GOVERNMENT REGULATION
of 27 October 2004
delimiting the Birds' Region of Jaroslavická pouches
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' zone of Jaroslavická ponds (hereinafter referred to as the "bird area") is defined.
(2) The object of the protection of the bird's area is the population of the night-time yeast (Nycticorax nycticorax) and its biotope.
(3) The aim of the protection of the bird region is to preserve and restore the ecosystems relevant to the bird species referred to in paragraph 2 in its natural area of extension and to ensure conditions for the conservation of the stock of that species in a favourable conservation situation.
Definition of bird area
(1) The bird area is situated in the territory of the South Moravian Region, in the cadastral territories of Hrádek near Znojmo, Jaroslavice, Wings and Oleksovice.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 10 000 map documents, in which the territory of the bird aredrawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Regional Office of the South Moravian Region and the municipal authorities of the enlarged municipalities in whose administrative district the bird area is located.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) can the birds' area
(a) to enter the island with the night-time yeast colony between 1 April and 31 August;
(b) interfere with the crops of trees on the island with the nest colony of the night-time yeast,
(c) to remove the lithoral crops of the Lower Jaroslavic Pond and the Upper Jaroslavic Pond;
(d) to remove lithoral crops of extractors during the period 1 April to 31 July;
(e) remove the litoral stands of the extractors within 2 metres of the shore, from the side of the dam of the Lower Jaroslavic Pond, then within 4 metres of the shore,
(f) to change the water level of the Lower Jaroslavic Pond by more than 20 cm between 1 April and 31 July in a period of less than 14 days;
(g) change the water level of the Upper Jaroslavický Pond by more than 20 cm between 20 April and 31 July in a period of less than 14 days;
(h) enter the lithoral crops of ponds between 1 March and 31 July, except for owners and tenants of land and hunting for the purpose of caring for released ducks;
(i) to establish the establishment of farmed aquatic poultry,
(j) to change the type and manner of land use (3).
(2) The prior agreement of the nature conservation authority on the activities referred to in points (f) and (g) of paragraph 1 shall not be required in the event of a flood, emergency or exceptional climate situation.
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Birds' Area of Jaroslavic ponds
The southern point of the bird's area is the southern end of the main dam of the Lower Jaroslavic pond), between the objects of the poultry factory and the Fishing plant Pohořelice, a.s. From here the border continues along the outer (eastern) side of this dam to the northeast, after about 200 m behind the Object of the Půhořelice Rybnikárny, a.s., turns east and along the road *) along the south bank of the chambers (trench ponds). After about 400 m at the southeast tip of the pond system, the border passes from the road to the circumference channel and leads to the northeast along its outer (eastern) bank along the eastern edge of the extraction system to its eastern tip. From here at the right angle after reinforced communication along the north bank of the elevators about 300 m to the northwest. At the point of connection of this communication to the main (eastern) dam of the Lower Jaroslavický pond, it is slightly tilted and leads along the edge of the forest first about 400 m to the north-west, from the point of intersection in the forest still along the edge of the forest at the right bank of the river Dyje to the bridge over the road * *) No II / 397 Jaroslavice-Hrádek. Behind this bridge it leads west and northwest along the edge of the forest along the left bank of the river Dyje to the place where (about 1 km west of the village Křídloběvka) on the right bank of the river Dyje meets the cadastral boundary k. ú. Slup and Oleksovičky. At this point the border crosses the river Dyji, further along the western edge of the forest in a southern direction along the river stream to the northernmost tip of the Upper Jaroslavic Pond. From there along the outer (northwest) bank of the circumference canal along the north-west bank of this pond to its mouth into the Mlyn Crouch. They also form the border of the birds' area from the southwest side of the Mlyn Mound, along which the right bank leads in a southeast direction along the level of the Upper Jaroslavický Pond (starting with its most western tip) and the Lower Jaroslavický Pond to the poultry house. In front of it, it crosses the Mlýnská Crouch and leads southeast along the bank of the Lower Jaroslavický Pond to the south end of its main (eastern) dam.
Explanatory notes:
*) If the text of the Annex indicates that the border of the bird's area leads along the way, it is thus stated that it leads along the edge of the route, namely the border facing into the bird's area.
* *) If the text states that the border of the bird's area leads on the road, it is expressed that it leads on the edge of the road auxiliary plot, and that it leads on the edge of the bird's area.
