GOVERNMENT REGULATION
of 27 October 2004
delimiting the Jizera Mountain Bird Region
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
§ 1
Subject matter
(1) The bird region of Jizera Mountain ("the bird region") is defined.
(2) The birds' areas are protected by the populations of tetra (Tetrao tetrix), the red cheese (Aegolius funereus) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
§ 2
Definition of bird area
(1) The bird region is situated in the territory of the Liberec Region, in the cadastral territories of Albrechtice in the Jizera Mountains, Bedřichov near Jablonec nad Nisou, White Potok pod Smrkem, Desná III, Frýdlant, Hejnice, Jizerka, Josef Mine near Jablonka nad Nisou, Spa Libverda, Oldřichov in Háje and Raspenava.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 50 000 map documents, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Jizera Mountains Administration Protected Landscape Region, the Regional Office of the Liberec Region and the municipal authorities of the enlarged municipalities whose administrative area is located.
§ 3
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of the municipalities be located in the birds' area outside the concurrently built and stoppable (3),
(a) carry out an activity causing a change in the level of the established surface and groundwater level which could cause a change in the biotope of the species for which the bird area is established;
(b) change the type of land and the means of usingit (4);
(c) maintain drainage systems on land intended to fulfil forest functions;
(d) use chemical agents for rodent control in forest management, excluding forest nurseries;
(e) define new tourist, cycling and ski tracks5).
(2) Prior consent of the competent nature conservation authority is not required for activities
(a) carried out in accordance with paragraph 1 (a), if it is carried out in accordance with approved waterworks (6);
(b) as referred to in paragraph 1 (c), in the case of the maintenance of a reinforced forest outbound road, allowing for year-round operation, or of a reinforced and unreinforced outbound road, allowing seasonal traffic.
§ 4
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Jizera Mountain Bird Region
Borders The birds' areas of the Jizera Mountains lead from the border line VI / 63 in a southeast direction to the state border with Poland (from the border line VI / 62 simultaneously through the centre of the Jizera river) to the confluence with the river Jizerka. Here it turns to the northwest, leads about 400 meters upstream of the Jizerka stream and along the forest road *) to the Panel path, on which it continues in the western direction to the Jizerka settlement. At the Pension Stará píl crosses the river Jizerku and along the local road * *) leads to a crossroads with the Jizera road near the Pansky house, on which it continues in the southeast direction to the parking lot below Bukovc. It also leads along the Promenade Road to the crossroads of U bunker, where it turns west on the Equestrian Road, on which it continues after crossing the road No II / 290 (Soušská road) and the river Black Desná to the broken dam. It crosses the White Desnou stream and along the hiking path it continues to rise in the western direction on a reinforced forest road and on the enclave of Mariánskohorské shod. From there it leads southwest along the forest road to the edge of the settlement Antonínov, where it turns north, along the forest road passes the river Jedlová and along its right bank it continues at the earliest about 150 m along the natural reserve Jedlová mine and later about 450 m along the border of its protection zone. It also connects to the Castle Road, which leads northwest towards the edge of the settlement of Hell, here it turns southwest and leads along the local road to the western edge of the village of Joseph's Mine. From there, it is headed on a reinforced forest road northwest towards the north edge of the dam of Josef's Mine and further to the village of Kristiánov, in the last section from the Great Kamenický creek, leading along the tourist path. From Kristianov, it continues in the western direction along the Kristianov Forest Road on the crossroads near the Blatná Pond, along the forest road to the Castle Nová Louka and from there it leads the Hejnicke Road on the crossroads of Clovíčky. From Cábínek he is heading north on the forest road and about 400 m before the turn of the hiking trail to the Bird Clubs he turns along the border of the forest department to the border of NPR Jizerskomountain beech. In the next part, the border of the bird area is identical to the border of the Jizerskomountain beech National Reserve (NPR) or its protection zone (OP NPR). First it leads along the NPR border to the rock massif Jizera church (cubicle 713,5 m) and continues along the NPR border to Oldřichov in Háje. It passes through the built-up territory of the municipality and alternately follows the border of the OP NPR (in the parts where it is declared) and the border of the NPR (in the parts of Sprůvá vrch and Špičák). It is also connected to the forest road, leading from the saddle at the Crest Buke, and following it continues in the north direction towards the still life grove, here it turns east and along the border of the OP NPR it continues to road No III / 2904 (Oldřichov in Háje - Raspenava). Following it leads to the turn to the Šolcov pond, after its dam and reinforced forest road to the grove Na Hraz, overloaded railway line Liberec - Frýdlant and enters the forest field, still along the border of the OP NPR. Following it he is still heading in approximately eastern direction, passing south of the village V Luky, further copying the forest border south of the village Ferdinandov, crossing the flows of Little and Big Stolpich and continuing along the forest border and the OP NPR south of Hejnice. It crosses the Black brook and the White brook and south of the village of White stream leads further along the forest border to road No II / 290 (White stream - Shift). Here he crosses the River Shed and along this road he continues to turn towards Bartla's hut. Following this Funeral Road leads north, crossing the Hájnej stream, leaving the forest road and heading west on the border of the OP NPR, where again it usually copies the forest border, overloaded the Great Fish Water stream and continues around the Hubertka cottage at the crossroads of the Cross Beech. From there it leads in the southeast direction to the peak of the Tišina (cubit 873 m). From Tišina continues on the French way to the east, further descends along the NPR border to the Hážený brook, on which he returns in the western direction. After the forest break, it rises south to the top of Paličník (booth 944 m). Here it leaves the border of NPR or OP NPR. Following a reinforced forest road, it continues to the east towards the crossroads of Na Pískiny and after a short section along the Smrková road it turns the forest path towards the Jizera flow, along which it continues to the state border.
Explanatory notes:
*) If the text of the Annex indicates that the border of the bird's area leads along the way, it is thus stated that it leads along the edge of the route, namely the border facing into the bird's area.
* *) If the text states that the border of the bird's area leads on the road, it is expressed that it leads on the edge of the road auxiliary plot, and that it leads on the edge of the bird's area.
