DECLARATION
of 22 December 2020
amending Decree No 72 / 2005 Coll., on the provision of advisory services in schools and educational institutions, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 28 (6), § 121 (1) and § 123 (5) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 383 / 2005 Coll., Act No. 49 / 2009 Coll., Act No. 472 / 2011 Coll., Act No. 333 / 2012 Coll., Act No. 82 / 2015 Coll. and Act No. 101 / 2017 Coll.:
Decree No. 72 / 2005 Coll., on the provision of advisory services in schools and educational institutions, as amended by Decree No. 116 / 2011 Coll., Decree No. 103 / 2014 Coll., Decree No. 197 / 2016 Coll. and Decree No. 248 / 2019 Coll., is amended as follows:
1. In Article 1 (2), the words "established by the State, Region, Municipality or Municipality 'shall be inserted after the words" School institutions and schools' and the second and third sentences shall be deleted.
2. In Article 1, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) Schools and schools other than those referred to in paragraph 2 shall provide free advisory assistance to:
(a) identification of special educational needs or special talent of the pupil;
(b) the recommendations of appropriate support measures and the evaluation of the provision of support measures to pupils with special educational needs and to pupils with exceptional qualifications;
(c) recommendations for the inclusion of a pupil in a school, class, department or study group established in accordance with Paragraph 16 (9) of the Education Act or for the inclusion or transfer of a pupil into an educational programme corresponding to the educational needs of the pupil; and
(d) promoting the education of pupils with special educational needs and of pupils gifted in schools and schools, as well as mitigating the consequences of disadvantages and preventing them from deepening.
(4) The provision of psychological or specially educational advisory services shall be subject to the transmission of the information referred to in paragraph 5 and the written consent of the pupil or his legal representative. No agreement is required in cases provided for by other legislation1). '
Paragraphs 3 to 7 shall be renumbered paragraphs 5 to 9.
3. In Article 1, paragraphs 7 to 9 are deleted.
4. After Paragraph 1, the following Section 1a is inserted:
Consultancy services for the detection of special educational needs or special talent
(1) The advisory services of educational institutions for the purpose of identifying special educational needs or exceptional qualifications of pupils are mainly the result of a report and recommendations which are subject to other legislation4).
(2) The educational institution shall not provide a advisory service for the purpose of identifying special educational needs or exceptional talents of the pupil if the previous recommendation issued previously in force to the applicant has been issued by the same or other educational institution, except in the case referred to in the Education Order for pupils with special educational needs and pupils with qualifications (6).
(3) In addition, a school advisory institution shall issue a report whenever the advisory service consists of psychological or specific pedagogical diagnostics or a decision by a public authority. "
5. in Article 4 (1) (e), "3" is replaced by "5."
6. In Article 8 (1), the words "established by the State, the Region, the Municipality or the Union of Municipality 'shall be inserted after the words" School institutions'.
Efficacy
This Decision shall enter into force on 1 January 2021.
