GOVERNMENT REGULATION
of 27 October 2004
delimiting the Bird Region of Neo Hrady
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' zone of Novohrad Mountain (hereinafter referred to as "the bird area") is defined.
(2) The protection of the bird area is the populations of the wild crane (Bonasa bonasia) and the trifinger (Picoides tridactylus) and their biotopes.
(3) The conservation of the species referred to in paragraph 2 is intended to preserve and restore ecosystems relevant to the species of those birds in their natural area of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area
(1) The bird region is situated in the territory of the South Bohemian Region in the cadastral territories of Belá u Malont, Benešov nad Černou, Lower Příbrání, Hojná Voda, Lužnice u Pohorská Vsi, Pivonice u Pohorská Vsi, Mountains in Šumava, Ratition u Malont, Old Huta u Upper Stropnice and Big Henry.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 25 000 map documents, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Regional Office of the South Bohemian Region and the municipal authorities of the municipalities with extended scope in whose administrative district the bird area is located.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2), outside the concurrently built and stoppable (3), the territory of the municipalities may be in the birds' area
(a) to draw new hiking, cycling, skiing and riding trails (4);
(b) carry out activities causing a change in the level of established surface and groundwater levels which could cause a change in the biotope of the species for which the bird area is established;
(c) maintain drainage systems on land intended to fulfil forest functions;
(d) to change the type of land and the means of usingit (5).
(2) Prior consent of the competent nature conservation authority is not required
(a) the activities referred to in paragraph 1 (b), in the case of a procedure in accordance with the waterworks control rules (6);
(b) the activities referred to in paragraph 1 (c) in the case of the maintenance of a reinforced forest outbound route, allowing for year-round operation, or forest outbound routes reinforced and unpaved, allowing seasonal operation.
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Birds' Region of Novohrad Mountains
From the village of Hojná Voda leads the border of the bird region along the forest road *) called "Lower Hospodárná" towards the east and later south to the intersection with the so-called "Lower" road, from there in a straight line to the state border, to the point where the water flow of Stropnice is diverted from the state border towards the north. The border of the bird region follows the state border towards the south, later west to the border of the k. The border of the bird region copies this border k. Ú. on the forest road "The enclosing," along this path continues north to the location "Landfill." From there, the region of the forest north across the road * *) Genova Ves- Leopoldov, further along the edge of the forest to the intersection of the forest "U 5 bullets," through the intersection of the forest road "Šveják" and from there in a northeast direction to the forest road "Unity." Following this forest road to the "Unity" grove, along the forest to the place where the Raptic stream flows from the meadows of Unity. From this point the border goes through the middle of the watercourse to the confluence with the Pokurský creek under the Ratitions. From the confluence, the border passes to the centre of the water stream Pokurský stream and leads upstream, thus towards the southeast to the Pokursky stream to the confluence with the nameless left-hand presence of Pokursky creek. At the centre of this inflow, the border leads to the bridge over road III / 158. At the bridge crosses the border to this road and leads along this road to the Pohorská village and from there further through the centre of the village along the road towards the Black Valley, Old Holland, Old Huta and Hojna Water.
Explanatory notes:
*) If the text of the Annex indicates that the border of the bird's area leads along the way, it is thus stated that it leads along the edge of the route, namely the border facing into the bird's area.
* *) If the text states that the border of the bird's area leads on the road, it is expressed that it leads on the edge of the road auxiliary plot, and that it leads on the edge of the bird's area.
