Government Regulation
of 30 June 1953
about ID cards.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42 paragraph 1 of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
Obligation to have an ID.
Citizens of the Czechoslovak Republic who are resident in its territory and have reached the age of 15 are required to have a card; The Minister for National Security is hereby authorised to provide for exemptions for certain groups of persons.
ID.
A citizen's card is a document by which a citizen can prove his identity in the territory of the Czechoslovak Republic, Czechoslovak citizenship and other legal facts written on the ID card.
Period of validity.
(1) Citizenship cards shall be issued on the basis of the documents provided for, in principle, for a period of 5 years.
(2) A temporary identity card with a shorter period of validity shall be issued to citizens who cannot submit all the documents provided for.
(3) Citizens over 55 years of age may be issued with no validity limit.
Registration.
(1) Local national committees shall enter in their identity card:
(a) a citizen's application for permanent or temporary residence and a permanent residence check in municipalities where local national committees are reporting authorities;
(b) details of the conclusion of marriage, divorce, widowing, birth and death of the child, if these events occurred after the issue of the identity card.
(2) The management of enterprises, offices and bodies of state administration, institutions and organisations enter employment data on their identity card.
(3) The District Department of Public Security shall enter in the identity card:
(a) a citizen's application for permanent or temporary residence and a permanent residence check in municipalities where they are intended to do so under special rules;
(b) details of the facts referred to in paragraph 1 (b), where such facts occurred before the issue of the identity card, and other information to be provided by the Minister for National Security.
Power of proof.
(1) The entries in the identity card replace the certificates of citizenship, the birth certificate, the permanent or temporary residence application, the permanent residence certificate, the marriage certificate and the birth certificate of the spouse and children under 15 years of age.
(2) The entries referred to in Article 4 (2) are a citizen's employment document.
(3) The entries on the temporary identity card replace the documents contained therein.
Citizen duty.
A citizen with an identity card shall:
(a) carry a permanent identity card and prove myself to the authorities empowered to do so;
(b) protect the identity card from theft, loss, damage or destruction;
(c) ensure that entries in the ID correspond to the facts;
(d) submit the identity card before expiry of the period of validity for extension.
Issue of identity cards.
The ID is issued by the district public security department, in whose district the citizen is resident, to replace the purchase costs.
Implementing regulations.
The Ministry of National Security shall, in agreement with the participating central authorities, issue more detailed provisions for the implementation of this Regulation.
Criminal provisions.
(1) Who
(a) fails to fulfil the obligation to prove with a citizen's card;
(b) use a foreign identity card;
(c) destroy or damage the identity card by degrading it;
(d) does not take into account the fact that entries in the identity card,
(e) fails to comply with any other obligation imposed by the rules on civil ID;
(f) fails to comply with the obligation imposed by the regulations on reporting of citizens or reporting of foreigners;
he will be punished for the offence by a fine of up to 200 ccs.
(2) No alternative custodial sentence may be imposed for an immaterial fine.
(3) If the District Department of Public Security is to be punished more severely, it shall refer the matter to the prosecutor.
The infringement proceedings referred to in Section 9 shall be held in the first storehouse by the district public security department. The Regional Public Security Administration decides on the appeal against the decision of the District Department of Public Security.
(1) Unless otherwise provided for in this Regulation, the provisions of the Administrative and Criminal Code of the Administrative Code shall apply mutatis mutandis to the prosecution of the offences referred to in Article 9.
(2) The authority to impose fines in block proceedings is granted by the Minister for National Security and provides details of such proceedings.
Civil ID cards up until now.
The existing identity cards shall remain valid unless they are gradually replaced by new ones; The provisions of this Regulation shall apply to them mutatis mutandis.
Final provisions.
The provisions which contravene this Regulation, in particular Act No. 198 / 1948 Coll., on Civil Documents, and the provisions issued pursuant thereto, shall be repealed.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for National Security in agreement with the participating members of the Government.
