GOVERNMENT REGULATION
of 27 October 2004
defining the Giant Bird Region
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' region of Giant Mountains (hereinafter referred to as the "bird region") is defined.
(2) The protection of the birds' areas are the populations of the tetrao tetrix, the rind cheese (Aegolius funereus), the stork (Ciconia nigra), the horseshoe (Crex crex), the small lees (Fislula parva), the black date (Dryocopus martius) and the tundra nightingale (Luscinia svecica svecica) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area

(2) The territorial demarcation and description of the border of the bird area are contained in Annex 1 to this Regulation, the indicative graphical representation of the area is set out in Annex 2 to this Regulation.
(3) The map documents of the scale 1: 50 000 in which the territory of the bird region is drawn are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Krkonose National Park, the Regional Office of the Liberec Region and the Regional Office of the Králové Hradec Region and the municipal authorities of the enlarged municipalities in whose administrative district the bird area is located.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of the municipalities be located in the birds' area outside the concurrently built and stoppable (3),
(a) carry out all toll and pre-toll mining and mechanized work in the forestry activity between 15 March and 15 July at a distance of less than 500 metres from known occupied black stork nests;
(b) in the period from 1 March to 31 July, carry out tolls and pre-tolls in forest areas over 80 years of age with a beech representation of 50% or more, in forest areas over 80 years of age with less than 50% of the presence of spruce and all forest areas over 120 years of age;
c) to reposition hunting gear at a distance of less than 200 m from known nests of the black stork;
(d) to carry out tolls and pre-tolls which have not been located in an approved forest economic plan or in a taken-over forest economic curriculum.
(2) Prior consent of the competent nature conservation authority is not required
(a) measures preventing or hindering the effects of harmful factors on the forest and measures in the event of exceptional circumstances and unforeseen damage in the forest under special legislation (4);
(b) for the production referred to in paragraph 1 (d), if they have been notified at least 15 days in advance to the competent nature conservation authority and for the production not subject to notification obligations under specific legislation5).
(3) The location of known occupied nests referred to in point (a) of paragraph 1 shall be communicated in writing to the owners of the forest land concerned by the competent nature conservation authority prior to or during the limitation period of mining activities.
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Giant Mountains
From the former customs office at the state border of the Czech Republic and the Republic of Poland in the New World Pass, north of Harrachov, the border of the bird area coincides with the border of the Giant National Park (KRNAP) to the village of Paseka n. J., to the crossroads *) Planyrka and Budárek. From there he continues on the road Budárek in the eastern direction to the factory complex of EMBA, crossing the bridge over the river Jizera, going about 250 m along the local road * *) to road * * *) No. I / 14, following it continues about 100 m north direction, following the local road turning about 120 m east, continuing along a yellow marked road and turning towards the north-eastern turning point of KRNAP over Vilémov (about 250 m SV from cubit 605,5). It continues along the KRNAP border up to the upper part of the Rokytina n. J. (Location of Burning House), to cross the blue marked tourist path with the western branch of the Black Creek. Here the border of the bird region turns southwest and along the Black Creek stream continues to the Upper Rokytina, where it crosses with a yellow marked path. He continues along the border of KRNAP about 300 m towards the south, crossing the blue-marked road, turning southwest and west towards the intersection of roads south of the Upper Ves location, turning southeast along the yellow-marked road towards the Jablonec road of ing. Krejčící, leading along it in about 350 m east direction, then turning south towards the reinforced road, which continues in the southeast direction, north of the agricultural complex, to road No III / 0143 in Františkov, where he joins again on the border of KRNAP. It continues along the border of KRNAP until the northern part of the village of Jestřábí in Giant Mountains. In a place where the KRNAP border passes along a yellow-marked path, diverts the border of the bird region towards the south, goes about 100 m upstream of the left-hand stream of the Veipalice creek, crosses the northernmost point of communication of the Hawk - Roudnice, passes through the spring of the Hawk creek and along its stream heads further south to the Kakov location. At the confluence of the Hawks and Roudnický creek, it passes on a forest road, along which it leads in about 100 m south direction, where it turns and continues along a reinforced forest and field road about 600 m north-east and east. At the crossroads of the paved roads, it turns southwest, turns south on the field road and further east, passes north of the agricultural complex U Kalenský, where it follows the north-south communication no. III / 28620 Roudnice - Hrabachev and at the same time the border of KRNAP. It continues along the KRNAP border to road No II / 286 northeast of Hrabachov. Here, the border of the bird region turns southwest, along road II / 286 continues to cross with the Hatina stream in Hrabacov, where it turns upstream to the east to road I / 14 and continues along the border of the KRNAP protection zone to the Spark site near Vrchlabí. In the crossing point of road No I / 14 with the river Belá, the border of the bird area turns north, continues upstream to the river Belá to Certov Mlýn, where it turns east and along the green marked tourist path continues to Vrchlabí. In the area of the Three Estates it passes from a green marked road to asphalt local communication, leads to road No II / 295, where it connects to the border of the KRNAP protection zone, on which it continues to the north and in the Herlíkovic region, on the Shindel road, it returns to the border of KRNAP. It continues along the KRNAP border to the east and further north to the left bank of the Elbe, in the Upper Vrchlabí (about 250 m JV from the Albis hotel) leaving the KRNAP border and crossing the south towards the KRNAP protection zone, which it copies to the City Park in Vrchlabi. At the crossing point with a blue-marked route, the border of the bird region turns northeast, continues along it to plot 1138 / 1 (k. Ou. Vrchlabí), here circling its southwest and southeast edges, returning to the blue-marked path, on which it continues (over the cubit 585.4) to the Little Labi in Lower Dvoře. It continues against the stream of the Little Elbe and the Klínské creek, where about 270 m JV from Kamenný