Law on the Protection of Olympic Symbols

THE LAW
of 24 February 2000
on the protection of Olympic symbols
In order to strengthen the idea and spirit of the Olympic movement as a means of peaceful understanding and cooperation between nations, the role of the international and national Olympic committees as governing bodies of this movement and to secure the commitments resulting therefrom, Parliament decided on this law of the Czech Republic:
§ 1
Subject matter
This law regulates certain rights and obligations in connection with the use of Olympic symbols and the protection against its misuse; This is without prejudice to the provisions of other legislation. 1)
§ 2
Olympic Symbology
(1) Olympic symbolism is:
(a) the Olympic symbol,
(b) the Olympic flag,
(c) Olympic motto,
(d) Olympic fire;
(e) the Olympic torch,
(f) Olympic anthem,
(g) Olympic emblems,
(h) the terms "Olympic" and "Olympics,"
(hereinafter referred to as the Olympic Symbology).
(2) Olympic symbolism is registered in accordance with existing legislation and international agreements for the protection of industrial and intellectual property, which is the Czech Republic vazan.2)
§ 3
Use of Olympic symbols
(1) Any use of Olympic symbols for commercial, advertising or other similar purposes is only possible on the basis of prior written authorisation; This is without prejudice to the provisions of Part Three of Act No. 137 / 1995 Coll., on Trade Marks, as amended. Written authorisation may be given to the person entitled by the Czech Olympic Committee.
(2) The prohibition of use referred to in the preceding paragraph also applies to any marking which constitutes or contains Olympic symbols or part thereof.
§ 4
Dispute settlement
Disputes concerning the rights and obligations governed by this Act shall be decided by the competent court. (3) The Czech Olympic Committee or the beneficiary may also claim damages which have been caused by the unauthorized use of Olympic symbols.
§ 5
Czech Olympic Committee
(1) The Czech Olympic Committee manages and organises the Olympic movement within the Czech Republic.
(2) The Czech Olympic Committee is an association according to specific regulations.4)
§ 6
Symbols of the Czech Olympic Committee
(1) The symbols of the Czech Olympic Committee are mainly the emblem and flag of the Czech Olympic Committee. The Czech Olympic Committee can also create other derived Olympic symbols.
(2) The symbols of the Czech Olympic Committee are entered as trade marks in the relevant register under a special law. 1)
(3) Paragraphs 3 and 4 of this Act apply mutatis mutandis to the use and protection of symbols of the Czech Olympic Committee.
§ 7
Efficacy
This Act shall take effect on 1 May 2000.
