GOVERNMENT REGULATION
of 27 October 2004
delimiting the Bird Region of Bohdany Pond
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
§ 1
Subject matter
(1) The birds' zone of Bohdany Pond (hereinafter referred to as the bird area) is defined.
(2) The object of the protection of the bird area is the population of the cropseed (Porzana porzana) and its biotope.
(3) The aim of the protection of the bird region is to preserve and restore the ecosystems relevant to the bird species referred to in paragraph 2 in its natural area of extension and to ensure conditions for the conservation of the stock of that species in a favourable conservation situation.
§ 2
Definition of bird area
(1) The birds' area is located in the Pardubice region, in the cadastral territory of the Bohdaneč Spa.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 10 000 map documents, in which the territory of the bird aredrawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Nature Protection Board, the Regional Office of the Pardubice Region and the municipal authorities of the enlarged municipalities in whose administrative district the bird area is located.
§ 3
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) can the birds' area, outside the territory of the national nature reserve,
(a) remove lithoral crops;
(b) to enter the lithoral crops of ponds between 1 April and 31 July, except for owners and tenants of land and hunting for the purpose of caring for released ducks;
(c) the establishment of non-commercial poultry farming;
(d) to discharge artificially reared ducks;
(e) to change the water level on ponds from 1 April to 31 July by more than 20 cm within a period of less than 14 days;
(f) carry out activities causing a change in the level of established surface and groundwater levels which could cause a change in the biotope of the species for which the bird area is established;
(g) to carry out field treatments.
(2) Prior consent of the competent nature conservation authority is not required
(a) the activities referred to in paragraph 1 (f), in the case of a procedure in accordance with the waterworks handling rules (3);
(b) the activity referred to in paragraph 1 (e) in the event of a flood, emergency or exceptional climate situation.
§ 4
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Birds' Region of Bohdany Pond
The border of the birds' area of Bohdanek pond is situated in the cadastral territory of the Lázně Bohdaneč) leads from the west edge of the dam to the outer border of the parcel No 1599 (crown of the side dam of the pond) in the north direction to the quarry point, which is formed by the south side of the bridge at the pumping station of the water and the end of the canal coming from the east. From there, it continues in the eastern direction along the southern edge of this channel approximately 400 m, where the right (northern) bank of the water stream Hlavnik crosses. Against its current it leads to the point where the Main is separating itself from the canal flowing east-west and returning on the left (southern) bank. In a section of 50 m long, there is a parcel No 1616 along the eastern border. It then passes on parcel No 1637 / 2 and leads along its eastern border in a southern direction until it meets parcel No 1637 / 5. Following its north edge it leads southeast, then passes to the north edge of plot No 1645 and continues in the southeast direction until it touches the west border of plot No 1646. Following it leads north about 90 metres to the south border of the canal (plot No 1641 / 23). Following the southern border of this parcel, it leads first in the southeast and later in the south direction to the point where it touches the southeast point of plot No 1659 / 3 at the edge of the forest draw. On the edge of the draw, southwest towards the 220 m cubicle. From there, the east continues still along the edge of the draw to its eastern edge, where it crosses to the southern border of plot No 1657 / 3 and leads in the eastern direction along the south edge of the canal (1657 / 72). From the south-west side, plot No 1774 / 2 and 1774 / 3 pass by and reach the booth 220 m above sea level. From there it turns in a sharp angle to the northeast, overloading the road (1744 / 1) and continues 90 meters along the canal to its northern border, along which it leads to its confluence with the Opatovice Canal. From there it leads the border along the right bank of the Opatovice Canal in the southeast and then in the southwest direction to the level of the west point of the Lower Zábranské Pond (plot No 939), which passes from the west and north-west side to the border of the parcel to the point where the border of the parcel touches the unpaved path *) along the south edge of the forest (plot No 934 / 3). Following this road it leads in the western direction along the southern edge of the Bodanec pond gradually through the cubits 220,6 m above and 221,3 m above, where at the second cubicle it crosses the exit of the pond over the bridge. Behind the bridge, it turns north and follows the service path. It copies this path to the fishing gear that passes east and north. On the northwest corner of the building it passes to the southern border of parcel No 922 / 1, on which it leads west to where it touches the unpaved road (parcel No 923 / 3). On the road it leads south to the road * *), which is further copied on its north side to the starting point to the west side of the pond dam.
Explanatory notes:
*) If the text of the Annex indicates that the border of the bird's area leads along the way, it is thus stated that it leads along the edge of the route, namely the border facing into the bird's area.
* *) If the text states that the border of the bird's area leads on the road, it is expressed that it leads on the edge of the road auxiliary plot, and that it leads on the edge of the bird's area.