Mlýn crosses the border of KRNAP. It continues along the KRNAP border in the eastern and later southeast direction to the Gulf. Along its flow leads the border of the birds' region in the southwest direction, gradually from the east and further south side bypassing the edge of the limestone quarry, returning back to the Gulf stream and continuing along it to the nameless left-hand inflow (cubicle 498.6) in Upper Lánov. Here it turns east, along the forest and field road heading towards the Bíner location, south-east of it it connects to the asphalt local communication from Prostřemní Lánov, on which it continues through the Confiscates, west of the limestone quarry in Černý Dole, to the end of it - parking at the Bönisch Boudy (pedestal 825 m above). Further, along the unpaved field path, it continues about 250 m northeast to the KRNAP border. It continues along the KRNAP border until the crossing point with road III / 2962 Upper Marshov - Lower Lysečina. Following this communication, the border of the bird region leads south towards the bridge through the Lysečín stream, north of the centre of Upper Maršov, and continues along the local communication on the left bank of Úpa and follows back to the KRNAP border. It continues along the KRNAP border in the south direction towards Maršov II, where it leaves the KRNAP border (at the point of its break towards the east, i.e. about 500 m SV from the bridge through Úpa). It continues after the local communication in the southwest direction to Maršov II, from there it leads in the south direction to the reinforced communication parallel to the left bank of Úpa to the green marked road and follows the next 100 m approximately south direction. Then it turns southeast towards an unpaved forest road, leading up to the green and yellow marked Rose Road. It crosses and along the edge of the forest on the north side of the Kraví hill first rises to the pedestal 675 m above sea level and then falls to the border of KRNAP at the intersection of the Pink and Mank road near the Natural Monument of the Sun Side. Further along the border of KRNAP along the Lower Sejeph and Bystřice to Bednář's path, at the point of cross with the Owl River, the border of the bird region turns south, along the stream of Owl's stream continues to road No II / 300. Along the western edge of road No II / 300, it continues in the north direction to the Plkenný Dol, where it crosses the border of the KRNAP at the crossing point with the Snow Creek. It follows it to the state border of the Czech Republic and the Republic of Poland.
The enclaves of the cities of Spindlerův Mlýn, Pec pod Snežkou and Velká Úpa are not enclosed in the above-defined bird area, as defined as follows:
Spindler's Mill. The enclave border is guided by the road on the dam crown (Labská Valley Tank), it continues to connect to road No II / 295, from which about 50 m later disconnects to the old road. Here it turns on a significant forest road to the west, to the southern edge of the Elbská enclave, where it connects to asphalt communication ("gas pipeline"), along which it leads about 0,5 km northwest to the creek, along which the left bank also rises upstream about 0,5 km until it connects to the forest asphalt route. Following it, it continues about 0.7 km northeast to the outer edge of the tourist slope, following it to the top station of the lift and following the route of the lift back down to the path which leads after the forest and meadow areas of the Elbská enclave and after 200 m continues through the forest, where it connects on the green marked tourist path, which leads up to Bedřichov. It continues along the gangway about 1 km towards the north-east to the southwest edge of the slopes of the Bear. On this slope it leads up to the top station of the cable car, where it turns on the northeastern edge of the second ski slopes down and connects to the tourist asphalt blue marked path to the Girls' Pines, where it crosses the Elbe bridge and before the Myslivna boatshed turns on the north side of road II / 295, from which it turns south on the yellow marked tourist path to Spindlerův Mlýn. From this road the border turns behind the White Labem through a southeast-oriented, yellow-marked tourist path (Woodwork). Following it leads the border to the eastern edge of Špindlerův Mlýn, where it diverts after asphalt communication to the southeast above the enclave of St. Peter; After about 400 m it is connected to the tie above St. Peter. From this after 1.1 km it meets directly to the south significant terrain depression first through the forest and then through the enclave St. Peter to the lower local communication, after which it continues to the east about 180 m, where after connection to road No III / 2958 it continues to the west about 900 m to the bridge through the Dolsk stream. On the right side, it rises up to the lower gangway, along which the direction west after 250 m follows the eastern edge of the tourist slope. On the edge of the ski slope it goes up to the top station of the cable car, here it turns on the west edge of another tourist ski slope. On the edge of the ski slopes it is heading up to the top station of the cable car, there is a turn on the west edge of other tourist slopes over the Plane and Thunder, where it connects to the forest road. On this journey it continues to the border k. Following this border, it heads down to a dedicated asphalt communication at the dam, after which the circuit is closed on the dam crown.
The furnace under Snow and the Big Ear. From the valley of Úpa, the enclave border on the left is led along the forest through a steep slope on the enclave of the Vavrincova mine to the local communication, along which it continues in the north direction above the Great Úpa building to the Javor mine; cross the Mavory stream and along the lower border of the forest towards the northwest continues to the path that forms the border and leads to the enclave of the Stránek. Further along the ski slopes on the Great Pasec it follows the southwest towards the ski trail on the High slope. It continues along this enclave to the Prague hut, behind which it turns sharply towards the west and along the administrative cadastral border of the kiln under Snow and further along the road and the enclave line descends to the Wolf Mine, where after crossing the Wolf's creek it continues along asphalt communication, along the tow route and bypassing the enclave of Brown Hill. From there, following local communication, it meets in the valley of the Green Brook and along the lower border of the forest above the building of the Small and Large Plane falls into the valley of Úpa. It continues along the road leading to the Giant Mine, crossing the Hep River along the road and following the lower forest border along the left bank beyond the retention tank; overloaded the cable car to the Porthage Shacks and further leads to John's Shacks. From there it descends along the road and the border of the lots around the chapel to the edge of the forest on the enclave of the Front Sunshine and down the lower border of the forest further to the river Úpa where the circuit closes.
