contain
(a) the name and address of the lottery organiser;
(b) the number of tickets issued and their price or indication of the total amount of deposits (bets);
(c) the number and price of wins and, where appropriate, how to determine the number of wins;
(d) the manner, place and date of the composition and, where appropriate, the determination of the circumstances determining the win;
(e) the number and date of the authorisation decision;
(f) an indication of how and where winnings will be announced,
(g) identification of the place where the winnings are issued;
(h) the time limit by which the winnings must be collected.
(1) The text of the lots is subject to the approval of the supervisory authority; the use of the national character on lots is not allowed.
(2) Before issuing the lots and before starting the sale, at least the number and correct numbering of the lots shall be tested at random in the presence of the supervisory authority.
The composition shall be made available to the public. Lottery compilation
(a) with a game principal exceeding 10 000 CZK must be performed with the presence of a notary certifying the compilation protocol;
(b) with a game principal of up to 10 000 CZK, it shall be carried out with the participation of a representative of the supervisory authority certifying the compilation protocol.
(1) The numbers of all tickets issued, whether sold or not, shall be included in the drawing; for raffle, only the numbers of tickets sold (composite papers) are taken. The Loyalty Commission (Loyrepresentative), together with the representative of the supervisory authority, is required to check whether the numbers of all issued (sold) tickets have been inserted into the pool.
(2) They must be secured and preserved in sealed packages in a suitable and safe place by unsold tickets. At the same time, provision must be made to ensure that tickets which are returned by post or other means and which arrive just before, after or after the draw cannot be misused.
(1) Upon completion of the draw, the lodger commission (the lodger representative) will identify the winnings that fall on the tickets not sold.
(2) The Lowest Commission (Lowest Representative) will draw up a report on the course of the composition, containing in particular information on the technical drawing procedure and the list of winning lottery numbers.
(3) The Loyalty Commission (Loyrepresentative) is required to ensure the issuance of the winning hand by printing and to inform the public.
Lottery billing
The Loyalty Committee (Loyrepresentative) shall ensure that the lottery bill is collected no later than 30 days after the end of the deadline; ensure, at the same time, a bill of account for an event for which the lottery has been authorised; if, even on that date, all issues for which the lottery has been authorised have not yet been covered by the proceeds, further billing shall be drawn up no later than the end of the current year. The organisation shall submit a bill report to the authority responsible for supervising the operation of the lottery and in the copy of the authority which authorised the lottery.
(1) Lottery income also includes winnings belonging to unsold tickets and winnings which have not been collected within the specified time limit.
(2) The use of any excess lottery that has not been consumed for the purpose for which the lottery was authorised shall be decided by the government authority which authorised the lottery.
Efficacy
This Decree shall take effect on 1 July 1973.
